RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT
#1203 FOR AN ACCESSORY STRUCTURE WITH A GROSS FLOOR AREA OF 1,800
SQUARE FEET IN THE A (AGRICULTURAL) ZONE DISTRICT, ARROWHEAD
SUBDIVISION -ALLEN RATHE
A public hearing was conducted on January 25, 1999, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated January 8, 1999, and duly published January 13,
1999, in the Fort Lupton Press, a public hearing was conducted to consider the request of Allen
Rathe for an Accessory Structure with a Gross Floor Area of 1,800 square feet in the
A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of
record. Eric Jerman, Department of Planning Services representative, presented a brief summary
of the proposal and entered the favorable recommendation of the Planning Commission into the
record as written. Mr. Jerman gave a brief description of the location of the site and stated it is not
located within a flood plain. He further stated four of the referrals responded with comments in
favor of the application, and twenty-eight of the surrounding property owners signed a petition in
favor of the project. Mr. Jerman stated the application is consistent with the Comprehensive Plan,
no farmland will be taken out of production, and the site is located within the City of Greeley's three
mile area of influence; however, it is not in its Urban Growth Boundary. He stated surrounding uses
consist of large-lot single family dwellings with accessory uses which include horses, gardens, and
accessory structures. In response to Chair Hall, Mr. Jerman stated the applicant intends to store
three personal trucks and a boat, and to construct a workshop in the garage. Sheble
McConnellogue, Health Department representative,added the Waste Handling Plan is required due
to the large amounts of oil and woodworking chemicals which will need to be disposed of.
Commissioner Hall commented that this requirement is excessive for a private structure which will
not be used for commercial activities. Responding to Commissioner Geile, Mr. Jerman stated there
are similar structures in the area; however, they were constructed prior to the Weld County
requirements. He added the requirement for a Use by Special Review Permit for accessory
structures over 1,500 square foot is under discussion and may be amended. Mr. Morrison
explained the standard was based on the standard pole barn size in the area, as well as
requirements in the Building Code. In response to Commissioner Vaad, Mr. Jerman stated the

structure has not been built, but the materials have been purchased. He further stated the
proposed building will not be taller than the house and will be located to meet the minimum
setbacks.
Allen Rathe, applicant stated the Arrowhead Covenants require accessory structures not to exceed
25-feet tall, with a 20-foot setback. No public testimony was offered concerning this matter. Chair
Hall requested Condition of Approval#2 be deleted. In response to Commissioner Kirkmeyer, Ms.
McConnellogue stated the Health Department staff requested a Waste Handling Plan based on the
number of complaints received concerning people who dump oil and other toxic chemicals into the
ground. She stated this requirement will be applied to commercial applications received after this
date.
Commissioner Kirkmeyer moved to approve the request of Allen Rathe for a Site Specific
Development Plan and Special Review Permit#1203 for an Accessory Structure with a Gross Floor
Area of 1,800 square feet in the A (Agricultural) Zone District, based on the recommendations of
the Planning staff and the Planning Commission,with the Conditions of Approval and Development
Standards as entered into the record and to delete Condition of Approval #2. The motion was
seconded by Commissioner Geile, and it carried unanimously.
This Certification was approved on the 27th day of January, 1999.
