Approved with Conditions The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of the County. 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. Prior to recording the plat, the applicant shall: A. The following notes shall be placed on the plat: (1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. PURPOSE of the request is to extend the lot line of Deubachs property to the East to increase their lot size an additional 0.772 acres. They have owned these parcels for some time. The Peters ' own a 3 . 2 Acre tract between the others. They now desire to sell parcels off each side to the adjoining owners and retain the center parcel which contains their home and improvements. The Deubach ' s and Fangmeier ' s want to increase the size of their parcels . In order to protect their purchases and provide flexibility they are each, concurrently, making application for Recorded Exemptions . The minimum parcel will be 1 . 00 Acres (which is the same size as the Fangmeier ' s present tract) . The largest parcel of this proposal will be 2. 3 Acres, with an average lot size of 1 . 35 Acres upon completion. These lots will be compatible with the lots in Sandy Knoll Estates to the South. Preliminary discussions were made with Shani Eastin, County Planning, in order to provide the necessary requirements and sequence of events to complete this process . All applications and plats are being submitted concurrently in order to better explain, coordinate and expedite the total process. The following outline is the procedure that has been suggested. 1 . Peters (Owners of Lot B Recorded Exemption 542) and Deubach 's (Owners of Lot A Recorded Exemption 542) are requesting an Amended Recorded Exemption to adjust their common line and create a legal description for transfer of 0.772 Acres to Deubach 's, for a new total of 3. 3402 Acres. 2. Peters ' (Owner of Lot B of Recorded Exemption 542) and Fangmeier 's (Owner of a 1 .003 Acre Metes & Bounds Tract) are requesting a Subdivision Exemption to adjust the common line and create a new legal description for the transfer of 1 . 00 Acres to Fangmeier ' s for a new total of 2.003 Acres . 3. Deubach ' s request a Recorded Exemption on their new tract to create a Lot A of 1 . 000 Acre and Lot B of 2.3402 Acres . 4. WCR 54% is designated, on the Transportation Plan Map, as a Collector Status road requiring 80 feet of right-of- way, presently there is 60 feet. REQUIREMENTS: The applicant should reserve an additional 10 feet of right-of-way through the entire length of the property for the expansion and full build out of WCR 54%. Lot A, the 3.3-acre parcel, has an existing residence and one access in place. The applicant should utilize this access point, no additional accesses will be granted.
