RE: APPROVE ASSIGNMENT OF PAYMENTS UNDER AGREEMENT FOR PURCHASE OF
SOIL AND/OR GRAVEL FOR ROAD PURPOSES BETWEEN WELD COUNTY AND
JUNE LEHR - LEHR PIT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Weld County is in need of soil and/or gravel for the construction and
maintenance of certain Weld County Roads, and
WHEREAS, June Lehr owned certain property, located within SE'% of Section 1,
Township 10 North, Range 67 West of the 6th P.M., Weld County, Colorado, on which there is soil
and/or gravel in suitable quantities for use in the construction and maintenance of said Weld
County Roads, and
WHEREAS, an Agreement for the Purchase of Soil and/or Gravel for Road Purposes
between Weld County and June Lehr was signed by the Board on November 14, 1990, with the
terms and conditions being as stated in said pagreement, a copy of which is attached hereto and
incorporated herein by reference, and
WHEREAS, June Lehr is recently deceased and her interest in the property has passed to
the June H. Lehr Living Trust, Tax I.D. #84-6279542, Trustee Victor Lehr, 3906 West 4th Street
Road, Greeley, Colorado 80634.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Assignment of Payments under the Agreement for the Purchase of Soil
and/or Gravel for Road Purposes between Weld County and June Lehr be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that this Resolution shall not be deemed to
have altered or amended any other portion of the agreement of November 14, 1990.
