RE: VIOLATIONS OF THE WELD COUNTY ZONING ORDINANCE
A public hearing was conducted on November 9, 1999, at 10:00 a.m., with the following
present:
Commissioner Dale K. Hall, Chair

The following business was transacted:
I hereby certify that a public hearing was conducted to consider whether to authorize the County
Attorney to proceed with legal action against the individuals named for violations of the Weld
County Zoning Ordinance. Cases were heard as follows:
VI#9900119 -BAUSERMAN: Joe Mendez, Department of Planning Services, presented the case
report for the record and stated the property is in violation of the Weld County Building Code
Ordinance. Responding to Chair Hall, Mr. Mendez stated no work has been started and the mobile
home remains connected to the delivery truck.
Mr. Bauserman, property owner, was present at the hearing. Mr. Bauserman stated the mobile
home was to be a home for his parents, but due to their health problems and eventual death of his
father he has been unable to complete the work. Mr. Bauserman further added the health
problems of his parents caused him financial hardship and he needs additional time to complete
the necessary work.
Commissioner Kirkmeyer moved to refer VI #9900119 against Richard Bauserman to the County
Attorney for legal action,with the instruction to delay action upon such referral until March 31, 2000,
to allow adequate time for the property to be brought into compliance. The motion was seconded
by Commissioner Baxter, and it carried unanimously.

VI #9900117 - CARRILLO: Mr. Mendez presented the case report for the record and stated the
property is in violation of the Weld County Building Code Ordinance. Mr. Mendez stated only the
installation and inspection of garage doors is needed to bring the property into compliance.
Mr. Bradford Carrillo, property owner, was present at the hearing. Mr. Carrillo stated due to
financial difficulties, he has been unable to complete the work and needs additional time.
Commissioner Geile moved to refer VI #9900117 against Bradford and Donna Carrillo to the
County Attorney for legal action, with the instruction to delay action upon such referral until
February 15, 2000, to allow adequate time for the property to be brought into compliance. The
motion was seconded by Commissioner Kirkmeyer, and it carried unanimously.
VI #9900142 - POE/RYAN: Julie Chester, Department of Planning Services, presented the case
report for the record and stated the property is in violation the Weld County Zoning Ordinance. Ms.
Chester stated the original permit for the mobile home located on the property was for a medical
hardship involving the property owners' daughter, Melissa Ryan. Ms. Chester further stated the
daughter is no longer living in the mobile home which is now owned and occupied by Terrell Graf.
Mr. Poe, property owner, was present at the hearing. Mr. Poe stated Terrell Graf purchased the
mobile home, however, in exchange for farm work being done on the property, he is paying for Mr.
Grafs' rent and utilities. Mr. Poe added he is financially unable to employ Mr. Graf full-time but
needs help with his farming.
Commissioner Kirkmeyer moved to dismiss VI #9900142 against Roger and Judy Poe, and
directed Department of Planning Services staff to work with the property owners in obtaining the
permit(s) necessary to bring the property into compliance. The motion was seconded by
Commissioner Baxter, and it carried unanimously.
VI #9900233 -VEIK/SCHMIDT: Ms. Chester presented the case report for the record and stated
the property is in violation of the Weld County Zoning Ordinance. Ms. Chester state the only
remaining violation on this property is the fencing/screening of buses located on the property.
Mr. Veik, property owner, was present at the hearing. Mr. Veik stated he purchased the property
and inherited the junk located on the property. Mr. Veik further added, he has moved the buses
beside an outbuilding located on the property and will be willing to put up fencing to further screen
them. After further discussion, the Board requested Mr. Veik to work with staff to move the buses
behind the outbuilding and to assure appropriate landscaping screens the buses from adjacent
property.

Commissioner Kirkmeyer moved to refer VI #9900233 against Ronald and Bonnie Veik to the
County Attorney for legal action, with the instruction to delay action upon such referral
until May 31, 2000, to allow adequate time for the property to be brought into compliance. The
motion was seconded by Commissioner Baxter, and it carried unanimously.
VI #9900207 - GUILLORY: Ms. Chester presented the case report for the record and stated the
property is in violation of the Weld County Zoning Ordinance. Ms. Chester stated at the most
recent inspection of the property, some progress has been made towards bringing the property into
compliance, however, a non-commercial junkyard still exists.
Mike or Lois Guillory, property owners, were not present or represented at the hearing.
Commissioner Kirkmeyer moved to refer VI#9900207 against Mike and Lois Guillory to the County
Attorney for legal action, with the instruction to delay action upon such referral until December 9,
1999, to allow adequate time for the property to be brought into compliance. The motion was
seconded by Commissioner Vaad, and it carried unanimously.
VI #9900181 - TODD: Ms. Chester presented the case report for the record and stated the
property is in violation of the Weld County Zoning Ordinance. Ms. Chester stated the property
owners have never completed the application process for a Site Plan Review.
John or Tate Todd, property owners, were not present or represented at the hearing.
Commissioner Baxter moved to refer VI #9900181 against John and Tate Todd to the County
Attorney for immediate legal action. The motion was seconded by Commissioner Kirkmeyer, and
it carried unanimously.
VI #9900266 -THURTELL: Mr. Mendez presented the case report for the record and stated the
property is in violation of the Weld County Building Code Ordinance. Mr. Mendez stated he would
like to try and contact the property owner again to schedule the inspections required.
Robert Thurtell, property owner, was not present or represented at the hearing.
Commissioner Baxter moved to refer VI #9900118 against Robert Thurtell to the County Attorney
for legal action, with the instruction to delay action upon such referral until December 9, 1999, to
allow adequate time for the property to be brought into compliance. The motion was seconded by
Commissioner Geile, and it carried unanimously.
