HomeMy WebLinkAbout991529.tiff RESOLUTION RE: GRANT MOBILE HOME PERMIT, ZPMH #2147 - MATTHEW MICHELS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 21st day of June, 1999, considered the request of Matthew Michels, 1117 City Park Avenue, #J5, Fort Collins, Colorado 80521, for a mobile home to be used as a principal dwelling, and WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a parcel of land being more particularly described as follows: Lot B of Recorded Exemption #2410; being located in the S'/ S''/z of the S'/2 of Section 7, Township 9 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard all of the testimony, finds that said request should be granted subject to the following conditions: 1. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home on the property. 2. Prior to the occupancy of the mobile home, the mobile home shall be connected to an approved septic system and a legal water supply. 3. The mobile home shall not be occupied until such time that the applicant has complied with Conditions #1 and #2 stated above. 4. The mobile home shall meet the minimum setback and offset requirements for the A (Agricultural) Zone District. 5. The applicant shall utilize the existing access. No additional accesses will be granted. 6. The access shall be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. 7. The applicant will provide evidence of adequate access to the parcels along the section line. This may include an easement dedication, or a deed showing that a right-of-way exists. 8. Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Ordinance#169-A. 10. The applicant shall maintain compliance with Section 43.2.6 of the Zoning Ordinance at all times. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Matthew Michels for permission to place a mobile home to be used as a principal dwelling on the above described parcel of land, which was found to be in compliance with Section 43 of the Weld County Zoning Ordinance, be, and hereby is, granted subject to the hereinabove listed conditions. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 21st day of June, A.D., 1999. It is the opinion of the Department of Planning Services'staff that the applicant has shown compliance with Section 43.2.6 of the Weld County Zoning Ordinance, as follows: a. Section 43.2.6.1.1-The proposed mobile home is compatible with the surrounding area, is in harmony with the character of the neighborhood and its effects upon the immediate area. b. I have scheduled a meeting before the Board of County Commissioners for June 21, 1999, at 9:00 a.m. This hearing will take place in Room 101, Commissioners Hearing Room, Weld County Centennial Center, 915 10th Street, Greeley, Colorado. The Board of County Commissioners will then consider your application and make a final decision on the zoning permit for the mobile home. It is recommended that you and/or a representative be in attendance to answer any questions the Commissioners may have. A representative from the Department of Planning Services will be out to the property a minimum of ten days prior to the hearing to post a sign adjacent to and visible from a publicly maintained road right-of-way which identifies the hearing time, date, and location. In the event the property is not adjacent to a publicly maintained road right-of-way, one sign will be posted in the most prominent place on the property and a second sign posted at the point at which the driveway (access drive) intersects a publicly maintained road right-of-way. The Department of Planning Services' staff will make a recommendation concerning this application to the Board of County Commissioners. This recommendation will be available twenty-four(24) hours before the scheduled hearing. It is the responsibility of the applicant to call the Department of Planning Services' office before the hearing to make arrangements to obtain the recommendation. This road is non-county maintained. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required setback is measured from the future right-of-way line. REQUIREMENTS: The access shall be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. The applicant shall indicate, on the plat, type of right-of-way or easement, dedicated, private, or a deed to provide adequate access to the parcel. Section line accesses are considered private lanes with no county maintenance.
