RE: GRANT MOBILE HOME PERMIT #2083 - DIENGDOH
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 29th
day of October, 1997, considered the request of Abstar Diengdoh, 322 N. 21st Avenue,
Greeley, Colorado 80631, for a mobile home to be used as a principal dwelling, and
WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a
parcel of land being more particularly described as follows:
North % of Lots 10 and 11, Block 4, Valley View, a subdivision
located in the NE% NW% of Section 30, Township 5 North, Range
65 West of the 6th P.M., Weld County, Colorado
WHEREAS, the Board of County Commissioners, having heard all of the testimony,
finds that said request should be granted subject to the following conditions:
1. The applicant shall apply for a building permit for the mobile home prior to
locating the mobile home on the property.
2. Prior to the occupancy of the mobile home, the mobile home shall be connected
to an approved septic system and a legal water supply.
3. The mobile home shall meet the minimum setback and offset requirements for
the A (Agricultural) Zone District.
4. The mobile home shall not be occupied until such time that the applicant has
complied with Conditions 1, 2, and 3 stated above.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request of Abstar Diengdoh for permission to place a mobile
home to be used as a principal dwelling on the above described parcel of land, which was found
to be in compliance with Section 43 of the Weld County Zoning Ordinance, be, and hereby is,
granted subject to the hereinabove listed conditions.

The Department of Planning Services' staff has reviewed this request and recommends that this
request be approved for the following reasons:
1. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance
with Section 43.2.6 of the Weld County Zoning Ordinance, as follows:
a. Section 43.2.6.1.1 - The mobile home will be compatible with the surrounding area. The mobile
home is proposed to be located in a platted subdivision which is predominantly mobile homes
at the present. The proposed lot is bordered on the north, south and west with existing mobile
homes. A vacant lot is to the east.
Section 43.2.6.1.2 - The mobile home is consistent with the Weld County Comprehensive Plan.
Although this subdivision is in the A (Agricultural) zone district, the primary land use in this area
is residential. Residential Goal and Policy 3 encourages a compact form of urban development
by directing residential growth to urban growth boundary areas and to those areas where urban
services are already available before committing alternate areas to residential use. The
proposed mobile home will effectively in -fill a lot with existing urban services which is
surrounded by other mobile homes

c. Section 43.2.6.1.3 - There is adequate availability of water and sewage disposal facilities for the
mobile home. The mobile home will be served by the Central Weld County Water District and
the existing septic tank system is permitted by permit #SP -9700408.
d. Section 43.2.6.1.4 - The conditions of approval will ensure that there are adequate provisions
for the general health, safety and welfare of the inhabitants of the area and the county.
The Department of Planning Services' staff recommendation for approval is conditional upon the
following:
1. The applicant shall apply for a building permit for the mobile home prior to locating the
mobile home on the property.
Prior to the occupancy of the mobile home, the mobile home shall be connected to an
approved septic system and a legal water supply.
3. The mobile home shall meet the minimum setback and offset requirements for the A
(Agricultural) zone district.
4. The mobile home shall not be occupied until such time that the applicant has complied with
Conditions 1, 2 and 3 stated above.

1 letter is in response to your request for the availability of additional water service for the

3757 McAvoy. Additional water service can be made available to this property provided all
requirements of Central Weld County Water District, Northern Colorado Water Conservancy

Dear Mr. Ballstadt:
This letter is in response to the request to place a mobile home on Lot 9 of Block 4, Valley View
Subdivision, Weld County.
Staff at the City of Evans has many concerns regarding this request. The following issues address
our concerns:
1) The City of Evans mobile home regulations allow mobile homes as principal dwellings
to be place in the R -5A communities or PUD zones. The placement of this mobile home would
be in violation of the City of Evans zoning ordinance. Since this site is in the city's urban growth
area and will more than likely be annexed to the City, denial of this proposal could alleviate a non-
conforming use in the future.
2) The City of Evans mobile home code also requires a 10' separation from any building or
property line. The site plan shows only a 5' setback.
3) The Uniform Building Code requires all residential units to have a landing at all doors.
If there is a door located on the north side of the mobile home the installation of a landing or
stairs would be in violation of the Building Code unless such structure was one hour fire rated.
4) This lot is approximately 130 feet from an existing sanitary sewer main. The city
request the septic tank permit be denied, and the property owners be required to connect to the
City's main. We have forwarded a copy of this letter to the Health Department concerning this
particular issue.
5) Research of County Referrals showed the city recommending denial of the same request
for the same individual on a different lot in 1995, in addition to a similar request from another
individual.
Therefore, staff respectfully recommends denial of this proposal, and requests that Weld County
accept our recommendation. We appreciate the opportunity to comment on this proposal. If you

A septic permit was issued for the property located at 3757 McAvoy Ave, Evans on September
11, 1997 and a final inspection was conducted on October 3, 1997. On October 3, 1997 this
Department received a letter from the City of Evans regarding the mobile home zoning request
and the issuance of the septic permit. In that letter they requested that the septic permit be
denied, stating that the City of Evans has a sewer main within approximately 130 feet of the lot.
I contacted Elizabeth Relford, Planner with the City of Evans on October 6, 1997 to explain the
situation, and again on October 9, 1997. She stated that they did not re -measure the distance
from the property to the sewer main, that this distance was an estimation from city maps. Ms.
Relford also stated that the City's comments will stand, however, they are not interested in
making someone rip -out or otherwise abandon a system, and that they won't push the issue,
their comments are a recommendation to Weld County Department of Planning. I discussed
this issue with Jeff Stoll, who in turn discussed it with Bruce Barker, Weld County Attorney.
This Department will stand by the septic permit as issued based on the fact that staff trusted
that the situation was the same when the permit was issued and that the letter from the City of
Evans was received after the fact.
