Approved with Conditions The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of the County. 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. Prior to recording the plat, the applicant shall: A. The applicant shall submit to the Weld County Health Department a designated area on both Lots A and B for a replacement septic system. After approval by the Health Department, the replacement septic areas shall be clearly delineated on the plat. • B. The following note shall be placed on the plat: All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. C. All access shall be clearly shown on the plat. D. Prior to recording the plat, the applicant shall submit evidence to the Department of Planning Services that the septic systems on both proposed lots meet all requirements of the Weld County Health Department. The Environmental Protection Services Division of the Weld County Health Department was unable to locate a septic permit for the septic systems located on both proposed lots. Any existing septic system(s) which is not currently permitted through the Weld County will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit(s). In the event the system(s) is found to be inadequate, the system(s) must be broughtinto compliance with current I.S.D.S. regulations. E. Prior to recording the plat, the applicant shall submit for review and approval by the Department of Planning Services a Geologic Hazard Development Permit. F. The following note shall be placed on the plat: The existing home on Lot B located immediately to the west of LotA shall be removed within 30 days of the certificate of occupancy for the new residence to be constructed on Lot A. The applicant shall notify the Department of Planning Serivices at the time a residential building permit is applied for on Lot A. 3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. Rieder Family Trust The Environmental Protection Services Division of the Weld County Health Department has reviewed RE -1924 and SE -604 submitted by the Laurence H. Rieder Family Trust. The Division recommends that the following conditions be a part of any approval: 1) The E.P.S. Division was unable to locate septic permits for the septic systems serving any of the four (4) homes located on the larger parcel of this application. Any existing septic system(s) which is not currently permitted through the Weld County Health Department will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit(s). In the event the system(s) is found to be inadequate, the system(s) must be brought into compliance with current I.S.D.S. regulations. In addition, the Division is concerned about the lot sizes proposed for both of the new lots created by the Recorded Exemption and Subdivision Exemption. Each lot size is only one (I) acre. The Soil Conservation Service, Soil Survey of Weld County indicates that the primary soil type in this area is the Ulm clay loam. This type of soil typically limits options for septic system construction and disposal of sewage effluent due to limited seepage. In addition, a review of existing septic systems in this area indicate that a significant percentage of the systems have been designed by a Professional Engineer due to poor soil conditions. Often in these type of soil conditions engineers design a system which relies on evaporation and transpiration of effluent (although some other options exist). These systems are very large systems, typically around 9,000 square feet or larger depending on the number of bedrooms in the home, etc. These type of systems cannot be driven on, landscaped over, etc. Therefore, the Division recommends that either that the applicant increase the lot size for each parcel to allow for the placement of these systems and adequate area for a replacement system, if necessary, or demonstrate that the proposed lot size (1 acre) is large enough for the same.
