RE: INTENT HEARING TO CONSIDER CREATING LOCAL IMPROVEMENT
DISTRICT #1995-1 - ROTH SUBDIVISION
A public hearing was conducted on April 24, 1996, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that a public hearing was conducted to consider the creation of a local improvement
district within Roth Subdivision. Lee Morrison, Assistant County Attorney, made this a matter of
record and noted informal notice was mailed to all property owners and publication will follow if the
Board declares the intent to create said district. He also stated, in accordance with Amendment
One, this issue was on the ballot for the election in November 1995, and the majority voted to
create said district. Drew Scheltinga, Engineer for the Public Works Department, stated 36 of the
50 lots, or 72 percent, petitioned in favor of the district, and he noted Lots 3 through 7 and Lots 48
and 49 are not included in the district and should not be assessed. Using overhead displays
marked as Exhibit H, Mr. Scheltinga presented a summary of the proposal indicating the streets
will be improved with 2 inches of asphalt pavement, 24-foot wide; 4 inches of aggregate base
course; and 4-foot wide aggregate shoulders. He stated the total cost estimate is $138,000.00,
with assessments of $2,760.00 per lot. Mr. Scheltinga also reviewed the table of estimated
payments over ten years, at 6.25-percent interest, and noted two letters of support, Exhibits E and
G, and two letters not supporting the district, Exhibits D and F, have been received. He clarified
one of the letters not supporting the district, Exhibit D, was from the owners of Lot 8 which
accesses onto Weld County Road 76 and does not access Gaylin Avenue; however, the lot is
adjacent to the improvements. Mr. Scheltinga requested the Board authorize staff to proceed with
the bid process. Responding to questions from the Board, Mr. Morrison stated the result of the
election was 40 votes in favor of the district and 20 votes opposed. No public testimony was
offered concerning this matter. Mr. Morrison clarified the Board's motion should state its intent to
create the district, direct staff to prepare construction plans and cost estimates, authorize the
bidding process simultaneously, and set the creation hearing for June 5, 1996, at 10:00 a.m., as
set forth in the draft resolution. Commissioner Harbert so moved, and Commissioner Baxter
seconded the motion, which carried unanimously.
