In the plans, we are including an interchange one mile west of the Weld-Morgan County line which will be used by the Kingsbury Ranch as a highway cross- ing to and from their properties located on both the north and south sides of the highway. In order to make this interchange effective, it will be nec- essary that it have a connection to Chappel Lane to be used as an outlet to the north. Our proposal to accomplish this is for the County Road which extends west along the north side of Sections 14 and 15, T. 3 N., R. 61 W., to remain in its present condition and not to be vacated by the County. Please consider this a request for your approval of the above proposal and a confirmation of same by letter at your earliest convenience. We certainly thank you for your cooperation in this matter. D. 1957, by and between THE STATE HIGHWAY COMMISSION OF COLORADO, a body corporate, for the use and benefit of the DEPARTMENT OF HIGHWAYS of the State of Colorado, hereinafter called the "Department", and the County of Weld, State of Colorado, hereinafter called the "County", WITNESSETH: WHEREAS, under authority of the laws of the United States and of the State of Colorado, by and with the concurrence and approval of the United States Bureau of Public Roads, certain State and Federal funds have been allocated for the purpose of improving a portion of relocated State Highway No. 2, which passes through the County, said improvements being known as Project I 093-1(5), the route and general plan of such project being shown on Exhibit "A", which is attached hereto, and by reference incorporated as a part hereof, and WHEREAS, in accordance with the laws of the State of Colorado, said portion of State Highway No. 2 in said County as so improved, and to be further improved, has been designated a Freeway, and WHEREAS, the parties hereto desire to agree upon the location of said portion of State Highway No. 2 through the County, and also desire to agree, as required by the Freeway Law of the State of Colorado, upon the extent to which ingress to and egress from the arterial lanes of said portion of said State Highway No. 2 will be permitted. NOW, THEREFORE, in consideration of the premises and of the mutual covenants and agreements herein contained and the faithful performance thereof, the parties hereto promise and agree as follows: /91/20 f -� • s • i y • October 25, 1957 I 093-1(5) Weld County 1. The Department will make plans and specifications for the project, now designated as I 093-1(5), and will let the contract for and supervise the construc- tion of the project, all with funds allocated by the State and Federal Government and without any expense to the County for such construction. 2. The County agrees to the general location of said portion of said State Highway No. 2 within the County, as such location is shown on said Exhibit "A". 3. The County agrees that when and to the extent requested by the Department, it will assist the Department in procuring the necessary rights-of-way and access rights required for the project, the payment for said rights-of-way and access rights to be made from State and Federal funds. 4. The County and the Department agree that public ingress to and egress from the arterial lanes of said Freeway shall be permitted only at the following locations shown on Rvhibit "A". A. At the intersection of the approach to the frontage road in the NW k, Section 34, T. 3 N., R. 62 W., Sixth Principal Meridian (Freeway Survey Station 1861±) ingress to the eastbound travel lanes of the Freeway by means of right turns only. Traffic will not be permitted to cross the median at this point. B. At the intersection of the approach to the frontage road in the NE ,i—„ Section 21, T. 3 N., R. 61 W., Sixth Principal Meridian (Freeway Survey Station 2155±) to and from both sides of the Freeway. C. At the intersection of the approach to the frontage roads in the NE I, Section 14, T. 3 N., R. 61 W., Sixth Principal Meridian (Freeway Survey Station 22944) to and from both sides of the Freeway. Ingress to and egress from the arterial lanes of the Freeway as described above in this Paragraph 4 has reference only to public ingress and egress. The matter of private access to the arterial lanes of the Freeway will be taken care of either by providing an outer highway or frontage road leading to points of public access or by providing a private access or by acquisition of the access rights, as may be found most expedient by the Department. All County roads presently in existence and use within said County which may be affected by the terms of this agreement will be terminated, rerouted, or separa- ted from the Freeway in a manner that will best serve the interests of local and freeway traffic. -2- . ;. 9 . • • 01( October 25, 1957 I 093-1(5) Weld County 5. The County and the Department agree that no ingress to or egress from the arterial lanes of said Freeway shall be permitted, except as provided in Paragraph 4 above and in connection therewith the County agrees that the Chief Engineer of the Department may close any or all streets, avenues, boulevards, alleys, county highways and other public ways which intersect said Freeway except for the points of ingress and egress to and from said Freeway, from and to said streets, avenues, boulevards, alleys, county highways and other public way over which the County has jurisdiction; provided, however, that points of ingress to and egress from the arterial lanes of said Freeway may only be changed or altered with the concurrence of the Bureau of Public Roads and as provided by Chapter 120, Art. 6, Sec. 4, C.R.S. 1953, as amended, or as same may be amended. 6. All of the covenants and agreements herein contained shall be binding upon and inure to the benefit of the successors and assigns of the parties hereto respectively.
