RESOLUTION
RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION #2260 - SCHOENIG
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the request for Recorded Exemption #2260 was submitted by Darrell
Schoenig, 6166 Red Ridge Trail, Bellvue, Colorado 80512, for property which is located in part
of the NY of the SE% of Section 19, Township 9 North, Range 67 West of the 6th P.M., Weld
County, Colorado, and
WHEREAS, this request is to divide the property into parcels estimated to be
approximately 44.1 acres and 34.9 acres, and
WHEREAS, after reviewing the Planning staffs concerns and hearing the testimony
presented, the Board determined that said request shall be denied for the following reasons:
1. It is the opinion of the Board of County Commissioners that this proposal evades
the purpose of the Weld County Subdivision Ordinance as defined in Section 1.3.
2. The Board feels this division would be inconsistent with efficient and orderly
development.
3. The Board feels this proposal is not consistent with the Weld County
Comprehensive Plan.
4. The Board feels this proposal increases the need for more urban-type services in
the area.
5. The conflict between rural and urban activities is evident in this request. When
an urban growth pattern is established without regard to long range
comprehensive planning, the outcome lacks the essential elements of long term
desirability. Higher costs are incurred by providing many public services to urban
sprawl area. As urban areas develop and expand they inadvertently influence
surrounding areas. These areas are either converted to urban uses themselves
or are in direct conflict and competition with agricultural area.
6. The applicant has failed to comply with the A (Agricultural) Zone District intent.
This parcel is located outside of an Urban Growth Boundary Area. Continued
division of this parcel emphatically opposes the intent of the A (Agricultural) Zone
District. The potential to interfere and encroach upon the agricultural activities of
this are is evident. The A (Agricultural) Zone District was established to promote
and maintain agriculture as a vital support element for Weld County citizens, and
not to be continually decrease for residential development. The A (Agricultural)
Zone District policies discourage the conversion of agricultural land for residential
uses within an area located outside of an urban growth boundary. The intent is to
eliminate incompatibilities that exist and minimize costs to Weld County tax-
payers.

Dear Commissioners:
Darrell Schoenig has requested two Recorded Exemptions to occur on the North %2 of the Southeast
1/4 and the North 1/2 of the Southwest 1/4 of Section 19, Township 9 North, Range 67 West of the
6th P.M. The two 80-acre parcels are located North of and adjacent to unimproved WCR 102 and
East of and adjacent to unimproved WCR 13. The parcel of land under consideration is the total
contiguous land holdings of the applicant.
Based upon submitted information,referral agencies, and the governing mechanism of the County,
the Department of Planning Services' staff recommends this request be denied.
The applicant is requesting to divide this section into 4 parcels. The staff believes the applicant has
evaded the intent of the recorded exemption process by creating multiple lots without utilizing the
appropriate subdivision process. The result is a quarter section which has been inundated with
piecemeal development.
Staff has the following concerns:
1. The applicant has not demonstrated that this application is consistent with efficient and
orderly development. These are the second and third requests for Recorded Exemptions in
the South half of this section, two of which are being submitted by this applicant, creating
seven lots:
Recorded Exemption 2201, Mike Coco and Willow Bartruff, Submitted on March 19, 1998
and approved April 16, 1998, created two buildable lots in the South 1/2 of the South 1/2 of the
South '/2 of this section

2. The conflict between ...ral and urban activities is evident in this request. When an urban
growth pattern is established without regard to long range comprehensive planning the
outcome lacks the essential elements of long term desirability. Higher costs are incurred by
providing many public services to urban sprawl areas. As urban areas develop and expand
they inadvertently influence surrounding areas. These areas are either converted to urban
uses themselves or are in direct conflict and competition with agricultural areas.
3. The applicant has failed to comply with the A(Agricultural) zone district intent. This parcel
is located outside of an Urban Growth Boundary Area. Continued division of this parcel
emphatically opposes the intent of the A (Agricultural) zone district. The potential to

development. The Agricultural zone policies discourage the conversion of agricultural land

is to eliminate incompatibilities that exist and minimize costs to Weld County tax-payers.
Instead of applying for and adhering to the appropriate subdivision regulations the applicant has
chosen to subdivide the land without regard to the long term impacts of the divisions. By doing so,
the applicant has not been required to pay for the cost of public services and improvements that his
current proposed divisions are producing. The Department of Planning Services' staff is concerned
with this lack of consistency with the Comprehensive Plan and Subdivision Ordinance.
Specifically, the Department of Planning Services' staff recommendation of denial for this request
is based upon the application's inconsistency with Section 1.3 of the Weld County Subdivision
Ordinance, which ensures orderly and efficient subdivision development within the county, and
conflict with A. Goals 1, 3, 4, 6, 7, and 9 of the Comprehensive Plan, which define appropriate
development goals and policies within the Agricultural zone district.
Scattered residential development in rural areas necessitates an increased demand for roads and
bridges, police and fire protection, education facilities, utilities and other services. The cost of
providing services and the conflicts between rural and urban land uses can be reduced if
development is encouraged within urban growth boundary areas or are adjacent to existing
municipalities.
The Department of Planning Services' staff requests that the Board of County Commissioners
consider the application and determine if the standards of Sections 11.2 through 11.8 of the Weld
County Subdivision Ordinance have been met and adhere to the goals and policies of the Weld
County Comprehensive Plan.

COMMENTS: On-site and surrounding area both very rough terrain including rolling
hills and dry pasture and weeds. WCR 102, the only east/west access to the site is a
one-lane unimproved road, making reasonable access very difficult. WCR 15, the only
north/south access, is barely passable with a non-4 wheel drive vehicle. The only man-
made feature in the area is a large single family home that is under construction
immediately to the east.

The West Greeley Soil Conservation District has completed review of the application for Recorded
Exemptions, Case Numbers RE-2259 and RE-2260 and has several comments. The access for these
properties is limited as the county roads are all undeveloped. The owner states that a road will be built
and an association formed, but the parcels are still remote and this will prove to be a problem for the
purchasers. These parcels are located in a rolling to rough area and this may be a hindrance to
building development, including septic systems and wells on smaller parcels.
These parcels and a number of other parcels in this area have been purchased in 80 acre lots and
are constantly being split into smaller pieces. Several farmers in the area have been approached by
the purchasers of these small parcels in an attempt to have the pieces farmed. This is not feasible.
Their highest and best use is grass. The district is concerned that there may be some
misrepresentation of suitability as to the land use or number of livestock the parcel is able to carry.
The district has developed a small-acreage manual designed to be a reference for information of
this nature. Would there be any way to require the purchasers of these parcels to make contact with
the district, Natural Resources Conservation Service or the Weld County Cooperative Extension?

These RE cases will be reviewed as one as they adjoin each other. The applicant is indicating the access to all
four parcels will be from LCR 66 onto WCR 102 then north on WCR 13. Both county roads are unimproved and
have section line designations.
The Clerk to the Board records is showing the county has no dedication on WCR 13 or WCR 102.
REQUIREMENTS:
The applicant needs to provide adequate documentation on easements, rights-of-way, or dedication from adjacent
landowners to access the four parcels. Once this access is in place, it needs to be placed on the plat and deed.
If new or existing access is secured, the county would recommend the width to be 30 feet. This would correspond
with Subdivision Ordinance 10.5.10 and Section 20.2 of ordinance #180, Width of Right-of-Way.
I would recommend that each parcel be granted one access and avoid circle drives and additional accesses.
If and when access to these parcels is secure, they will be designated as privately maintained rights-of-way or
easements.
Footnote: These RE's, adjacent to each other and being the same applicant, are pushing the envelope on the
minor subdivision requirements.
