NOW, THERERORE, BE IT RESOLVED, by The Board of County Commissioners of Weld County, Colorado, that they sign said agreement as per said conditions contained in said agree,ent, a copy df which is hereto attached and made a part of this resolution. DATEDL August 4, 1952 a r nits / L.<" .--A 1- t RESOLUTION TO SIGN FREEWAY AGREEMENT WITH STATE HIGHWAY COMMISSION-BY PASS OF HUDSON i O -'- / c;) Afrirh' i ,61 CA. - .,A t, ,. of /- r',, -_-,� a —2-11y,. a. 1 :,a : --`May 12, 1952 ?I 003-1(2) Weld County- FREEWAY AGREEMENT THIS AGREEMENT, dated this 12th day of May A.D. , 1952, by and between THE STATE HIGHWAY COMMISSION OF COLORADO, a public corporation, for the use and benefit of the DEPARTMENT OF HIGHWAYS of the State of Colorado, hereinafter called the "Department", and the County of Weld, State of Colorado, hereinafter called the "County", WITNESSETH: WHEREAS, under authority of the laws of the United States and of the State of Colorado, by and with the concurrence and approval of the United States Bureau of Public Roads, certain Federal and State funds have been allocated for the purpose of improving a portion of relocated State Highway No. 2, which passes through the County, said improvement being known as Project FI 003-1(2), the route and general plan of such project being shown on Exhibit "A", which is attached hereto, and by reference incorporated as a part hereof, and WHEREAS, in accordance with the laws of the State of Colorado, said portion of State Highway No. 2 in said County as so improved, and to be improved, has been designated a Freeway, and WHEREAS, the parties hereto desire to agree upon the location of said portion of State Highway No. 2 through the County, and also desire to agree, as required by the Freeway Law of the State of Colorado, upon the extent to which ingress to and egress from the arterial lanes of said portion of said State Highway No. 2 will be permitted. NOW, THEREFORE, in consideration of the premises and of the mutual covenants and agreements herein contained and the faithful performance thereof, the parties hereto promise and agree as follows: 1. The Department has made plans and specifications for the project designated as FT. 003-1(2) and will let the contract for and supervise the constructior of the project, all with funds allocated by the Federal and State Governments and without any expense to the County for such construction. 2. The County agrees to the general location of said portion of said State Highway No. 2, within the County, as such location is shown on said Ekhibit "A". 3. The County agrees as when and to the extent requested by the Department, to assist the Department in procuring the necessary rights-of-way and access rights required for tha project, the payment for said rights-of-way and access rights to be made from State and Federal funds. 4. The County and the Department agree that public ingress to and egress from the arterial lanes of said Freeway shall be permitted only at the following locations shown on Exhibit "A". A. At the intersection of the County road on or near the section line common to Sections 35 and 36, T. 2 N., R. 65 W., Sixth Principal Meridian, to and from West side only of the Freway. / , %; B. At the intersection of the County road (Present S.H. 2) in the NEk i - - Section 2, T. 1 N., R. 65 W. Sixth Principal Meridian, to and from East side only of the Freeway. May 12, 1952 2 .. At the intersection of the County road (Present S.H. 2) near the center of Section 10, T. 1.N. , 'R. 65 W. , Sixth Principal Meridian, to and from the East side only of the Freeway. G. At the intersection of the County roads at or near the section corner common to Sections 9, 10, 15 and 16, T. 1 N. , R. 65 W., Sixth Principal Meridian, to and from both sides of the Freeway. H. At the intersection of the County road on or near the section line common to Sections 16 and 21, T. 1 N. , R. 65 W., Sixth Principal Meridian, to and from both sides of the Freeway. I. At the inter-section of the County road on or near the section line common to Sections 20 and 21, T. 1 N., R. 65 W. , Sixth Principal Meridian, to and from the West side only of the Freeway. J. At the intersection of the County road on or near the section line common to Sections 20 and 29, T. 1 N. , R. 65 W. , Sixth Principal Meridian, to and from the East side only of the Freeway. I. At the intersection of the County road on or near the section line common to Sections 29 and 30, T. 1 N. R. 65 W. Sixth Principal Meridian, to and from the West side only of the Freeway. L. At the intersection of the County road on or near the suction line common to Sections 30 and 31, T. 1 N. , R. 65 W. , Sixth Principal Meridian, to and from both sides of the Freeway. M. At the intersection of the County roads on or near the ADAMS-IC.D County Line, to and from both sides of the Freeway. Ingress to and egress from the arterial lanes of the Freeway as described above in this Paragraph 4, has reference only to public ingress and egress. The matter of private access to the arterial lanes of the Freeway will be taken care of either by providing an outer highway or service read leading to points of public access or by providing a private access or by acquisition of the access rights, as may be found most expedient by the Department. 5. The County and the Department agree that no ingress to or egress from the arterial lanes of said Freeway shall be permitted, except as provided in Paragraph 4 above and in connection therewith the County agrees that the Chief Engineer of the Department may close any or all streets, avenues, boulevards, alleys, county highways and other public ways with said Freeway except for the points of ingress and egress specified in Paragraph 4 above, and thereby prevent and prohibit ingress and egress to and from said Freeway from and to said streets, avenues, boulevards, alleys, county highways and other public ways over which the County has jurisdiction; provided, however, that points of ingress to and egress from the arterial lanes of said Freeway may be changed or altered from time to time, as provided by Section 4, Chapter 195, S.L. 1941, or as the same may be amended. 6. This agreement shall not be deemed valid until it shall have been approved by the Controller of the State of Colorado, or by such assistant as he may designate. 7. All of the covenants and agraeraents herein contained shall be binding upon and inure to the benefit of the successors and assigns of the parties hereto respectively.
