County Clerk of said County, reference thereto being made for all purposes; and,

of the County Clerk of said County, reference thereto being lade for all purposes;

corporation, Lessee, an oil, gas and mineral lease covering certain lands in
Weld County, Colorado, said lease being recorded in Book 141h, Page 292 of the
records of the County Clerk of said County, reference thereto being made for all
.purposes; and,
WIii:ttAS, the parties hereto are still the owners, respectively of all
of Lessor's and Lessee's rights, title and interest in and to said leases; and
WAERLAS, it is the desire of the parties hereto that said leases be
amended.
NOW, `1'ti,saLFORA , for and in consideration of the sum of Ten Dollars
(110.00) and other good and valuable consideration, the receipt of which is
hereby acknowledged, the parties hereto agree that Paragraph 9 of each of the
above listed leases be amended to read as follows,
9. a. Lessee may at any time or times, pool and consolidate
this lease, in whole or in part, or as to any stratum
or strata, with adjacent lands and leases, so as to
constitute a unit or units not substantially exceeding
the size required for the most efficient and economical
location and spacing of wells in the field or pool, but
not to exceed 90 acres if oil is produced or 660 acres
if gas only is produced, or the size (if any) approved
by State or Federal authorities, by delivering to Lessor
or to the depository hank or by filing for record an in-
strument so declaring. Drilling, mining or reworking
operations upon, or production of any mineral from any
part of any such unit shall be treated, for all purposes
hereunder, as such onerations upon or such production from
this lease, and shill) satisfy any obligation expressed or
implied for the drilling or producing of wells hereunder.
Upon production from any part of any such unit, Lessor
shall be entitled to royalties calculated as follows:
there shall be allocated to the portion of this lease
included in such unit a fractional part of such production,
in the ratio that the number of acres of this lease in.
eluded in such unit bears to the total number of acres
of all lands and leases included in such unit, and Lessor
shall be entitled to the royalties in this lease provided,
on such fractional part of such production, and no more.
Provided, that if State or Federal authorities shall pre—
scribe a different method of allocation, the method so
prescribed shall prevail.
b. It is further agreed that Lessee may commingle in a common
tank battery all oil produced from an area including all
or some of the lands covered by this lease and adjacent
lands thereto, which area, however, may not substantially
exceed &LO acres, comprised of surveyed subdivisions, and
attribute the total production from the said area to the
wells therein on the basis of individual well tests con-
ducted periodically by methods which are generally used in
the oil and gas industry or nrescribed by any State or
li Federal authority.
In all other respects said leases remain unchanged, and as modified
herein, are hereby ratified and confirmed as valid and subsisting leases, and
Lessor hereby grants and leases to Lessee the lands described therein for the
purposes, and upon the terms and conditions, set forth in said oil and 7as
and oil, gas and mineral leases, as hereby amended.
