Colorado Department of Public Health and Environment Air Pollution Control Division JUL 2 1999 HMWMD-SWIM-B2 4300 Cherry Creek Drive South RECEIVED Denver, CO 80246-1530 SUBJECT: NORTH WELD SANITARY LANDFILL TITLE V OPERATING PERMIT APPLICATION _ USR #895 Dear Ms. Kendall: The North Weld Sanitary Landfill (NWSL) submitted a Title V application to the Colorado Department of Public Health and Environment (CDPHE) on March 12, 1997 as required under the New Source Performance Standard (NSPS) for Municipal Solid Waste Landfills set forth in 40 CFR 60 Subpart WWW. During 1998, the Environmental Protection Agency (EPA) published amendments to Subpart WWW which redefined the applicability of the NWSL from a "new source" regulated under Subpart WWW to an "existing source" subject to the Emission Guidelines Program, Subpart Cc. Accordingly, on November 9, 1998 NWSL submitted a letter to CDPHE stating that due to the definition change in NSPS WWW, the NWSL was no longer considered a new source and not subject to Subpart WWW but rather to the emission guideline (NSPS Cc). Because of this NWSL requested the application for Title V be withdrawn and stated that a new application would be submitted as necessary in accordance with the emission guideline program. However, pursuant to your letters of April 13 and April 21, 1999 and our recent telephone conversation, NWSL requests that the Title V Operating Permit Application submitted on March 12, 1997 be reinstated and that the review of the Division's draft permit prepared from the Application resume. The NWSL has received its Administrative Completeness Determination from CDPHE for this application. Since NWSL is requesting CDPHE to resume its review of the application, NWSL reviewed the Title V Operating Permit application for appropriate changes or updates. The permit application was submitted on March 12, 1997, and since that time the CDPHE has issued final approval for the Construction Permit No. 90WE107 on March 17, 1999. This plan was revised pursuant to Development Standard #8 of the Weld County Certificate of Designation. This Development Standard requires the plan to be reviewed at least once every two years. The NWSL plan was previously reviewed, updated and submitted to the Colorado Department of Public Health and Environment (CDPHE) and Weld County Department of Public Health and Environment (WCDPHE) on November 25, 1997. The NWSL Groundwater Monitoring Plan was reviewed and modified by NWSL and includes general plan updates/revisions since the previous plan submittal. These plan revisions are described below: • Updated Revision Summary. • Updated information included on List of Appendices (Changed Appendix 8 reference to Quanterra Laboratory Quality Assurance Management Plan) • Revised Section 1.4 (Page 2) and changed reference to Well Location Map from Appendix 3 to Appendix 1. 991301 � c:\data.1.6 rnwsl\upgrwpin usa ?c155 I File: 4.1.6 -7L Letter Roger Doak and Trevor Jiricek May 4, 1999 Page 2 • The contractor providing analytical services to NWSL has changed from Waste Management Technology Center (WMTC) to Quanterra Incorporated. Accordingly references to WMTC have been changed to Quanterra throughout the plan. • Revised Section 9.0 (Page 26) and added Quanterra Quality Assurance Management Plan to the reference list. • Updated information included in Appendix 4 (Directory). • Changed the title page of Appendix 8 from WMTC Laboratory Quality Assurance Program Plan to Quanterra Incorporated Quality Assurance Management Plan. Accordingly, the WMTC Quality Assurance Plan was replaced with the Quanterra Quality Assurance Management Plan. Please replace the existing information with the enclosed text and corresponding pages, which have been revised as described above.
