Subject: Tripointe First Annexation
Dear Commissioners:
Enclosed, please find information pertaining to a petition for annexation which is located
north of US Highway 34 Business Route, and 1/2 mile east of State Highway 257. This
12.01 acre annexation will be considered by the City of Greeley Planning Commission
on January 26, 1999, and the City Council on February 16, 1999, where the ordinance
will be introduced and the public hearing will be on March 2, 1999. The applicants have
indicated this site is a portion of the property being considered by State Farm for their
proposed relocation.

INTENDED USE AND DEVELOPMENT OF TERRITORY PROPOSED FOR
ANNEXATION
The property has direct access to U.S. Highway 34 Business Route. It currently has a
dwelling on it which is not in use. The intent of this proposed annexation is to include it
in the larger Tri_Pointe Development which borders to the east and south. The proposed
zoning is P.U.D. Industrial-Office. The size of the commercial or industrial facilities is
not known at this time. As a commercial development, no new dwellings will be
constructed and no new school students are to be added.

10. Except as otherwise provided, no part of the territory sought to be annexed is more
than three miles from a point on die municipal boundary, as such was established
more than one year before this annexation will become effective.
11. As an condition of annexation, land owner(s) consent(s) to inclusion into
the NoiColorado Water Conservancy District and the municipal subdistrict
pursuant to Section 3745-136 (3.6) C.R.S. Land owner(s) acknowledge(s) that,
upon inclusion into the district and subdistrict, land owner's(s') property will be
subject to the same mill levies and special assessments as are levied or will be
levied on other similarly situated property in the district and subdistrict at the time
of inclusion of land owner's(s') lands. Land owner(s) agree(s) to waive any right
to an election which may exist to require an election pursuant to Article X, Section
20, of the Colorado Constitution before the district and subdistrict can impose such
mill levies and special assessments as it has the authority to impose. Land owner(s)

INTENDED/PROPOSED USES Mr. Harrison has stated the intention of
developing the site as a portion of the area
required to attract a major employer.
COMPREHENSIVE PLAN The site lies within the boundaries of the Long-
Range Expected Growth Area, and outside the
Mid-Range Expected Service Area and the
Municipal Services Suitability Area.
Generally speaking, the proposed land use is
compatible with existing surrounding land uses
both within City limits and in unincorporated
Weld County, and compatible with the existing
conceptual PUD plan to the east and south.
Access to the site is currently possible from one
access points onto US Highway 34 Business.
As part of any proposed development of the
site, the applicants will need to comply with
State and City requirements regarding access
along a Business Route. Access to serve this
individual parcel would not likely be granted,
but two access points to serve the larger 600
acre PUD have been identified as appropriate.

ANALYSIS The site consists of 12.01 acres, and is located
north of US Highway 34 Business, and 1/2 mile
east of State Highway 257, north and west of
existing City limits.
The site is fully within the City's Long-Range
Expected Growth Area and outside the Mid-
Range Expected Service Area and the City's
Municipal Services Suitability Area.
Within City limits immediately to the east and
south of this site is an undeveloped parcel which
is zoned PUD (Planned Unit Development) with
a conceptual PUD for light industrial/office
uses. To the north and west is US 34 Business,
while a CDOT Work yard exists to the north.
The land use envisioned by the applicant for this
site is to include this site as a portion of the
proposed State Farm development, which
appears to be consistent with City of Greeley
Comprehensive Plan policies, as was
conceptually approved late last year.
The annexation of this site into the city would
be consistent with a contiguous Ci1:y boundary
and Comprehensive Plan policies. There is
clear evidence that this site shares a common
interest with the City's future. The
requirements of State statutes and City of
Greeley guidelines for annexation appear to
have been met by this requested annexation.
