RE: APPROVAL OF RECORDED EXEMPTION #1770 - BOATRIGHT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1770, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1770 was submitted by William
Boatright, 33015 Weld County Road 10, Keenesburg, CO 80643, for property which is located in
part of the SW% of Section 10, Township 1 North, Range 63 West of the 6th P.M., Weld County,
Colorado, being more particularly described in the plat which shall be provided by the applicant and
known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to be approximately
145.4 acres and 8.6 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1770 submitted by
William Boatright be, and hereby is, approved conditional upon the following:
1. In accordance with the Weld County Department of Public Works, no additional
accesses shall be allowed.
2. A Weld County septic permit is required for any proposed home. The septic system
shall be installed according to the Weld County Individual Sewage Disposal System
(ISDS) regulations.
3. An ISDS evaluation by the Weld County Health Department on all existing septic
systems will be necessary prior to issuing the required septic permits on the existing
systems.
3. Any ISDS shall be located at least 100 feet from any well.

4. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 23rd day of August, A.D., 1995.

Subject: RE -1770, located in part of the SW4, Section 10, TIN, R63W of the 6th P.M., Weld County,
Colorado.
Dear Commissioners:
This request for a recorded exemption is submitted by William Boatright. The parcel of land under
consideration is described as Lot B of AmRE-1032, being part of the SW4, Section 10, TIN, R63W of the
6th P.M., Weld County, Colorado. The property does not lie within the urban growth boundary of any
surrounding municipality. A residence exists on proposed Lot A, but no existing residences on proposed Lot
B. Proposed Lot B is in agricultural production, consistent with the majority of the surrounding properties.
A septic system provides Lot A with sewage disposal. There are currently two accesses on Lot A, and one
access to Lot B. The Weld County Department of Public Works is asking that there only be one access per
legal parcel, no additional accesses shall be granted. Water is provided by a domestic well on Lot A, and a
domestic well may be applied for on the larger Lot B as well.
The previous Recorded Exemption on this parcel, RE -1032, approved by staff on July 14, 1987, divided a
160 acre parcel into 157.43 acres and 2.44 +/- acres. The purpose of the original request was to separate the
existing improvements off of the larger parcel to provide the parents and their son the ability to live in a rural
setting and operate a farming enterprise. The applicants are now requesting to further divide the property
into an amended Lot A of 5.4 +/- acres, a new Lot A of 8.6 +/- acres, and a new Lot B of 145.4 +/- acres.
According to the applicant, Lot A will be for the son's residence, adjacent to the amended Lot A of RE -1032.
Lot B will remain in agricultural production. The application states the purpose of the proposed division is
"to modify the boundaries of the existing parcel, secure legal parcels for farm family members and allow the
ability to sell off the balance of the land, which is consistent with the Comprehensive Plan...the purpose of
the division of land is to accommodate retirement, provide legal rural residential parcels for family members,
allow for the sale of excess land, and preserve as much prime agricultural ground as possible..."

-Even though this application is consistent with the Weld County Comprehensive Plan, staff has concerns that
an additional buildable site will be created should this Recorded Exemption be approved. The Department
of Planning Services requests that the Board of County Commissioners consider this application and
determine if Sections 11.5.1 through 11.5.7 of the Weld County Subdivision Ordinance have been met.

STAFF RECOMMENDATION: Staff recommends approval of this request but has concerns
about the addition of another buildable site to this area.

is granted.

RE: Boatwright Application for Recorded Exemption & Amended Recorded Exemption
Dear Commissioners,
The above captioned application resulted in a referral from the Colorado Division of
Water Resources regarding the location of existing domestic wells. When preparing
the application for Mr. Boatwright, I submitted copies of well registration papers for 2
olifferent comestic wells that appeared to be the currently existing wells. After receipt of
the referral letter and further research with the Records Section at the Colorado
Division of Water Resources, it appears that the 2 records we had were actually
original and replacement permits for the same well, located on existing Lot "A" and
completed in 1988 under permit No. 153209. The other existing well, located on
proposed new Lot "A" was an older record for a well drilled in 1959 under permit No.
4248 for which we did not have a copy. Both wells are in fact located on their
respective lots, both are currently in compliant use, and both are properly registered.
The attached sketch shows the locations for your review. I have indicated to the
personnel in the Records Section at the Colorado Division of Water Resources that I
would assist the Boatwrights in updating the records to properly reflect the existing
wells. This should answer any concerns in this regard for both the Board of County
Commissioners and the Division of Water Resources. Please contact me if you have

Dear Planner Goranson:
We have reviewed the above referenced proposal to split a 8.6 acre lot from a 145.5 acre
parcel. The proposed water supply is to be from on lot wells. The 8.6 acre lot appears to be sewed
by an existing well. It is not clear which well will serve this lot. We would object to approval until
the applicant identifies the well that will serve the 8.6 acre lot and indicates the current location
of each well on the sketch plan that was submitted.
A permit for a domestic type well permit will be available for the larger lot the same as for
any parcel of 35 acres or more.

