HomeMy WebLinkAbout971982.tiffRESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST VERA GLENDENING FOR VIOLATION OF THE WELD COUNTY BUILDING CODE ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Vera Glendening, VI #9700117, is allegedly in violation of the Weld County Building Code Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 9th day of September, 1997, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Vera Glendening, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until November 1, 1997, to allow adequate time for the property owner to secure the appropriate permits to convert subject residence to storage use and disconnect electrical service to said residence and for an inspection of the property by the Department of Planning Services staff. Lupton, CO 80621 Subject: VI -9700117, Abatement of Dangerous Building Legal Description: E2NW4 Section 9, T01N, R65W of the 6th P.M., Weld County, Colorado 14374 WCR 12 Dear Mrs. Vera Glendening This letter is to inform you that the residence located at 14373 WCR 12 was inspected on May 16, 1997 and July 7, 1997. Due to the following conditions it has been determined to be dangerous and substandard in accordance with Section 302 of the Uniform Code for the Abatement of Dangerous Buildings and Section 20.13 of the Weld County Building Code Ordinance. 1. On May 16, 1997 the crawlspace was flooded and inaccessible. On July 7, 1997 the water in the crawlspace had been removed. It appears that the exposure to this moisture and lack of adequate ventilation has began to deteriorate the floor system. The floor system of the south addition is constructed directly on an existing slab. The floor joist are not of redwood or pressure treated material. The floor in this portion of the building is not provided with a subfloor and is not of adequate strength to comply with the requirements of the Uniform Building Code. 2. The foundation system on the southeast and southwest comers of the original house have either been removed or deteriorated to the point at which they no longer comply with the requirements of the Uniform Building Code. A portion of the crawlspace foundation wall is constructed of wood. This wood is not of material resistant to decay or pressure treated material. The south addition appears to be built directly upon an existing slab without a foundation that extends below frost depth. 3. The building has faulty weather protection in that the installation of the new siding is not completed and the windows need repaired and/or replaced. Service, Teamwork, Integrity, Quality 971.,82 4. The unit heater has been replaced without the appropriate permits. This unit heater is not installed in compliance with the Uniform Mechanical Code. It is not provided with the required clearances from combustible materials which constitutes a fire hazard. The hot water heater flue appears to be single wall pipe and is required to be a listed double wall vent. 5. The plumbing system is not installed in compliance with the Uniform Plumbing Code and is considered substandard. 3. The electrical system is not installed or maintained in accordance with the National Electrical Code and constitutes a hazard. 5. The Weld County Health Department has issued a Cease and Decease Order for the occupancy and use of the existing septic system. Please contact the Weld County Health Department at 970-353-0635 for information concerning this issue. Based upon the above items it has been determined that this residence is dangerous and must be tabated by either demolition, repair, or converted to storage. You are hereby ordered to take steps, by August 4, 1997, to ensure that no further use or occupancy of the building is allowed. If you choose to demolish, repair, or convert the building to storage, you are hereby ordered to secure the appropriate permits by August 15, 1997. The following are your options and requirements: 1. DEMOLITION OF THE BUILDING a. Prior to the release of any demolition permit, an industrial hygienist or asbestos inspector will be required to evaluate the building for the presents of asbestos. 