Due to circumstances outside our control, we wish at this time to rescind our agreement to this proposal. It has come to our attention that there is impending litigation related to the Third and Fourth Filing of West Hill-N-Park,and we have been advised that our involvement in attempting to represent the homeowners in this area might put us at personal legal risk. We apologize for the inconvenience this may cause. Our intent from the beginning was to be involved as citizens in the process of improving the area in which we live. However,we simply do not have the resources to defend ourselves from legal actions that we have been advised may occur. We will no longer be involved as representatives of the homeowners until such time as we are legally supported by involvement in the property owner's association that has been established for our use. Attached is an example of the form the park could take, including prices and examples of park equipment provided by Mr. Lundvall. However, our homeowners have requested both the opportunity to be involved in the creation of the park, and the discretion to make some changes as they deem appropriate. With that in mind, we request that the Weld County Commissioners approve the following: -Mr. Lundvall will provide$20,000 to an account to be supervised by a member of the Planning and Zoning staff, and accessed by authorized executives of the West Hill-N-Park Property Owners Association (once our homeowners have assumed the corporation). Half of the money ($10,000) will be dedicated to the parks in the Third Filing area, and the other half($10,000)will be dedicated to the parks in the Fourth Filing area. - Our homeowners ask that they be given discretion in their use of the money, including the possibility of purchasing a water tap to serve the park(s), with approval of the Planning and Zoning staff member (as stated above). -Our homeowners will commit to significant, if not complete establishment of the parks in the Third Filing area by January 1, 1997. -Our homeowners will commit to taking responsibility for the establishment of the parks in the Fourth Filing area when the Property Owners Association determines there are enough homes erected in that area for the park to be appropriately used and maintained. The homeowners we have rcp«sented in this discussion process are quite prepared to help put in these parks, and we feel their involvement will be of great value toward our working as a community and creating and enjoying the parks we desire. The only caveat to this process is if there is any (presently unforeseen) problem(s) with assuming the Property Owner's Association and implementing the covenants and/or homeowner's assessments. Without the proper authority of the Property Owner's Association, we may not be able to maintain our . commitments. As of this time,we are taking the actions to assume this association,and we have no reason to believe there will be any problems with this. We feel very positive about the installation of these parks, and we appreciate the efforts of Mr. Roy Lundvall,Mr. Mike Thomas, and Mr. George Ottenhoff in working with us to reach a fair and amicable accord on this matter. With the conditions stated above, we support their plans. Commissioners Greeley, CO Attached herewith is another piece of propaganda which the Baesslers have given to each homeowner at Hill N Park and West Hill N Park. It concerns the meeting regarding West Hill N Park 4th Filing and the parks which are to be built. Granted, parks are a nice addition to any com- munity. However, most parks are located within city limits and the city government takes care of them. The parks in West Hill N Park will have to be taken care of by the homeowners therein and I really don' t see any volunteers stepping forward to promote an active Homeowner 's Association to deal with the day-to-day maintenance and costs. Speaking of costs, I foresee dues being charged each homeowner to care for these parks and if a vote were taken today, most would not want to con- tribute a single dime to pay for parks ! It is unfortunate that the Baesslers have used the 4th filing process to promote their own self-serving interest in 3rd filing. They can afford to create problems now as they won' t be around in the future to pay for them! The location will be the Commissioners Hearing Room 915 10th St on the 1st floor. The issue being discussed is park development in your neighborhood_ The County Staff is trying to get Roy Lundvall and partners to construct parks to a standard that will adequately serve your neighborhood. Less than full cooperation has been exhibited by Mr Lundvalls and Shupe. At Wednesday's meeting the Commissioners will decide whether the Parks will be built to a public standard and in accordance with the approved West Hall-N-Park official unit development plan and covenants or Mr Lundvall's and Shup's standard. The approved plan calls for such items as swings slides and other play or recreation amenities. The developer does not want to pay for some items and his landscape plan including tees and sprinklers is less than adequate. It is vital that those who live in the area express their concern. Including those persons living in the original East filing where parks were promised but never built You were promised parks and you have paid for parks. Yet, in spite of developer and County promises you have no parks to date. These parks will enhance both your property values and your quality of life. They are yours by right. This may be your last chance for your voice to be beard. If the Commissioners are to stand up for your neighborhood and not bow to the pressure from the developers there must be a good representation from all parts of West Hill N Park Please find a way to be there.
