RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST ROBERT MCPEEK FOR VIOLATION OF THE WELD COUNTY BUILDING CODE ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Robert McPeek, VI #9800071, is allegedly in violation of the Weld County Building Code Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 14th day of July, 1998, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Robert McPeek was not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against the individual as hereinabove named to correct said violation. PARCEL NUMBER: 1 309 22 000044 CASE SUMMARY May 4, 1998 Initial violation letter from Tom Potter, Electrical Inspector, sent to Mr. McPeek. It explained that the violation could be corrected by obtaining the final electrical, final plumbing, and final approval inspections. May 5, 1998 Telephone call between Robert McPeek and Dave Sprague, Building Official. Mr. McPeek was very upset that a violation was issued. Dave Sprague explained that our office would work with him and asked him how much longer he would need to finish the work. Mr. McPeek was unwilling to give any kind of time frame. June 25, 1998 Progress inspection. Three decks larger than the allotted 4'x 4', have been installed. (east 7'5"x 7'10", north 8'2" x 8", and west 8' x 8') no permits for decks were applied for through the Weld County Building Inspection Department. June 26, 1998 Letter from Dave Sprague sent scheduling Mr. McPeek to appear before the Board of County Commissioners Violation Hearing on July 14, 1998 at 10:00 a.m. The manufactured home is still located on the property without the required final inspections completed. Three decks have been built that require a separate permit fee and no permit has been applied for or issued, therefore this is a violation of Sections 50.5.3, 60.5.2 and 71.4.2 of the Weld County Building Code Ordinance. To bring the property into compliance final inspections would need to be completed on the manufactured home, and the additional fees for decks larger than 4' x 4' would need to be added to the permit and paid for. The Department of Planning Services recommends that the County Attorney authorize legal action against any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties. Of Planning p Services COLORADO Subject: Early Release of Building Permi,,, On July 18, 1997, I met with Robert McPeek concerning early release of his building permit fora manufactured home on his property, also known as 31 Disposal Site. Earlier this week Mr. McPeek had requested that the Board of County Commissioners grant him an early release due to the fact that he has not received concurrence from the State regarding his well. The Board of County Commissioners did sign off on this permit. Commissioner Barb Kirkmeyer, George Baxter, and Bill Webster, all three concurred that Mr. McPeek should proceed at his own riskrand should he not be able to obtain a well permit, a cistern would be his next available option. Mr. McPeek spent quite some time expressing his dissatisfaction with the process, as well as the complexities of the system in his frustration regarding land use in general. I found Mr. McPeek to be somewhat combative but very pleasurable at the same time. Mr. McPeek agreed that he would proceed at his own risk and understood the ramifications of his choice.