2. REPAIR OF BUILDING a. The foundation on the southeast and southwest comer of the original house will be required to be repaired and or repaired. The foundation supporting the south addition to the original house will be required to be evaluated by an engineer or a foundation installed in compliance with the Uniform Building Code. The floor joist installed on the south addition will need to be replaced with material resistant to decay or of pressure treated material. A subfloor shall be installed in the south addition. b. The installation of the siding shall be completed and the windows shall be repaired/replaced to provide a weather proof baffler. c. The hot water heater vent shall be replaced with a listed double wall vent installed in accordance with its listing. d. The unit heater shall be relocated to comply with the required clearances from combustible material or a unit heater listed for reduced clearances shall be installed. The plumbing system including drainage, waste and vents shall be installed such that all drains slope a minimum of one quarter inch per foot toward the main drain. All drainage piping shall be of material that is approved for such use. The bathroom and kitchen sink are provided with top vent "s" traps that are not allowed. The bathroom sink is not provided with a vent. The plumbing system in these areas shall be installed in accordance with the Uniform Plumbing Code. f. The following electrical items were noted and shall be corrected. There may be other hazardous items or wiring that are not readily apparent and are not noted. Attach electrical meter and service securely to yard pole. ii. The following corrections are required at the electrical panel. (1) The panel needs to be permanently attached to the exterior of the house. (2) The panel needs to be provided with grounding electrodes as specified in the National Electric Code. (3) The neutral in the panel shall be bonded. (4) All above grade PVC conduit shall be a minimum of schedule 80. iii. The subpanel inside the house needs to be provided with four wire service as specified in the National Electric Code. (1) Isolate the neutral bar and ground bar from each other. iv. The exposed wiring on the two outside light boxes shall either be removed, or an approved exterior light installed. The metal light box on the south end of the house shall be grounded. v. The motion detector light in the kitchen shall be installed according to the National Electric Code or removed. vi. The receptacle on the south wall of the kitchen has been damaged and pushed back into the wall. This shall be repaired and a cover plate installed. vii. Install device plates throughout the house. viii. The exposed "romex" to the dryer needs to be protected from damage. ix. Install a knock out seal into two circuit fuse box in the bathroom. x. A light fixture shall be installed in the bathroom ceiling. 3. CONVERSION OF THE BUILDING TO STORAGE a. If you decide to convert the building to storage, which is an unoccupied structure, all utilities, except electrical, will be required to be disconnected. Failure to comply with this order may result in the posting of the property and the demolition work being performed under the direction of Weld County and the costs thereof charged to you as the owner pf the property. You, or any person having any record title or legal interest in this building, may appeal this action to the Weld County Building Code of Appeals provided the appeal is made in writing, as provided in Chapter 5 of the Uniform Code of the Abatement of Dangerous Buildings, as adopted by reference in the Weld County Building Code Ordinance. Such notice shall be filed in our office within thirty days from the date of this notice. Vera Glendenning requested the meeting on June 3, 1997 and notice had not been sent to her within the forty-eight hours. The Health Department, upon considering the statements of witnesses, having considered the reports herein, and being otherwise advised in the premises, DOTH FIND AND ORDER: 1. That the Respondent was properly served with a Certified Letter, giving notice of this hearing and has been adequately advised of the condition which is the subject of this hearing and has waived the requirement of 48 hours notice of hearing. 