RE: GRANT ZONING PERMIT#2128 FOR A MOBILE HOME TO BE USED AS A
PRINCIPAL DWELLING -JUAN AND MARIA DEL CARMEN RAMIREZ
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the
22nd day of February, 1999, considered the request of Juan and Maria Del Carmen Ramirez,
1020 37th Street, Evans, Colorado 80620, for a mobile home to be used as a principal dwelling,
and
WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a
parcel of land being more particularly described as follows:

63 West of the 6th P.M., Weld County, Colorado
WHEREAS, the Board of County Commissioners, having heard the testimony, finds that
said request should be granted subject to the following conditions:
1. The access shall be placed in such a location to have adequate sight distance in
both directions and not below the crest of a hill or where physical obstructions
are present.
2. A local residential/agricultural access shall be a minimum distance of 75 feet
from an intersecting county or state roadway.
3. If a drainage culvert is required, a 15-inch CMP (Corrugated Metal Pipe) is the
minimum size. If the applicant chooses to place a larger culvert, please contact
the Public Works Department to adequately size your culvert.
4. The existing access shall be closed, and the new access shall be off Weld
County Road 78.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request of Juan and Maria Del Carmen Ramirez for permission
to place a Mobile Home to be Used as a Principal Dwelling on the above described parcel of
land, which was found to be in compliance with Section 43 of the Weld County Zoning
Ordinance, be, and hereby is, granted subject to the hereinabove listed conditions.

THE DEPARTMENT OF PLANNING SERVICES'STAFF RECOMMENDS THAT THIS
REQUEST BE APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of
Section 43.2 of the Weld County Zoning Ordinance, as amended.
2. It is the opinion of the Department of Planning Services' staff that the applicant has
shown compliance with Section 43.2.6 of the Weld County Zoning Ordinance, as
amended, as follows:
a. Section 43.2.6.1 - That the Board of County Commissioners shall hear the
application at a regularly scheduled meeting of the Board, if the application
does not meet the criteria stated in Sections 43.2.6.1 through 43.2.6.4 and

which has only four (4) out of six (6) or 66% of the signatures of their
neighboring property owners. Section 43.4.2 of the Weld County Zoning
Ordinance directs applicants to collect at least seventy percent 70% of the
signatures of the people owning property within five-hundred (500)feet of the
property on which the MOBILE HOME is proposed to be located.
b. Section 43.2.6.1.1 - Compatibility with surrounding area, harmony with the
character of the NEIGHBORHOOD and its effects upon the immediate area.
The subject property is roughly six (6) miles Northeast of Galeton and is
predominantly vegetated in sage brush. The surrounding area is un-irrigated
and is agriculturally zoned land. The neighboring properties have mobile
homes on them.
c. Section 43.2.6.1.2 - Compatibility with the Weld County Comprehensive
Plan. R.Policy 1 states that "Opportunities for multiple-family and
manufactured home developments should be provided to encourage lower-
cost renter and owner occupied housing." The applicant owns the mobile
home they will be living in and they own the 80 acre parcel of land where it
will be located.
d. Section 43.2.6.1.3 -- Availability of adequate water and sewage disposal
facilities. The applicant has a Well permit (#213804) from the Colorado
Division of Water Resources and a Septic permit from the Weld County
Health Department (SP-9800544).
e. Section 43.2.6.1.4-- The general health, safety and welfare of the inhabitants
of the area and the COUNTY The attached conditions of approval ensure
the health, safety and welfare of the inhabitants of the NEIGHBORHOOD and
the County.
f. Section 43.2.6.2 -- One (1) zoning permit fora MOBILE HOME as a principal
DWELLING UNIT shall be issued for each LEGAL LOT in the A District in
Weld County, Colorado. The applicant has applied for one Zoning Permit for
a Mobile Home as a principal DWELLING UNIT on an 80 acre parcel.
This recommendation is based, in part, upon a review of the application materials
submitted by the applicant, other relevant information regarding the request, and
responses from referral entities.
The Department of Planning Services' staff has reviewed this request and approves this
request for the following reasons:

The applicant has submitted a petition in favor of the request. The petition contains the
signatures of 66% of the surrounding property owners within 500 feet of the property where
the mobile home is proposed to be located.
The Department of Planning Services's staff recommendation for approval is conditional
upon the following:
1. The access shall be placed in such a location to have adequate sight
distance in both directions and not below the crest of a hill or where
physical obstructions are present. (Public Works)
2. A local residential/agricultural access shall be a minimum distance of 75
feet from an intersecting county or state roadway. (Public Works)
3. If a drainage culvert is required, a 15-inch CMP (Corrugated Metal Pipe)
is the minimum size. If the applicant chooses to place a larger culvert,
please contact the PublicWorks Department to adequately size your

4. Whenever multiple accesses to a single level parcel exist and additional
accesses are requested, one or more existing accesses shall be removed,

The applicant is proposing a new access off WCR 78. These items are standard access
requirements for a new access point onto a Weld County road:
According to our policy granting one residential access per legal parcel, the existing access shall
be closed. The new access shall be placed in such a location to have adequate sight distance in
both directions and not below the crest of a hill or where physical obstructions are present.. A local
residential/agricultural access shall be a minimum distance of 75 feet from any intersecting county
roadway.

the application does not meet the approval criteria, you will be notified and asked to appear before the Board
of County Commissioners at a public hearing. You will be informed of the hearing date at least a week prior
to the hearing. The Board of County Commissioners will then consider your application and make a final
decision on the zoning permit for the mobile home.

The Weld County Public Works Department has reviewed this proposal; the following requirements are
recommended to be a part of any approval:
COMMENTS:
WCR 78 is designated on the Transportation Plan Map as a local gravel road which requires 60 feet of right-of-way
at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld County. Pursuant to
the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required
setback is measured from the future right-of-way line.
REQUIREMENTS:
The access shall be placed in such a location to have adequate sight distance in both directions and not below the
crest of a hill or where physical obstructions are present.
If a drainage culvert is required,a 15-inch CMP is the County minimum size. If the applicant chooses to place a
larger culvert, please contact the Public Works Department to adequately size your culvert.
A local residential/agricultural access shall be a minimum distance of 75 feet from an intersecting county or state
roadway, 150 feet for commercial type use.
Whenever multiple accesses to a single level parcel exist and additional accesses are requested, one or more
existing accesses shall be removed, minimizing new accesses and utilizing existing accesses.
