SUBJECT: USR-1143, KKDD-FM Broadcasters
USR-1143 was approved by the BOCC on May, 14, 1997. The USR was for a 493' radio booster station. The
applicant, Bob Zellmer, has been in contact with the Department regarding certain conditions of approval. As
this case is becoming rather confusing, the Department of Planning Services would like to update the Board
on the process in which Mr. Zellmer and the Planning Department are pursuing.
UPDATE ON USR-1143
COA#6E : This condition states that the Special Use Permit(SUP-3)currently on the site,which
was for a commercial hog operation, shall be vacated prior to recording the USR
plat. SUP-3 encompasses a total of 15 properties. The ideal remedy to vacate this
SUP would be to have all 15 property owners write a letter in favor of the vacation
or to sign petition. The Department of Planning Services sent letters to all affected
property owners and has received responses for the vacation from 6 owners (40
percent of the total). In addition to the letters, staff has also followed up with a phone
call to those not replying to the letter. Staff has left messages for the majority of the
property owners, however two persons did indicate that they are writing the letter for
the vacation. When discussing the situation with Lee Morrison, he indicated that for
a small portion of the property owners not responding, a letter could be mailed
stating that as no response was received, the permit was vacated. Lee, did say that
this should not be done for the majority of the responses.
Another option to vacate the permit would be to schedule it for Probable Cause/
Show Cause hearings. Staff has also created a petition list for Mr. Zellmer to give
him the option of hand delivering the vacation request to the affected property
owners to obtain their signatures. Mr. Zellmer indicated that he did not think that this
approach would be wise, as people in the area did not want the tower to be erected.
COA#6F: This condition states that the mobile home on the site permitted as an accessory to
the farm shall be either removed from the site or documentation provided to
substantiate its use. Documentation was provided from the resident of the mobile
home that they currently do not have any animals on the site. She indicated that
they may in a couple of months buy some hogs and that they are in the process of
remodeling their home on another site and will move into that when it is completed.
A 5-day violation letter was sent by Julie Chester to Mr. Croghan, the property
owner. This condition must be taken care of prior to recording the USR plat.
