The Weld County Council met in regular session in full conformity wit)tipie We,,I4county
Centennial Center, 915 10th Street, Greeley, CO, Tuesday, December 15, 1998, 6:30
p.m..
ROLL CALL: The meeting was called to order by President Judy Curtis. Vice
President Dan Oster, Councilman Ralph Campbell, Councilwoman Pam Malcom, and
Councilman Al Roberts were present, constituting a quorum of the members. Also
present: Sharon Hopper, Dwaine Kurtz, Steve Lannen, Keith McIntyre, Dan Post, Joyce
Smock, and the Council secretary, Bev Thomas.
APPROVAL OF MINUTES: Councilwoman Pam Malcom made a motion to approve
the November 17, 1998 meeting minutes. Councilman Ralph Campbell seconded the
motion and it was approved unanimously.
SIGNING OF RESOLUTION 122: Council members signed Weld County Council
Resolution 122 that had been adopted at the November 17, 1998 meeting.
PUBLIC COMMENT: Mr. Dan Post, a Greeley attorney, presented concerns about the
lease between Weld County and Winona's Deli. Mr. Post said that the lease had been
brought to his attention by landlords and tenants in downtown Greeley. He said his
clients at this time desire to be anonymous and hope to avoid litigation. Mr. Post stated
that Winona's was able to rent its second floor area of the Weld County Centennial
Center for a price considerably below the going rate for rental space in downtown
Greeley.
He said that tenants in downtown are concerned because they can't get the same kind
of rental rate and landlords are concerned about their property values. Mr. Post said
that according to Colorado Revised Statutes the County cannot subsidize a private
company and it appears that Winona's is receiving a subsidy. County Attorney Bruce
Barker had been instructed by the Board of County Commissioners to not answer Mr.
Post's letter requesting information about the lease.
In response to Mr. Post's request for a Council review of the matter Council members
committed to get information about this situation.
APPOINTMENTS: President Judy Curtis, Vice President Oster, and Councilman Al
Roberts will attend the Retiring Commissioners Reception December 21, 1998.
CORRESPONDENCE: The Council reviewed the correspondence.

COORDINATOR REPORTS:
Social Services Grievance Board
President Judy Curtis reported she had obtained the names of the appointees to the
Social Services Grievance Board. She is going to research the activity of the Social
Services Grievance Board.
Council's Letter to State Attorney General's Office
President Curtis reported that Richard Westfall, Solicitor General of the State Attorney
General's office, in response to the Council's November 23, 1998 letter had telephoned
her and indicated that he was an advocate for Social Services.
The Council agreed that ultimately the Weld County Home Charter would need to be
changed to clarify the jurisdiction of the Weld County Council to review the Weld County
Airport and Weld County Social Services.
Midtown Materials
Sharon Hopper reported her frustration with the County's response to the continued
planning violations by Midtown Materials. Councilman Roberts said that he would
continue to track the County's response to Midtown Materials.
Election Petition Concerns
Mrs. Hopper requested a copy of the letter written by County Attorney Bruce Barker
regarding the Board of County Commissioners carrying petitions for Weld County
Council candidates. She also requested a copy of the Weld County Council's review of
the County election petition process.
Councilman AL Roberts reported that attention to the following election concerns are
pending: 1) use of ditto marks on candidate petitions 2) update of the petition used by
candidates for the Weld County Council 3) Can a person residing in one Weld County
district circulate a petition for a candidate running in a different Weld County district?
Parking Near Centennial Center
Councilman Al Roberts reported the result of his findings regarding Weld County
Planning Department employees' parking concerns when they come to the Centennial
Center to Planning hearings. Councilman Roberts said that employees cannot park
near the Centennial Center for more than two hours without getting a parking ticket.
Councilman Roberts talked to City of Greeley personnel and Commissioner Webster
and learned that the best parking options are a three-hour city parking lot between 8th
and 9th Avenue and the unlimited-time parking lot at the Greeley Train Depot.

NEW BUSINESS:
Search for District I Councilman
The Council has published a notice requesting persons interested in the District I
Councilman position submit a letter of application and a resume to the Council by 5:00
p.m. January 5, 1999. Joyce Smock and Keith Mclntrye, District I Councilman
applicants, visited with the Council.
Councilman Ralph Campbell urged the 1999 Council to get guidelines from the
Personnel Department before interviewing applicants for District I Councilman.
Payment of the Bills
Councilman Ralph Campbell made a motion to pay the following bills:
Mileage for Councilman Ralph Campbell $11.88
Mileage for President Judy Curtis $23.22
Reimburse Meals for Judy Curtis $50.53
Mileage for Vice President Dan Oster $ 7.56
Mileage for Councilman Al Roberts $28.08
Ft. Lupton Press for Legal Notice $18.00
Councilwoman Pam Malcom seconded the motion and it carried unanimously.
Secretarial Research Requests
Councilman Dan Oster will return a communication scanner that had been lent to the
Council by the Communications Department. Councilman Ralph Campbell suggested
that the Council obtain a scanner that is currently used by the Communications
Department.
ADJOURNMENT: The meeting was adjo ed at 9:00 p.m..
