HomeMy WebLinkAbout980305.tiff HEARING CERTIFICATION DOCKET NO. 98-08 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT#1177 FOR AN ACCESSORY BUILDING WITH GROSS FLOOR AREA LARGER THAN 1,500 SQUARE FEET (2,400 SQUARE FEET) IN CASAGRANDE ESTATES SUBDIVISION IN THE A (AGRICULTURAL)ZONE DISTRICT - DARYL HAFELE A public hearing was conducted on February 18, 1998, at 10:00 a.m., with the following present: Commissioner Constance L. Harbert, Chair- EXCUSED Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Scott Ballstadt Health Department representative, Sheble McConnellogue Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated January 16, 1998, and duly published February 4, 1998, in the Platteville Herald, a public hearing was conducted to consider the request of Daryl Hafele for a Site Specific Development Plan and Special Review Permit#1177 for an Accessory Building with Gross Floor Area larger than 1,500 square feet (2,400 square feet) in Casagrande Estates Subdivision in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Scott Ballstadt, Department of Planning Services representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Ballstadt stated this proposal is for a 2,400 square foot accessory building, located in Casagrande Subdivision, which is also located in the Firestone Urban Growth Boundary area south of Weld County Road 22. Mr. Ballstadt referenced the Town of Firestone's referral response stating the Town has no conflicts with the proposal, and added the proposal is compatible with the surrounding uses. In response to Commissioner Baxter, Don Carroll, Public Works representative, stated he is concerned about a structure being placed within the utility easement and displayed a map to the Board. Mr. Ballstadt explained the proposed structure is not in the easement; however, the existing house is. Daryl Hafele, applicant, stated he feels his proposal is consistent with the other existing uses in the area. In response to Commissioner Webster, Mr. Hafele stated he is in agreement with the Conditions of Approval and Development Standards. Responding to Commissioners Baxter and Kirkmeyer, Mr. Hafele explained his proposed building will be constructed with a steel frame and steel siding, similar to others in the area in both size and material and added he is 980305 C� ; Pt PL1240 HEARING CERTIFICATION - DARYL HAFELE (USR#1177) PAGE 2 not aware of a housing group which will enforce any covenants. He also gave a brief overview of the other structures in the area. In response to Commissioner Baxter, Mr. Hafele explained the current barn is not recorded on the original plat and will be torn down and replaced by the new structure. Responding to Commissioner Hall, Mr. Hafele stated he has no intention of running a business from the shop; rather he plans to use it for metal and wood working, and for storing his racing vehicles. Mr. Hafele clarified for Commissioner Kirkmeyer that the shed is not within the utility easement and added he spoke with members of the Planning Commission who stated not much can be done about the existing structure. No public testimony was offered concerning this matter. Commissioner Kirkmeyer questioned if Development Standard #10 could be misinterpreted to mean no commercial or industrial uses, even if they are not for business purposes. In response to Commissioner Kirkmeyer, Lee Morrison, Assistant County Attorney, stated the word "uses" is consistent with the Zoning Ordinance. Commissioner Kirkmeyer clarified for the record that though the applicant will be involved in uses as discussed, he has no intention of using the structure for business purposes. Commissioner Hall moved to approve the request of Daryl Hafele for a Site Specific Development Plan and Special Review Permit for an Accessory Building with Gross Floor Area larger than 1,500 square feet (2,400 square feet) in Casagrande Estates Subdivision in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Baxter, and it carried unanimously. This Certification was approved on the 23rd day of February, 1998.
