A regular meeting of the Weld County Planning Commission was held January 6, 1998, in the County
Commissioners' Hearing Room (Room#101), Weld County Centennial Building, 915 10th Street, Greeley,
Colorado. The meeting was called to order by Chairman, Glenn Vaad, at 1:35 p.m.

The summary of the last regular meeting of the Weld County Planning Commission held on December 18,
1997,was approved as read.
CASE NUMBER: USR-1177
PLANNER: Scott L. Ballstadt
APPLICANT: Daryl Hafele
REQUEST: A Site Specific Development Plan and Special Review Permit for the Construction of an
Accessory Building with Gross Floor Area larger than 1,500 square feet (2,400 sq. ft.) In
Casagrande Estates Subdivision in the A(Agricultural) Zone District.
LEGAL DESCRIPTION: Lot 2, Block 2, Casagrande Estates Subdivision located in Section 17,T2N, R67W
of the 6th P.M., Weld County,Colorado.
LOCATION: South of Weld County Road 22; approximately 75 feet on Sierra Vista Road.
Scott Ballstadt, Department of Planning Services, presented Case USR-1177. Scott stated that there have
been changes to the Conditions of Approval of moving number 4 and 5 to the Development Standards, and
the deletion of Development Standard number 7,with subsequent renumbering to both. The request is for a
2400 sq. foot accessory building. The Department of Planning Services is recommending approval of the
application. A petition from 15 surrounding property owners was received against the application stating that
the building violated local covenants. Scott stated that the County does not enforce local covenants and that
the Homeowner's Association would be responsible for enforcement. Additionally, the Department had not
received any comments from the Homeowner's Association. Scott also explained that there is a similar
structure that is 3000 square feet going up close to the existing location in the same subdivision.
Fred Walker asked Scott to explain why Mr. Hafele has had to apply for the Special Use Permit(USR). Scott
explained that the Agricultural zone district only allows for accessory structures up to 1500 square feet in a
platted subdivision, and to obtain a building permit for a larger structure, a USR is required.
Glenn Vaad asked Scott what the building is going to be used for. Scott explained that Mr. Hafele will be
storing vehicles and doing metal and woodworking, all for personal use.

Stephan Mokray asked if this would be a violation if used commercially. Scott stated that yes it would be..
Glenn Vaad asked about the recourse through the Homeowners Association of the covenants and how the
homeowner would use those. Lee Morrison,Assistant County Attorney, explained that the covenants would
have to be enforced by the homeowners in court and that the County does not enforce covenants. Lee stated
that they would have to be compatible with the neighborhood as it has developed and how the covenants have
historically been enforced.
Glenn asked Scott about the exterior material being used on the similar building. Scott stated that it is metal
but was not familiar with the height due to it being under construction.
Daryl Hafele, applicant, explained that he plans to use the building for working on personal cars and doing
some personal woodworking and metal work. Glenn Vaad asked what the height of the building will be and
Mr. Hafele explained that is will be approximately 12 feet high and 60'x 40'.
Arlan Marrs asked Mr. Hafele about the building currently under construction and Mr. Hafele was not aware
of any building being constructed at this time. Mr.Vaad also stated that he had noticed several homeowners
in the neighborhood having some type of building and asked what the covenants stated as far as size of a
building. Mr.Hafele stated that he was not aware of building height restrictions but material restrictions such
as it being similar to what the home is constructed of. Mr.Vaad also asked Mr. Hafele if he had any other
building on site. Mr. Hafele explained that he does have a pole barn currently that he uses for storage, but it
will come down when this building is constructed.
The Chairman asked if there was anyone in the audience who wished to speak for or against this application.
No one wished to speak.
The Chairman then asked Mr.Hafele is he was in agreement with the Conditions of Approval and Development
Standards as modified. Mr. Hafele stated that he was.
Stephan Mokray moved that Case USR-1177,be forwarded to the Board of County Commissioners along with
modification to the Conditions of Approval and Development Standards with the Planning Commissions
recommendation of approval. Bruce Fitzgerald seconded the motion.
The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Glenn
Vaad,yes;Man Marrs,yes; Christie Nicklas,yes; Stephan Mokray,yes; Bruce Fitzgerald,yes;Jack Epple,
yes; Fred Walker,yes. Motion carried unanimously.
Glenn Vaad made a comment that the concerns in the letter that was received from the property owners had
been addressed by the Board.

APPLICANT: Glen S. Douthit, c/o Tuttle-Applegate, Inc.
REQUEST: Request for an amendment to the Mixed Use Development (MUD) Ordinance 191-B -
Map 2.1,Structural Land Use Map,and an amendment to the Comprehensive Plan (CP) 147-
N, Structural Land Use Map
LEGAL DESCRIPTION: The NE4 of Section 26, T3N, R68W of the 6th P.M., Weld County, Colorado.
LOCATION: South of and adjacent to State Highway 66;west of and adjacent to Weld County Road 11.

