RE: GRANT MOBILE HOME PERMIT #1958 - MANNING
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 19th
day of June, 1995, considered the request of Beverly Manning, 15025 Good Avenue, Fort Lupton,
Colorado 80621, for a mobile home to be used temporarily during a medical hardship, and
WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a
parcel of land being more particularly described as Part of Tract 12, Second Filing, Aristocrat
Ranchettes, Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, having heard the testimony, finds that
said request should be granted subject to the following conditions:
1. The existing septic system must be evaluated to assure it is adequately sized and
constructed for the proposed load. The evaluation may be completed by either a
Registered Professional Engineer or the Environmental Protection Services of the
Weld County Health Department. A copy of the approval shall be submitted to the
Department of Planning Services.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of Beverly Manning for permission to place a mobile home to
be used temporarily during a medical hardship on the above described parcel of land, which was
found to be in compliance with Section 43 of the Weld County Zoning Ordinance, be, and hereby
is, granted subject to the hereinabove listed conditions.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 19th day of June, A.D., 1995.

The City of Fort Lupton has concerns about the type of water and
sewer being used. These issues were discussed with the City and
the City of Fort Lupton has no concerns.
The Weld County Health Department recommends conditional
approval upon having the septic system evaluated to assure
adequate size and construction for size load.
STAFF RECOMMENDATION: Staff recommends conditional approval of the
request.

DECREE OF DISSOLUTION OF MARRIAGE AND FINAL ORDERS
- In Re the Marriage of:
BEVERLY MANNING,
Petitioner,
and
LEON MANNING,
Respondent.
The above -captioned matter came on for Trial on the 30th day of
November, 1989 for Final Orders. Both parties appeared in person and through
their respective counsel of record; the Court having heard testimony of the
parties and of DON KRIEGER; having received exhibits; heard argument of
counsel and being thereby fully advised in the premises,
HEREBY FINDS AS FOLLOWS:
1. The Court has jurisdiction over the parties and the subject matter
herein.
2. The marriage between the parties is irretrievably broken, and a
Decree of Dissolution of Marriage should enter at this time.
3. There are children of the marriage, however, all of the children
are emancipated.
4. The parties have entered into a partial agreement with respect to
some personal property, and the Petitioner has agreed to deliver to the
Respondent, within ten (10) days, the following property:
a. Any of Respondent's power tools in Petitioner's possession;
b. One (1) antique stove;
c. Any of Respondent's pictures presently in Petitioner's
possession; and
d. One (1) antique glass lamp given to the parties by the
Respondent's grandmother.
5. The Petitioner has suffered a reduced earning ability due to a
medical disability suffered during the marriage, and is presently not able to
support herself in the same lifestyle she enjoyed while married. It is
reasonable for the Court to Order maintenance in the total amount of Six
Hundred Dollars ($600.00) for purposes of the Petitioner furthering her
education.

6. The Respondent makes substantially more income than the
Petitioner, and it would be equitable to award the Petitioner approximately
two-thirds of her Nine Hundred Eighty One Dollars ($981.00) attorney's fees
incurred as a result of this dissolution action.
7. The value of the marital residence, a mobile home, is
approximately Two Thousand Dollars ($2,000.00), and the marital residence,
including the land on which it is situated, has a net equity value of One
Thousand, Five Hundred Dollars ($1,500.00). The value of Respondent's pension
or P.E.R.A. is Nineteen Thousand, Six Hundred Forty Two Dollars ($19,642.00),
and the property of the marriage should be divided equally between the
parties.
THE COURT THEREFORE ORDERS AS FOLLOWS:
1. That a Decree of Dissolution of Marriage is entered, and the
marriage between the parties is hereby dissolved.
2. Certain personal property, as set out in the findings above, shall
be delivered to the Respondent by the Petitioner within ten (10) days.
3. The Petitioner is awarded maintenance from the Respondent in the
total amount of Six Hundred Dollars ($600.00). The Respondent shall pay to
the Petitioner Two Hundred Dollars ($200.00) per quarter for a maximum of
three (3) quarters, and said amount shall be due and payable to the Petitioner
upon Respondent's receipt of an admission slip or other documentation showing
that Petitioner has been admitted into school. The Respondent shall not be
responsible for any maintenance after July 1991.
4. The Respondent shall pay to the Petitioner, as and for her
attorney's fees incurred in this action, the sum of Six Hundred Dollars
($600.00) no later than the 31st day of January, 1990.
5. The Petitioner is awarded the sole use, possession and ownership
of the marital residence, including the mobile home and land located at 15025
Good Avenue, Fort Lupton, Colorado, and the Petitioner shall be responsible
for all debts associated with that property. The Respondent shall execute
whatever documents are necessary to transfer his interest in that property to
the Petitioner.
6. Each party shall retain the permanent use, possession and
ownership of all personal property presently in their possession, except for
the specific items of property as set out in the findings above.
7. The Petitioner is awarded Nine, Thousand, Seventy One Dollars
($9,071.00) of Respondent's P.E.R.A. or retirement account, and she shall be
entitled to that amount in full in the event that the Respondent, at any time,
withdraws the full amount, or in the event the Respondent receives a
retirement annuity, and she shall be entitled to a percentage of Respondent's
annuity payments equal to the percentage as Nine Thousand, Seventy One Dollars
($9,071.00) relates to the total amount of Respondent's P.E.R.A. at the time
of disbursement.

8. This Court retains jurisdiction over the parties and this action
as is provided by law.

regular meeting of May 9, 1995.
The Commission was concerned about this referral because it did not mention water or sewer for
the new Mobile Home. The commission cannot make a recommendation as there is not enough
information regarding the utilities. If the County can provide us with more information we will
