HomeMy WebLinkAbout960909.tiff RESOLUTION RE: APPROVE CONTRACT AMENDMENT NO. 1 TO HEALTH EDUCATION STANDARDS CONTRACT BETWEEN HEALTH DEPARTMENT AND COLORADO DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with a Contract Amendment No. 1 to the Health Education Standards Contract between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Health Department, and the Colorado Department of Public Health and Environment, commencing March 1, 1996, and ending February 28, 1997, with further terms and conditions being as stated in said contract amendment, and WHEREAS, after review, the Board deems it advisable to approve said contract amendment, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Contract Amendment No. 1 to the Health Education Standards Contract between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Health Department, and the Colorado Department of Public Health and Environment be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said contract amendment. FACTUAL RECITALS Authority exists in the Law and Funds have been budgeted, appropriated, and otherwise made available and a sufficient unencumbered balance thereof remains available for payment in Fund Number 100, Appropriation Code F86, Contract Encumbrance Number ADM 960540 FAA; and Required approval, clearance and coordination have been accomplished from and appropriate agencies; and The parties entered into a contract dated October 1. 1995, with contract encumbrance number ADM 960540,contract routing number 9650540, hereinafter referred to as the"Original Contract". The Original Contract is attached hereto as Exhibit A and incorporated herein by the - reference. The Original Contract is being amended to change the start and stop dates of the Original Contract because of the delay in finding. The contractor has given written assurance that no services were performed prior to the effective date of this amendment. A copy of this written assurance is attached hereto as Exhibit B and incorporated herein by this reference. NOW THEREFORE, it is hereby agreed that: 1. Consideration for this Amendment to the Original Contract, CE Number ADM 960540, Contract Routing Number 960540, dated October 1. 1995, consists of the payments which shall be made pursuant to this Amendment and the promises and agreements herein set forth. It is expressly agreed by the parties that this Amendment is supplemental to the Original Contract CE Number ADM 960540, Contract Routing Number 960540, dated October 1, 1995, which has been incorporated as Exhibit A, and all terms, conditions, and provision thereof, unless specifically modified herein, are to apply to this Amendment as though they were expressly rewritten, incorporated, and included herein. 3. It is agreed the Original Contract is and shall be modified, altered, and changed in the following respects only: a. The parties hereby agree that the Original Contract shall commence on March 1, 1996, and shall end on February 28, 1997. b. The six and twelve month reports described in paragraph 2. of the Original Contract shall be due on November 15, 1996, and March 15, 1997, respectively. 4. The effective date of this Amendment is March 1, 1996. 5. Except for the"Special Provisions" and"General Provisions," in the event of any conflict, inconsistency, variance, or contradiction between the provisions of this Amendment or any of its attachments or exhibits, and any of the provisions of the Original Contract, the provisions of this Amendment shall in all respects supersede, govern, and control. The"Special Provisions" and "General Provisions" shall always be controlling over other provisions in the contract or amendments. The factual representations in the Special Provisions concerning the absence of bribery or corrupt influences and personal interest of State employees are presently reaffirmed. 6. FINANCIAL OBLIGATIONS OF THE STATE PAYABLE AFTER THE CURRENT FISCAL YEAR ARE CONTINGENT UPON FUNDS FOR THAT PURPOSE BEING APPROPRIATED, BUDGETED, AND OTHERWISE MADE AVAILABLE. 7. THIS AMENDMENT SHALL NOT BE DEEMED VALID UNTIL IT SHALL HAVE BEEN APPROVED BY THE CONTROLLER OF THE STATE OF COLORADO OR SUCH ASSISTANT AS HE MAY DESIGNATE. Project Funding Cycle Due to funding uncertainty, the Health Education Standards project implementation began March 11 and incurred no expenditures prior to that date. We therefore are requesting an annual funding cycle of March 1, 1996 through February 28, 1997. 2. Progress Toward Objectives 1) facilitate the completion of the agency assessment tool at local public health units. (year one) 4 Project advisory board convened March 20. 4 Assessments scheduled for Weld, El Paso and Jefferson Counties. 2) assist local public health units in the development of a strategic plan for the provision of health education services. (year one and ongoing) 3) identify and coordinate the provision of health education skills training to local public health units. (years two and three) Such training needs will be identified through the assessment tool. Decisions regarding training priorities and locations will be guided 960T19 • by the Standards Oversight committee. 4) coordinate the development of a mentorship network and support system. (years two and three) • 4 Resource rolodex work group has been identified and convened to guide data collection and development 5) coordinate activities with the CHES section of CDPHE and Colorado Action for Healthy People to assure the provision of training needs while avoiding duplication of services. 4 overlap in training need and commonality of objectives has been noted between this project and some aspects of the minimum data set project As both projects continue, WCHD will coordinate providing trainings which meet the objectives of both projects. 3. Changes Made No changes have been made to the project other than time line adjustments to allow for the funding uncertainty. No further changes are anticipated. 4. Accounting of Projected Expenditures See attached budget sheet for detailed accounting of project expenditures to date. In December 1995, the Board approved the original contract which will fund a half-time health education specialist to help local health departments perform an agency assessment of capacities to do health education functions. The contract is now being amended to change the start and stop dates because of the delay in funding. The original dates were from October 1, 1995 through September 30, 1996. The amendment provides for the contract to commence on March 1, 1996 and end on February 28, 1997. I recommend your approval of this amendment. Enclosures 960909 Hello
