AGREEMENT TO PARTICIPATE -
IN ''Jai, COST OF HIGHWAY IMPROVEMENT
THIS AGREEMENT, entered into this 5th day of November, 1958, by and between
the DEPARTMENT OF HIGHWAYS of the STATE OF COLORADO, hereinafter called the
"Department", andithe COUNTY OF WELD, hereinafter called the "County",
WITNESSEPH that
WHEREAS, the Department has included in the Budget for 1958-1959, dated
May 12, 1958, a Federal Aid Secondary Project, designated as S 0034(6) to
consist of improvements on State Highway No..392, Windsor-West, for which the
sum of $300,000.00 has been allocated, and
WHEREAS, thelCounty desires to participate in the right-of-way acquisition
costs only of this project to the extent of $3,000.00.
NOW, THEREFORE, in consideration of the premises and the mutual covenants
and agreements herein contained, and the faithful performance thereof, the
parties hereto promise and agree as follows:
1. The Department Agrees:
(a) To prepare the plans, specifications, and estimates for the work;
to advertise for bids; to award the contract; to prepare the monthly and final
estimates; to paylthe contractor according thereto; and to arrange for the force
account work by railroad, utility and irrigation companies.
(b) To secure at the cost of the project all right-of-way required for
the project, as indicated by right=of way lines shown on project construction
plans.
(c) To bill the County for Three Thousand Dollars ($3,000.00) after
the said right-of-way has been obtained.
2. Tip.; COUNTY AGREES:
(a) To pay to the Department Three Thousand Dollars ($3,000.00)
immediately upon receipt of the billing as stated above.
3. The Parties Agree that the Department may postpone, suspend, delete
and/or extend any pr all portions of this project as the Department may from
time to time determine to be necessary but nothing herein shell obligate the
County to expend moneys beyond the amount herein otherwise specified.
4. This Agreement shall not be deemed valid until it shell have been
approved by the Controller of the State of Colorado, or by such assistant as

5. This Agreement shall be binding upon and inure to.the benefit of the
successors and assigns of the parties hereto, respectively.

6. This Agreement is executed under authority of Section 6, Article 2,
Chapter 120, C.R.S., 1953, and with reference to the signatories on behalf
of the County by virtue of a resolution passed at a meeting of the Board of
County Commissioners held on November 5 r 1958, a certified
copy of which is attached hereto.
IN WITNESS WHEREOF, the parties hereto have caused the foregoing
Agreement to be executed the day and date first above written.

This is to certify that at a regular meeting _
of the Board of County Commissioners of Weld County held on
November 5, , 1958, the following resolution
was adopted:
"Resolved that this Board hereby approves a certain Agreement
with the Colorado Department of Highways, dated November 5, 1958,
whereby the County obligates itself to participate in the cost of
Federal Aid Secondary Project S 0034(6), to consist of improvements
on State Highway No. 392, Windsor-West, as per the terms of said
Agreement,, and authorizes the execution of said Agreement on behalf
of Weld County by signature of the Chairman of the Board."
