Lupton, Colorado 80621 We thank you for the time you extended to us today for our presentation on behalf of our request for approval of ZPAD-79. We very much appreciate the professional manner in which you chaired the meeting. There is something we are trying to understand, and we would like to ask a question to help us. The question is: What is it that we needed to say and/or do in order to convince the Board of County Commissioners that our ZPAD-79 request should have been approved? We expect that at some time in the future we may be again applying for an accessory dwelling. We would like to clearly understand what criteria are being used to approve or deny requests such as ours. There was obviously something that you discerned about the nature of our request that lead to your vote against denial of ZPAD-79. BOX 758 GREELEY, COLORADO 80632 May 28, 1997 Richard and Elizabeth Wilson 670-7 Weld County Road 19 Fort Lupton, CO 80621 RE: Response to Letter of April 30, 1997, Regarding ZPAD-79 Dear Mr. and Mrs. Wilson: The Board of County Commissioners has received your letter of April 30, 1997, regarding ZPAD-79. In your letter, you ask "What is it that we needed to say and/or do in order to convince the Board of County Commissioners that our ZPAD-79 request should have been approved?" Enclosed is a copy of the Board of County Commissioners' Resolution regarding its decision on the ZPAD-79 request. Also enclosed is a copy of § 43.2.3.1 of the Weld County Zoning Ordinance (Weld County Ordinance 89, as amended). As you can see from the Resolution, the Board of County Commissioners addressed each of the criteria which are stated in the regulation. The Board of County Commissioners cannot give you any guidance as to what it is you should say or do which will convince the Board to approve any zoning request you submit in the future, other than to always speak forthrightly to each of the pertinent criteria associated with the request. Your letter also suggests that you will be applying again for an accessory dwelling "some time in the future." Please be advised that pursuant to Section entitled, "Applications for Land -Use Matters for Property Previously Denied,"of the Weld County Administrative Manual, you will need to go through a substantial change hearing if you desire to reapply for an accessory dwelling for the same property. The Board of County Commissioners will determine in the substantial change hearing whether the facts and circumstances regarding the request have changed substantially from your original application. No reapplication for the accessory dwelling on the property will be accepted by the Department of Planning Services unless and until the Board approves of the filing after a substantial change hearing.
