RE: APPROVE NOTICE OF INTENT TO TERMINATE AGREEMENT FOR PATHOLOGIST
SERVICES BETWEEN DR. GARY CLARK AND HEALTH DEPARTMENT AND
AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Notice of Intent to Terminate the
Agreement for Pathologist Services between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, on behalf of the Weld County Health
Department, and Dr. Gary Clark, effective November 1, 1995, in accordance with Paragraph 8C
of said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said notice, a copy of
which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Notice of Intent to Terminate the Agreement for Pathologist Services
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Weld County Health Department, and Dr. Gary
Clark be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized
to sign said notice.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 14th day of August, A.D., 1995.

Dear Dr. Clark:
We appreciate the service you have provided our Weld County Health Department
over the past year. Through your technical input you have taken the
Laboratory a long way in meeting its quality assurance requirements.
At this time however, we have an opportunity to contract with a local
Pathologist who can provide more accessible and comprehensive consultation
services to the Department. Consequently we will be terminating our contract
with you effective November 1, 1995. In accordance with paragraph 8C of that
contract, please accept this letter as notice of intent to terminate.
Again, we appreciate your service to the Department, and wish you well in
future endeavors.

Agreement for Pathologist Services
The enactment of the Clinical Laboratory Improvement Act in 1993 required that
we obtain the services of a consulting Pathologist to provide ongoing clinical
supervision of our medical laboratory services. Initial efforts to locate a
Pathologist in the Greeley, Weld County area were unsuccessful and we
eventually contracted with a physician from Georgetown in order to satisfy
this requirement. While we have appreciated Dr. Gary Clark's services to the
Department, he has not been as accessible to staff for consultation and
follow-up as would have been a local physician.
It has come to our attention that a local Pathologist, Dr. Jerry Weil has
retired from full time practice. I have talked with Dr. Weil and he is
willing to work with our Department to satisfy the CLIA requirements. Living
less than a mile from our Department, Dr. Weil would certainly be more
accessible to staff. In addition, 1Dr. Weil has indicated that his associates
who are still in active practice at NCMC, would be able to provide coverage
when he is out of touch. This is a service we have not had in the past.
Given these facts, we feel a contract with Dr. Weil would result in a much
more effective and productive relationship.
I would recommend at this time that we terminate
