RESOLUTION
RE: APPROVE VACATION OF SPECIAL USE PERMIT #387 - SIMPSON FARMS
COMPANY, % GARY SIMPSON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated June 13, 1979, the Board did approve Special Use
Permit#387 for a hog operation for Simpson Farms Company, % Gary Simpson on the
following described real estate, to-wit:
E ''A NW 1/4 of Section 26, Township 8 North,
Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from Simpson Farms Company, % Gary
Simpson, to vacate said Special Use Permit #387, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Special Use Permit #387 be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 8th day of February, A.D., 1999.

SUBJECT: Vacation of SUP-387 TO THE T.,'
The Department of Planning Services has received the attached letter dated December 10, 1998
from Gary Simpson, President of Simpson Farm Company. Mr. Simpson is requesting that SUP-
387 be vacated since hogs are no longer raised on the property.
Background information:
Legal Description: E2 NW4 of Section 26, T8N, R65W of the 6th P.M., Weld County, CO.
Location: South of and adjacent to Weld County Road 90 and 1/4 mile east of Weld
County Road 45 - 6 miles east of Pierce
SUP-387: SUP-387 was approved by the BOCC on June 13, 1979, for a hog
operation for 4,480 head of hogs.
A "Memorandum of Understanding" was approved on October 9, 1991 to
allow Mr. Simpson to keep, raise, and board alligators at the site until
December 31, 1992 to determine the feasibility of growing alligators in
Colorado.
Mr. Simpson recently applied for a Subdivision Exemption for financing purposes. Because the
Special Use Permit is no longer active, the Department of Planning Services required the
vacation of SUP-387 as a condition of approval. This request for vacation of SUP-387 is to
satisfy the Department of Planning Services' condition.

RE Subdivision Exemption
N W 1/4 of 26-8-65
Simpson Farms Co. would like to establish a boundry along Owl Creek to divide
approximatly 20 acres from the rest of the 80 acre property for financing. The 20
acre plot shown as 'A' on the map has a Use by Special Review Permit for Hogs.
Plot 'A' has hog buildings and pens on it and banks are not able to provide real
estate financing for such property. In order to get financing for the rest of the
property Plot 'B' which has another set of inprovments including my home, it is
necessary to establish such a boundry.
Simpson Farms Co. would like to vacate the Use by Special Review Permit for
Hogs as there will no longer be a need to raise hogs on this land. The current plan
is to tear down the hog unit.
