This letter is to convey to you an additional Resolution from Weld County School District RE-8,
Ft. Lupton, in support of a Weld County ordinance regarding fair contributions for public school
sites between Weld County and Weld County School Districts. This RE-8 Resolution brings
the total of Weld County School Districts that have approved the Resolution to ten.
As per my letter of April 22, 1998,we are looking forward to working with your Board of
Commissioners and your staff on this issue.
We continue to look forward to a formal response from you in the near future.

RESOLUTION IN SUPPORT OF WELD COUNTY ORDINANCE
REGARDING FAIR CONTRIBUTIONS FOR PUBLIC SCHOOL SITES
BETWEEN WELD COUNTY AND WELD COUNTY SCHOOL DISTRICTS
WHEREAS, the School Districts in Northern Colorado are faced with unprecedented growth in
student enrollment arising from new residential development;
WHEREAS, increased student enrollment creates the need for additional capital construction;
WHEREAS, modern land use policy recognizes that new development should pay its own way
rather than impose additional costs on existing residents;
WHEREAS, Colorado Revised Statute section 29-1-203 authorizes local governments
including counties and municipalities to enter into intergovernmental agreements with school
districts;
WHEREAS, Colorado Revised Statute section 22-54-102(3) recognizes that School Districts
may cooperate with local governments to fund capital construction;
WHEREAS, many Colorado counties have entered into intergovernmental agreements with local
school districts regarding school site dedications, fees in lieu thereof, or a combination of the
two in order to mitigate the adverse effect of new residential development on school capacity;
WHEREAS, many Colorado School Districts have entered into similar agreements with local
municipalities;
WHEREAS, the St. Vrain Valley and Thompson School Districts have ordinances and
intergovernmental agreements in place with Boulder and Larimer Counties and several
municipalities in Boulder, Larimer and Weld counties providing for land dedication and
payments in lieu of land dedication;
WHEREAS, some School Districts in Weld County have been unable to enter into
intergovernmental agreements with local municipalities for the dedication of school sites, fees
in lieu thereof, or a combination of the two in the absence of a comparable Weld County
ordinance;
WHEREAS, Colorado Revised Statute section 30-28-133(4)(a) requires that subdivision
regulations adopted by the Board of County Commissioners must include, as a minimum,
provisions governing school site dedications, fees in lieu thereof, or a combination of the two;
THEREFORE:
Ten North Colorado School Districts located either in whole or in part within Weld County, by
and through their Superintendents and Boards of Education, request that the Board of County
Commissioners direct members of the Weld County staff to meet with representatives of the
School Districts to develop proposed language for a county ordinance for school site dedications,
fees in lieu thereof, or a combination of the two, as well as intergovernmental agreements that
may be used to mitigate the adverse effects of new residential development on the residents of
Weld County.
