BE IT RESOLVED, that the Board of County Commissioners of Weld County,
Colorado, hereby sign Quit Claim Deed conveying to Wiggins Telephone Assocition,
a part of the Northeast Quarter Northwest Quarter of Section 3, Twp 7 N, R 58 W,
of the 6th P.M, Weld County, Colorado, described as follows: Beginning at a point
on the North side of the said NE$NW* of said Section 3, 2377 feet East of the
Northwest corner; thence, South 1° 23' West 30 feet to the true point of beginning;
South 1° 23' West 100 feet; thence, East 100 feet; North 1° 23' East 100 feet; thence,
West parallel to and 30 feet South of the North line of said Section 3, 100 feet to
the point of beginning, copy of said Quit Claim Deed hereto

Re: Wiggins Telephone Association -
New Raymer Telephone Exchange
Gentlemen:
My client, Wiggins Telephone Association, has acquired
title to a parcel of land in the NE*NW* of Section 3, Township 7
North, Range 58 West of 6th P. M., Weld County, Colorado, 100
feet square for the purpose of erecting thereon an automatic
telephone exchange serving all the people in the vicinity of
New Raymer and Buckingham. Enclosed you will find a thermofax
copy of the deed to the lands so acquired.
The Wiggins Telephone Association is a non-profit association
organized under REA. It is necessary, in order for the association
to build facilities serving the people in your county, in the
area of Briggsdale, New Raymer, Buckingham and East, that loans
be secured from the Rural Electrification Administration in
Washington, D. D.. In connection with the title, the association
acquired from Mr. Schmeeckle and from the enclosed deed, it
appears of record that Weld County is the owner of oil, gas or
other minerals under this parcel of land. The rules and regulations
of REA do not permit us to secure a loan to build this exchange
where the minerals are not owned by the association.
For your information, the county acquired title to this
parcel of land by virtue of a treasurers deed dated April 8, 1940
recorded May 16, 1940, in Book 1063 at page 200 wherein Weld
County became the owner of the following parcel of land to -wit:
Part of the NE*NW* beginning at a point 392.4 feet west of
the NE corner of the NE4NW*; thence south 328.7 feet; thence
east 392.4 feet; thence north 328.7 feet; thence west

392.4 feet to the point of beginning in Section 3,
Township 7 North, Range 58 West of the 6th P. M.
By virtue of a deed dated May 31,
1944, in Book 1135 at page 140, Harold
for Weld County to execute deeds, Weld
above premises owned by Weld County to
said deed, the county reserved all oil
1944, recorded June 6,

County conveyed the
Albert Schmeeckle wherein
, gas, and other minerals.
The parcel of land that the Wiggins Telephone Association
owns is very small as is the parcel of land that Weld County
sold to Mr. Schmeeckle and the value interest of Weld County in
the minerals to this parcel of land and especially the parcel
of land that Wiggins Telephone Association owns is comparatively
small.
I am enclosing herein a quit claim deed from the Board of
County Commissioners of Weld County to the Wiggins Telephone
Association, conveying all of the county's right title and
interest in and to all minerals under the telephone exchange
site due Wiggins Telephone Association which we would appreciate
very much your executing. I am not certain whether or not you
believe this matter is important enough that you should have
some consideration for this deed, but if you do, please advise
me of the amount of consideration.
In any event, I would appreciate your informing me, at
your earliest convenience, of what you would desire to do concerning
this matter as it is holding up the building of the telephone
service in the area as we cannot secure the loan funds until
this is taken care of. If the commissioners or County Attorney
have any further questions in regard to this matter, I would
appreciate very much, your calling me collect. Also if for any
reason, the enclosed form of deed is not satisfactory, I would
appreciate the County Attorney preparing such a deed and billing
us for his services and costs.
