RE: CONFIRMING DESIGNATION OF WELD COUNTY HEALTH DEPARTMENT AS THE
WELD COUNTY DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Weld County has had a local health department which was first organized
in 1938 and established pursuant to statute as a County Health Department, May 23, 1947, and
WHEREAS, the County Health Department was recognized in the Weld County Home
Rule Charter under the headings of Department of Health Services, Division of Public Health,
and included a function of providing "Environmental Health Services", and
WHEREAS, Section 25-1-501, C.R.S., establishing county health departments does not
proscribe the nomenclature to be applied to a county health department, and
WHEREAS, the Colorado Department of Health was renamed Colorado Department of
Public Health and the Environment in 1993, and
WHEREAS, the Board of County Commissioners intends to establish a name for the
Weld County Health Department which is consistent with State statute, the Weld County Home
Rule Charter, current nomenclature for the Colorado Department of Public Health and
Environment, and with the services being provided.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Weld County Health Department be, and hereby is, formally
designated as the Weld County Department of Public Health and Environment.
BE IT FURTHER RESOLVED by the Board that said change in designation be effective
May 1, 1999.
BE IT FURTHER RESOLVED by the Board that any duty, power, function, obligation or
authority previously delegated or assigned to or accepted by the Weld County Health
Department by Ordinance, resolution, contract or agreement shall not be deemed modified,
affected, amended or terminated by this Resolution nor shall any agreement or contract
approved by the Board of County Commissioners with respect to the Weld County Health
Department but not yet executed by the other parties to the agreement or contract be deemed
modified, affected, amended or terminated by this Resolution.

The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 19th day of April, A.D., 1999.

Brief description of the''problem/issue: The Weld County Department of Health is proposing to
confirm its name as Weld County Department of Public Health and Environment to coincide
with the relocation to the North. Warden and_ilarker have reviewed the proposed Resolution and
find the form to be satisfactory. The name change will not affect the name on the buil in . T,.h/e
name change would not be inconsistent wit e er or statute and would highlig-Iih the tuba La gut—
services now provided by the agency.