RECORDED EXEMPTION QUESTIONNAIRE
Explain the reason for the proposed recorded -exemption and how each proposed lot will
be used.
The owners of the property acquired the original 160 +/- parcel in the -mid 1980's. They
wished -to provide for residences -for the parents and son in a rural setting and operate a
fanning enterprise. To that end,a prior -Recorded Exemption was completed in 187
(RE --1932) to create a 2 +/- acre pareelforplacement of the parent's home. At this time, it
is the desire oftheapplicants to mudify-the existing Lot "A" andcreate aseparate new Lot
"A" for the son's home. The -parents are retired -and wish to sell off the farmland, yet
retain rural homes for the family. The end result will be 2 separate rural residential parcels
adjacent to one another in a cluster type configuration, and -a legal, separate farm parcel.
This application is being submitted concurrently with an application to amend the existing
Lot "A" as shown on the plat. Records will show a previous Mobile Home Zoning Permit
for medical hardshippurposes that was properly utilized and consequently abandoned.
The -mobile home has been removed from the property in accordance with appropriate
regulations. The proposed use of the larger -Lot "B" will be farming and agricultural
production, as it is good quality irrigated farm land. The proposed use of the smaller Lot
"A" will-beas a rural residence for the aforementioned family members (son 8t family). A
barn, corrals, machine shed, and other support buildings are also on the smaller parcel.
2. Describe the location, size, and present use of the area where eachproposed new lot will
be created.
The parcel is located -at the southwest corner of the intersection of Weld County Road 67
and Weld County Road ID, 1 -mile southwest oftheTown of Prospect Valley in the
southeast part of Weld County. Weld County Road 10 is the south boundary of the
property and Weld County Road 67 is the west boundary. Access to all parcels exists off
WCR 10; no change in access is proposed. The property consists ofa total of 159.4 -acres
of contiguous land, including the existing amended Lot "A". The smaller parcel (proposed
new Lot "A") will consist of 8.6 +/- acres. Exact acreages will be determined by survey
upon approval of this application.
The larger parcel is productive farmland, irrigated by one large irrigation well together
with waters derived from inclusion of the property in the Henrylyn Irrigation District.
This parcel would be considered prime agricultural land. There exists a year-to-year crop
share lease with a neighbor as the farm tenant. This proposal creates a split which
preserves the prime agricultural lands and existing improvements, resulting in no effective
loss of prime agricultural lands. The 2 proposed smaller parcels have existing dwellings,
support buildings, wells, andseptics. No new wells, septics, or accesses are proposed.
The domestic water supply for the smaller parcel (proposed new Lot "A") is provided by
an existing domestic well. Theexisting amended Lot "A" also has its own deep domestic
well and permitted septic system. The largerparcel has the availability to obtain a
domestic well if needed in the future. The parcel size is adequate to obtain a_lomestic
well permit without restrictions at this time. There is a separate, existing septic system

serving each of the existing dwellings on the smaller parcels. There is adequate acreage of
a suitable nature to obtain a septicsystem permit on the larger parcel should a future
owner need to do so.
3. Explain how the proposal is consistent with the Weld County Comprehensive Plan and
any adopted municipal plan, if applicable.
This parcel hasbeenrlivided by a previous recorded exemption (RE -1032), created in
1987, well past the -5 year limitation on additional recorded exemptions as set±orth in the
Comprehensive Plan. This proposed division creates a separate parcel for an existing rural
homesite and the larger parcel remains as productive, irrigated agricultural land. The
purpose is to secure legal parcels for farm family members and allow the ability to sell off
the balance of the land, which is consistent with the Comprehensive Plan. Both parcels
will retain their "A" agricultural zoning. -The parcels are not located within3 miles of an
incorporated town.
4. Explain how the uses permitted will be compatible with existing uses surrounding the
proposed recorded exemption.
The uses of the nearby and surrounding properties include productive irrigated farmland
and individual rural homesites. This division will be compatible with the existing uses and
should pose no discernible effect on the surrounding properties. No new dwellings are
proposed. This application utilizes existing housing stock, wells, and septics. To our
knowledge, -the property is not located in a flood plain, geologic hazard area, or overlay
district.
5. Explain how the proposal is consistent with the intent of the zoning district within which
it is located.
The -zoning of both proposed parcels is "A" Agricultural and will remain so after the
proposed division. The proposed uses of rural homesitc and productive farmland are
allowed under the provisions of this zoning classification. A -previously approved Mobile
Home Zoning Permit for medical hardship purposes has been properly abandoned and is
no longerin existence.
6. Explain how the proposal is consistent with efficient and orderly development.
The smaller parcel has an existing set of improvements which have been on the site in
excess of 30 years, together with a separate dwelling built in 1987 on the existing
amended Lot "A". The existing dwellings and support buildings are clustered in a corner
of the larger parcel, reducing the effect of "leapfrog" or scattered housing locations. If a
future owner should decide to build a singlefamily dwelling on the larger parcel, it should
pose little effect on the area and surrounding parcels due to the size and location of the
parcel.

7. Explain how adequate provision for protection _of the health, safety, and welfare of the
inhabitants of the neighborhood and the County will be accomplished.
Each proposed parcel has either an existing septic system and domestic well, or the ability
to obtain same. With the location and limited density due to the creation of a single
additional lot and no additional proposed dwellings, there should be minimal to no effect
with regard to sheriff and/or police protection, fire protection, road maintenance, or
increased traffic. The site is located in the Southeast Weld FireProtection District and is
served by the Prospect Valley Volunteer Fire Department, located 1 1/2 miles away.
Since the purpose of the division is to accommodate retirement, provide legal rural
residential parcels for family members, allow for the sale of excess land, and preserve as
much prime agricultural land as possible, and since all criteria for division by Recorded
Exemption appear to be in order, we ask that this request be granted.