Shani Eastin, Department of Planning Services,gave an overview of the request for a 310-acre addition into
the Comprehensive Plan (Ordinance 147) Structural Land Use Map 2.1 and the Mixed Use Development
Ordinance(Ordinance 191) Structural Land Use Map 2.1. Shani explained that at the time of the Mixed Use
Development Plan update, public sewer was not available to service the subject property, thus it was not
included. Public sewer can currently be made available to the subject site by St.Vrain Sanitation District. The
subject property is within a 1/4 mile of the interchange of I-25 and State Highway 66. The Department of
Planning Services is recommending approval for the application.
Glenn Vaad asked Shani about the cross hatch area and the Town/City annexation that has occurred in the
I-25 area. Shani explained that the annexation has occurred along the I-25 area, and that the cross hatch
reflects the Town of Mead boundaries. Mr. Vaad then asked if there was an agreement with the St. Vrain
Valley School District, if development occurs. Shani explained that the proposal was not for development at
this time,but a request for the additional acreage into the MUD Area, and that when development does occur,
a Planned Unit Development would have to be applied for, and this is where the standards from local referral
agencies would be adhered to. Mr.Vaad asked about the access from the Highway by way of the County
Road. Shani explained that the applicant may have to upgrade and pave Weld County Road 11 through the
facility for traffic to enter onto.Access onto the State Highway,the applicant would need to meet with the State
Highway Department and discuss that. Mr.Vaad also asked about Weld County Road 9.5 and matching an
access point on the north side of Highway 66. Don Carroll, Weld County Public Works, explained that they are
working with the developer on the property adjacent to Sekich Business Park and Radamacher Business Park,
both on Weld County Road 32 and I-25 Frontage Road, and in this development they are doing some
improving and widening of Weld County Road 9.5 working back toward Highway 66. Don explained that he
did state in his referral trying to match up Weld County Road 9.5 and the property to the south matching the
intersections.
Jack Epple asked Shani about the Town of Mead and if they have annexed portions of this property into the
town limits.Shani explained that there have been discussions with the Town of Mead and if any portion of the
property is annexed in the future,the MUD area would not be effected. Shani further stated that if annexation
occurred that the County would encourage the Town to include urban infrastructure and development
standards.
Gary Tuttle,representative of the applicant, explained the request for the extension of a sewer line. Mr. Tuttle
. stated that there was participation of the land owners, and this request would include the applicant, Mr.
Douthit's property. Mr.Tuttle addressed the transportation issue and stated that they would not have a problem
donating property for route 66 and that they would contact the Department of Transportation for access onto
the State Highway. In regard to the school district, Mr.Tuttle explained that they were willing to enter into an
agreement with the School District and the possibility of building a 10 to 15 acre school in the future if needed.
In regards to the ditch,they are willing to include the extension and consider it a limited site factor and consider
it to be open space.
Arlan Marrs asked about the potential of the property being annexed by the Town of Mead. Mr. Tuttle
explained that at the present time it is hard to evaluate the benefit of being annexed, since they do not know
when something is going to happen on the ground. Mr. Tuttle explained that they are not in the Mead
Sanitation District,but the St.Vrain Sanitation District and at this time, and if in the future an Intergovernmental
Agreement was in place,they would not object to being annexed.
Stephan Mokray asked about the extension of the ditch into the residential area and his concerns of safety.
Mr.Tuttle explained that the Planning Staff has suggested the irrigation ditch be called a limited site factor with
the idea of it being used or incorporated as open space.

Lee Lawson,Manager of St.Vrain Sanitation District, explained to the Board the service area, which extends
'/ mile north of the property in question, and that the Sekich Business Park is not a part of the service area.
Glenn.Vaad asked if the service area and the District were one in the same. Mr. Lawson stated that it was not.
Mr.Lawson also explained that they do not force inclusion, but when people are ready for service,they could
petition for inclusion. Mr. Lawson explained the petition for inclusion process.
Glenn Vaad asked Mr. Lawson about the capacity to expand the district. Mr. Lawson explained that they do
have the capacity to expand and is currently about 1/3 existing capacity at'A million gallons per day,which
equates to approximately 1-1/2 million gallons of water to a 15,000 population. (100 gallons per day per
person).
The Chairman asked if there was anyone in the audience who wished to speak for or against this application.
No one wished to speak.
The Chairman asked Mr.Tuttle if he was in agreement with the adjustment of the Structural Land Map including
the limited site factors along the natural drainage way. Mr.Tuttle stated that they were.
Christie Nicklas moved that Ordinance 191-B , be forwarded to the Board of County Commissioners with the
Planning Commissions recommendation of approval along with the changes to the Structural Land Use Map.
Stephan Mokray seconded the motion.
The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Glenn
