RE: APPROVE ACCEPTANCE OF EASEMENT FOR PARKING AT THE DEPARTMENT OF
SOCIAL SERVICES BUILDING AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Easement for parking at the
Department of Social Services Building between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, and the City of Greeley, 1000 10th
Street, Greeley, Colorado 80631, with terms and conditions being as stated in said easement,
and
WHEREAS, after review, the Board deems it advisable to accept said easement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Easement for parking at the Department of Social Services Building
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, and the City of Greeley be, and hereby is, accepted.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said easement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 9th day of September, A.D., 1998.

EASEMENT
THIS EASEMENT, granted this 1st day of June, 1998, between the City of Greeley,
Colorado, a municipal corporation of the State of Colorado, whose legal address is 1000 10th Street,
Greeley, Colorado 80631 of the County of Weld, State of Colorado, the Grantor, and, the County of
Weld, a body corporate and politic of the State of Colorado whose legal address is 915 10th Street,
Greeley, Colorado 80631 of the County of Weld , and State of Colorado, the Grantee.
WITNESSETH, that the Grantor, for and in consideration of the sum of$1.00 dollar and
other good and valuable consideration, paid to the Grantor by the Grantee, the receipt and
sufficiency of which is hereby acknowledged, does hereby grant, bargain, sell, and convey to the
Grantee an easement for the purposes of a parking lot for visitors to the Weld County Department of
Social Services over and across the following described parcel of real property situate in the
County of Weld and State of Colorado to wit: The north half of the vacated `C' Street lying west of
11th Avenue and east of Lot 6, Block 33, Clayton Park, City of Greeley, County of Weld, State of
Colorado.
This Easement is for the benefit of and appurtenant to that land, or any part thereof, situate
in the County of Weld and State of Colorado, and described as: Lots 1, 2, 3, 4, 5, 22, 23, 24, 25,
and 26, Block 33, City of Greeley, County of Weld, State of Colorado and is permanent.
IN WITNESS WHEREOF, I, LaVern Nelson, Mayor, City of Greeley, on behalf of said
City and by virtue of the Order contained in the Resolution made by the Greeley City Council on
the 4th day of August , 1998, have hereunto set my hand and affixed the seal
of said City this 4th day of August , 1998, for the uses and purposes therein

The Grantee hereby accepts this easement for a parking lot for visitors to the Weld County
Department of Social Services and agrees to repair and maintain the easement granted herein at the
cost and expense of the Grantee, and that said Grantee will in no way hinder or prevent the proper
and reasonable use and enjoyment of the property through which the easement is granted.

CITY OF GREELEY,COLORADO
RESOLUTION NO. 50 , 1998
A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AN EASEMENT AGREEMENT
WITH WELD COUNTY TO PROVIDE PARKING AT THE WALTON BUILDING.
WHEREAS, the City Council of the City of Greeley is desirous of cooperating with Weld
County to provide needed parking for the Walton Building located at C Street and 11th Avenue in
Greeley; and
WHEREAS,the County owns all of the property needed for said parking with the exception
of one small sliver of land owned by the City(see shaded portion to Exhibit"A" attached hereto and
incorporated herein); and
WHEREAS, an easement agreement granting use of that property by the County has been
drafted and said easement agreement is legally sufficient.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GREELEY, COLORADO AS FOLLOWS:
Section 1. The City Council authorizes the Mayor to sign an easement agreement between
the City of Greeley and Weld County to provide parking at the Walton Building.
Section 2. This resolution shall become effective immediately upon its passage, as provided
by the Greeley City Charter.
PASSED AND ADOPTED, SIGNED AND APPROVED this 4th day of
August , 1998.