2. That the Respondent has created and continues to allow to exist a regularly reoccurring condition which is a nuisance. In particular, the Respondent has failed to comply with Section 3.1 of the Individual Sewage Disposal System Regulations which requires that the structure maintained as a residence by the Respondent must contain an adequate, convenient, sanitary toilet connected to a sewage disposal system 1 in good working order and that under no conditions shall sewage or effluent be permitted to be discharged upon the surface of the ground. Furthermore, Respondent has violated §3.17 C. , E. and F. which prohibit maintaining a cesspool, an Individual Sewage Disposal System which lacks sufficient separation from groundwater or a dwelling without adequate facilities for the sanitary disposal of sewage. Specifically the leach field is found to be failing and sewage is being discharging to the surface by means of bypass pipes. 3. The Respondent has previously exhibited a pattem and practice of removing tenants from the subject building when cited for violations only to re -lease the property as a residence. It is found that the likelihood of reoccurrence of a discharge at anytime the structure is occupied is sufficient to consider this to be an ongoing nuisance. 2 971.f:'1.12 THEREFORE, IT IS ORDERED that the Respondent cease and desist from the use of the structure at 14374 WCR 12, Ft Lupton, Colorado, for any form of human habitation unless and until the residence is connected to and being serviced by an individual sewage disposal system designed and and installed in accordance with the Weld County Individual Sewage Disposal System Regulations. A pipe was found leading from a depression above the septic tank to a ditch. An algal bloom was found in the ditch. Kitchen sink sewage plumbed to discharge upon the surface of the ground. Sewage line from under bathroom plumbed to discharge into a ditch to the south of residence. Found groundwater (limiting zone) at less than three (3) feet below grade. VINCENT ALSO INDICATED TO ME THAT HE HAD MADE A CONTRACT WITH VERA GLENDENING TO DO SOME WORK INCLUDING WORK ON THE RESIDENCE IN EXCHANGE FOR A DEDUCTION FROM THE RENT. VINCENT ADVISED THAT HE HAD GIVEN VERA THE RECEIPTS AND REQUESTED PAYMENT OR A DEDUCTION OFF OF THE RENT. SHE ADVISED THAT SHE HAD NOT HAD A CHANCE TO GO THROUGH THE RECEIPTS AND THAT SHE WANTED HER RENT RIGHT THEN. VINCENT DID NOT GIVE HER THE RENT AND SHE BECAME VERBALLY IRATE. VINCE INDICATED THAT THERE ARE A COUPLE OF PLACES THAT PUDDLE UP AND THAT HAVE STAYED FULL OF WATER SINCE THEY MOVED IN ON APRIL 10TH. HE ALSO INDICATED THAT THE CRAWL SPACE HAS APPROXIMATELY 18 INCHES WORTH OF WATER IN IT AND HAS STAYED THAT WAY OR GOTTEN DEEPER SINCE APRIL 10TH OF THIS YEAR. VINCE INDICATED THAT THE LAST TIME HE TALKED WITH ME, THERE WAS A PADLOCK ON HIS PHONE BOX. HE ADVISED THAT THE PHONE COMPANY HAD COME OUT AND HAD FOUND AN UNAUTHORIZED AND UNKNOWN WIRE ATTACHED TO THE PHONE BOX. THE ENDS OF THE WIRE WERE FRESHLY STRIPPED AND NOT OXIDIZED. THE PHONE COMPANY DID NOT KNOW WHERE THE WIRE WENT AND PULLED IT OUT OF THE GROUND TO A CONCRETE SLAB JUST OUTSIDE THE RESIDENCE. AT THAT POINT IT DISAPPEARED INTO THE GROUND GOING TO AN UNKNOWN LOCATION. I ASKED VINCE IF HE HAD HAD ANY INDICATION THAT VERA MIGHT BE LISTENING TO HIS PHONE CONVERSATIONS AND HE SAID THAT HE HAD FELT THAT SHE HAD BEEN MAKING COMMENTS ABOUT THINGS THAT HE BELIEVED TO HAVE BEEN SAID IN PRIVATE, BUT THAT HE WAS UNABLE TO GIVE ME ANY SPECIFIC EXAMPLES. VINCE INDICATED THAT HE HAS NOT RECEIVED A SINGLE PIECE OF MAIL SINCE MOVING IN ON APRIL 10TH. HE HAS NOT RECEIVED ANY PHONE BILLS OR PAPERS FROM WORK AND HAS BEEN THERE FOR OVER A MONTH. VINCE ADVISED THAT HE TALKED WITH THE NEIGHBORS WHO ONE IN PARTICULAR HAS SEEN VERA GOING THROUGH HIS MAIL. I ADVISED VINCE THAT I WOULD TALK WITH