Lasell, Assessor for Subject: Gargas abatement scheduled for September 30, 1998 Date: September 24, 1998 When Mr. Gargas come to us, we adjusted the value of their property downward. He indicated that at closing late in 1997 he felt he received too little credit for taxes. He was assured the amount was correct. The closer prorated the taxes paid for value as of January 1, 1996 (agricultural land). The difference between the amount prorated at closing and the bill received early in 198 was more than $1,200. Staff suggested he petition to abate taxes. We felt the situation was not right and I am recommending approval of his petition for abatement. It is also my understanding that you stopped by the Assessor's Office on May 6, 1998,to protest the Corrected Notice. l Your protest raises two points. First,you argue that you should not have to pay the entire 1997 taxes, because you purchased the property on November 3, 1997. Second, you believe 1 that the Assessor's value of$152,170 is too high,especially given that the sales price was $136,250. This letter deals only with your first point of contention. All properties in Weld County are valued for assessment on January 1"of each year. Improvements which are 80 percent or more complete on the assessment date are fully assessed. The taxes prior to our purchasing the home is clearly the responsibility of the owner at that time. I feel that we are being placed in the position of being the County's tax collector. It only seems fair that you look to the owner of the property at that time for the due taxes prior to our closing escrow. I had met and spoke with Weld County's chief appraiser,Michael Sampson, and he had indicated that he understood my position and that he felt an abatement would resolve this situation. My wife later spoke to Mr Rodriquez, and he indicated the same. The next thing, we get your 5-19-98 letter demanding that we pay the taxes. It seems that there may be some confusion within your office and we are being the victims. I have also spoken to the title company where we closed escrow and they have indicated that the prorated figures that they included in our escrow closing were figures provided by your office. I have never been one to avoid paying my taxes, but I strongly feel that I should not penalized for someone else's error nor should I be responsible for taxes which are someone else's obligation. I do hope that you can resolve this issue for us in a fair manner. We want to pay our rightfully due taxes and bring this issue to a close as soon as possible. I look forward to your response.
