A public hearing was conducted on July 9, 1997, at 10:00 a.m., with the following present: Commissioner George E. Baxter, Chair Commissioner Constance L. Harbert, Pro -Tern Commissioner Dale K. Hall - EXCUSED Commissioner Barbara J. Kirkmeyer Commissioner W. H. Webster Also present: Acting Clerk to the Board, Carol Harding Assistant County Attorney, Lee Morrison Planning Department representative, Shani Eastin The following business was transacted: I hereby certify that pursuant to a notice dated June 16, 1997, and duly published June 26, 1997, in the South Weld Sun, a public hearing was conducted to consider the request of Kenneth and Jay Littlefield / Children's ARK, Inc., for a Site Specific Development Plan and Special Review Permit #1150 for a Commercial Use (Residential Child Care Facility) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Shani Eastin, Department of Planning Services representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Eastin stated the proposal is consistent with the Weld County Comprehensive Plan, the intent of the Agricultural Zone District, the existing surrounding land uses, and future development of the surrounding area; and is not located within the Overlay District Areas, but is located on gently rolling hills; and the Design Standards, Operation Standards, Conditions of Approval, and Development Standards ensure there are adequate provisions for the protection of the health, safety, and welfare of the inhabitants of the neighborhood and county. Ms. Eastin presented a copy of an Agreement Regarding Education Services at the Children's ARK site at Raymer Ranch, marked Exhibit B. She recommended a change to the first sentence of Development Standard #3 to read: "The facility shall allow for youths of ages permitted by the pertinent licensing authority" to address the concerns stated by the Planning Commission regarding limiting ages of the youth in the program. Jay Littlefield, applicant, answered questions from the Board concerning the age limits. Chair Baxter questioned whether the various impacts by the school district were determined with the ages being set at 10 through 17, or whether it was looked at with no age limit included. Mr. Littlefield explained the age limit and number of youth is determined by the State license. He also explained the private school operated by Children's ARK in Sterling would be able to provide school for some of the youth if School District RE -11 could not handle them. Commissioner Kirkmeyer asked that a Development Standard be added to ensure the agreement is executed and finalized. No public testimony was offered concerning this matter. Commissioner Webster moved to approve the request of Kenneth and Jay Littlefield for a Site Specific Development Plan and Special Review Permit #1150 for a commercial use (Residential Child Care Facility) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Kirkmeyer, who included the change in language of Development Standard #3 as discussed; the addition of Development Standard #13 to require an executed agreement between the applicant and school district prior to the plat being recorded; and the renumbering of #13 and #14. Commissioner Webster agreed to the inclusion to the motion, and it carried unanimously. This Certification was approved on the 14th day of July, 1997.
