Harbert, Chair Commissioner W. H. Webster, Pro-Tern Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Scott Ballstadt The following business was transacted: I hereby certify that pursuant to a notice dated May 19, 1998, and duly published June 3, 1998, in the Platteville Herald, a public hearing was conducted to consider the request of City of Longmont, Longmont BMX, Inc., 0/0 Tom Lindsey for a Recreational Facility (BMX bicycle racing track) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Scott Ballstadt, Department of Planning Services representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Ballstadt gave a brief description of the property location and stated the proposed public recreational facility will be open to the youth of Weld and Boulder counties. He further stated the proposal is consistent with the Weld County Zoning Ordinance, it is compatible with the existing surrounding land uses, and this use will be temporary since the City of Longmont intends to use the site for future expansion of Union Reservoir. Mr. Ballstadt stated the Department of Planning Services received two letters of concern; however, he addressed these concerns in the Conditions of Approval and Development Standards. In response to Commissioner Baxter and Chair Harbert, Mr. Ballstadt stated the property south of the site has been annexed into the City of Longmont and in reference to Condition 2.B. he explained the Weld County Sheriffs Office does patrol the area, as well as Union Reservoir rangers, who are in the area 24-hours a day.. Mr. Ballstadt stated the applicant spoke with Don Carroll, Department of Public Works, and discussed responsibility for speed limit signs. Tom Lindsey, applicant and operator of the BMX bicycle racing track, explained the County grades the road and the City of Longmont applies magnesium chloride to control the dust. Mr. Lindsey stated the neighbors, as well as the operators are concerned with the speed on Weld County Road 26, and the operation is being run by volunteers to benefit the children in Weld and Boulder Counties. Mr. Lindsey explained the City of Longmont allowed the track to be built and the operators have maintained the site. In response to Commissioner Baxter, Mr. Lindsey stated 981043 PL1251 et: Pt HEARING CERTIFICATION - CITY OF LONGMONT (USR #1182) PAGE 2 speeders will be stopped by the police who patrol the area at least four or five times daily; however, speed limit signs need to be posted. He clarified there are five Union Reservoir rangers, and they are on patrol 24-hours a day. In response to Commissioner Webster, Mr. Lindsey stated no motorized bikes are allowed on the loop track and they have $5 million of insurance coverage. Responding to Commissioner Kirkmeyer, Mr. Lindsey estimated twenty people use the track daily and 100 attend special events. Commissioner Kirkmeyer stated a traffic count in 1996 reported 168 vehicles used Weld County Road 26, which could easily increase to over 200 with the track. Mr. Lindsey reiterated he would like to see speed limit signs posted along the road. He stated the road is dust controlled by the City of Longmont from Weld County Road 1 past the track. Chair Harbert stated a paving agreement might be necessary with the City of Longmont if traffic is significantly increased. Commissioner Kirkmeyer agreed and stated Condition 2.6. is unclear. Mr. Ballstadt explained this condition pertains to on-site and off-site dust control. He stated Mr. Carroll explained Weld County currently does off-site grader preparation work and the City sprays the chemicals. In response to Commissioner Kirkmeyer, Mr. Ballstadt stated this has been a standing agreement; however, there is no written agreement. In response to Chair Harbert, Mr. Morrison stated there are other sources of traffic in the area and a future paving agreement would need to address the amount of traffic actually generated by the track. In response to Chair Harbert, Mr. Ballstadt stated the 1996 traffic count was done prior to the construction of the track and would be used as a reference when figuring the amount of traffic generated by the track. Mr. Morrison stated Condition 2.B. does address off-site maintenance of Weld County Road 26 and an addition can be made to the Dust Control Plan addressing the future need for paving. In response to Commissioner Baxter, Mr. Ballstadt stated, the City of Longmont currently sprays the road one or two times a year. Mr. Lindsey reported the City sprayed the road at the beginning of the season and then, one month later, and added the City has a strong commitment to keeping the dust down to benefit the community. He further stated the City of Longmont is the landowner; however, Longmont BMX, Inc., is leasing the land. Mr. Lindsey reiterated this will be a family-oriented facility and the parking lot will also be sprayed to benefit the users of the track. In response to Commissioner Hall, Mr. Lindsey stated he is anticipating the track to be used for approximately five years. Commissioner Hall commented that the City has already shown a commitment to controlling the dust regardless of a written agreement. Commissioner Kirkmeyer clarified for the applicant that if there is a future need to hard-surface the parking lot, a Storm Water and Drainage Plan may be required as mentioned in Mr. Carroll's memorandum dated March 18, 1998, and Development Standard #21. Mr. Ballstadt stated this issue was discussed with the applicant at the Planning Commission hearing as well. No public testimony was offered concerning this matter. Commissioner Hall moved to approve the request of the City of Longmont, Longmont BMX, Inc., % Tom Lindsey for a Site Specific Development Plan and Special Review Permit #1182 for a Recreational Facility (BMX bicycle racing track) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record.