THE NEIGHBOR AND SEE IF SHE COULD ADVISE ANY ADDITIONAL INFORMATION. I TOOK SOME PHOTOGRAPHS OF THE PROPERTY WHERE VINCE SHOWED ME WERE STANDING PUDDLES. PHOTO NUMBER ONE WAS A PICTURE OF THE WEST SIDE OF THE RESIDENCE AT THE SEPTIC ACCESS WHICH IS COVERED BY A PIECE OF PLYWOOD. PICTURE NUMBER TWO IS ALSO THE WEST SIDE UNDERNEATH THE PLYWOOD. PHOTO NUMBER THREE WAS ALSO ON THE WEST SIDE OF THE RESIDENCE AND A SINK HOLE UNDER THE KITCHEN SINK OUTSIDE THE RESIDENCE. PHOTO NUMBER FOUR WAS ALSO WEST SIDE TOWARDS THE SOUTH END OF THE PROPERTY WHERE A HOLE WAS DUG IN THE GROUND AND IT WAS FULL OF WATER. IT WAS AN UNKNOWN DEPTH. PHOTO NUMBER FIVE WAS A PICTURE ON THE EAST SIDE OF THE RESIDENCE AT A CRAWL SPACE ACCESS. THERE IS A WATER PUDDLE TO THE SOUTH OF THE ACCESS THAT HAS BEEN THERE SINCE APRIL 10TH. VINCE ADVISES THAT IT FLUCTUATES, BUT IS CONSTANTLY THERE. PHOTO NUMBER SIX WAS ALSO A CRAWL SPACE ACCESS LOOKING INSIDE. AS OF MAY 13TH, VINCE HAD MEASURED THE DEPTH OF THE WATER, IT WAS 18 INCHES AT THE ENTRANCE. PHOTO NUMBER SEVEN WAS A PICTURE ON THE NORTH SIDE OF THE RESIDENCE SHOWING A DITCH HAND DUG IN THE GROUND FROM THE CRAWL SPACE ACCESS TO THE BARROW DITCH. PHOTO NUMBER NINE WAS A PICTURE OF THE OVERALL HOUSE AND PHOTO NUMBER TEN WAS A PICTURE TO THE SOUTH OF THE RESIDENCE SHOWING THE PUDDLE AND HOLE DUG IN THE DRIVEWAY. I CONTACTED KAREN WILSON AT 14425 WELD COUNTY ROAD 12 AND SHE ADVISED THAT SHE SEES VERA GOING THROUGH THE MAIL ON A FAIRLY REGULAR BASIS. SHE ADVISED THAT SHE WAS UNABLE TO SEE IF VERA TOOK ANY OF THE MAIL FROM THE MAILBOX. SHE ADVISED THAT VERA PARKS PARTIALLY IN THE DRIVEWAY, PARTIALLY ON THE ROAD, GETS OUT OF THE VEHICLE AND LOOKS AROUND AS IF LOOKING FOR SOMEONE TO BE WATCHING HER. SHE THEN GOES THROUGH THE MAIL AND THEN GETS BACK IN HER TRUCK AND LEAVES. KAREN ADVISED THAT SHE HAS SEEN VERA AT THE PROPERTY WHEN VINCENT AND HIS WIFE ARE NOT THERE. SHE IS UNABLE TO ADVISE WHETHER OR NOT SHE GOES IN THE RESIDENCE, BUT HAS BEEN TOLD BY VINCENT THAT SHE HAS COME INTO THE RESIDENCE UNANNOUNCED AND UNINVITED. IT SHOULD BE NOTED THAT VINCENT TOLD ME THAT A WEEK OR SO AGO, VERA CAME INTO THE RESIDENCE AT APPROXIMATELY 11:00 AM. VINCE AND HIS WIFE HAD JUST WORKED ALL NIGHT AND SO WERE SLEEPING. VINCENT ADVISED THAT HE HEARD VERA IN THE KITCHEN CALLING OUT TO SEE IF ANYONE WAS IN THE RESIDENCE. SHE WAS TOLD TO NOT COME INTO THE RESIDENCE WITHOUT PERMISSION OR AT LEAST NOTIFICATION AND SHE ADVISED THAT SHE HAS A RIGHT TO DO SO AND HAS BEEN SEEN IN THE RESIDENCE ON NUMEROUS OCCASIONS. I CONTACTED THE HEALTH DEPARTMENT AND THERE TALKED WITH TREVOR JIRICEK WHO THEN IN TURN CONTACTED THE BUILDING INSPECTOR AND MADE AN ARRANGEMENT TO MEET WITH THE BUILDING INSPECTOR, THE SHERIFF'S OFFICE AND HEALTH DEPARTMENT AT THE ADDRESS IN QUESTION ON 051697, AT 10:00 AM. I CONTACTED THE OFFICER, BILL HOOD, WHO WOULD BE RESPONDING AND ADVISED HIM OF WHAT WAS GOING ON AND REQUESTED THAT HE COMPLETE A SUPPLEMENT AS TO WHAT THEY FIND. I REQUEST THIS CASE BE ASSIGNED BACK OUT TO BEAT THREE TO FOLLOW-UP ON THE HEALTH DEPARTMENT ISSUE AS WELL AS POSSIBLY GET WITH THE COUNTY ATTORNEY'S OFFICE TO FIND OUT ABOUT HOW WE CAN DEAL WITH VERA AND THE ONGOING TENANT PROBLEM. WHILE AT THE RESIDENCE, THE LAND OWNER, VERA GLENDENING, CAME TI TGE RESIDENCE AND WANTED TO KNOW WHAT WAS GOING ON. TROY SWAIN, ED STONER AND I ALL ATTEMPTED TO EXPLAIN TO VERA GLENDENING WHY WE WERE THERE AND WHAT WAS GOING ON, BUT ALL SHE WANTED TO DO WAS ARGUE WITH THE PEOPLE TRYING TO TALK TO HER. FINALLY, TROY STONER WAS ABLE TO WALK THROUGH THE BUILDING WITH VERA GLENDENING AND EXPLAIN TO HER THE VARIOUS CODE VIOLATIONS THAT WERE EVIDENT IN THE RESIDENCE AT THIS TIME. ALL THE TIME WHILE WE WERE TRYING TO TALK TO GLENDENING, SHE WAS MAKING COMMENTS ABOUT SHE WAS GOING TO SUE THOSE OF US INVOLVED IN BEING AT THE RESIDENCE CHECKING ON THE CODE VIOLATIONS, ETC. VARIOUS CODE VIOLATIONS OBSERVED BY SWAIN AND STONER WERE RESIDENCE NEEDED TO BE REPLUMBED, REWIRED, SEPTIC SYSTEM FIXED, GET RID OF THE GROUND WATER UNDERNEATH THE RESIDENCE, AND REPLACE THE SUBFLOORING.
