IN THE MATTER OF RFSCLUTICN RE : ASSESSMENT OF BUILDINGS OF THE GREELEY ICE AND STCF.AGE COMPANY FOR THE YEAR 1952 : Commissioner Winter offered the following Resolution : WHEPFAS, it appearing that taxpayer , The Greeley Ice & Storage Company , filed with the County Assessor of Weld County , Colorado , on April 29 , 19537 its Petition for abatement and/or for a refund of the 1952 taxes upon its Real Estate (buildings ) as theretofore determined and assessed for the year 1952 , by said Assessor , setting forth in said Petition.' the facts constituting erroneous or illegal assessment , and WHEREAS,. it further appearing that a preliminary hearing with said Assessor and the taxpayer was held April 29th , 1953 , and thereafter a full hearing upon said Petitions was held before said Assessor on July 28th , 1953 , said taxpayer , in writing waiving all notice of said hearing , and WHEREAS , at said hearing on July 28th , 1953 , said Assessor reviewed the 1952 assessment of the property of said taxpayer and heard all evidence relating thereto and on said July 28 , 1953 , said Assessor made his findings , determining : "That the total assessed value of the Peal Property described on the above numbered Schedule for 1952 was $131+ , 690 . 00 ; that it is corrected or remains the same in total valuation of $101 ,1+70 .00 . If reduced , you are entitled to an abatement refund on $33 , 220 . 00 valuation. " And WHEREAS , said Assessor thereupon , and on July 28th , 1953 notified the taxpayer of his findings and determination , and WHEREAS , it further appearing that said taxpayer being dissatisfied with the determination and ruling of the Assessor on July 28th , 1953 , filed with the Assessor , a Notice of Appeal to the Board of County Commissioners , and WHEREAS , said assessor forwarded to the Board of County Commissioners of Weld County , Colorado , said Notice of Appeal , his determination of the question of assessments and all other papers in evidence relating thereto , and IT FURTHER APPEARING , that said taxpayer waived notice of the time of hearing of said appeal before said Board , and on July 29 , 1953 , the Board of County Commissioners of Weld County , Colorado , sitting as a Board of Appeal , heard and considered said appeal by said taxpayer , the said County Assessor being present at said hearing , and 495 WHEREAS, at said hearing the Board proceeded to review the action of the Assessor and heard all evidence and facts relating to the said assessment of said property of the taxpayer , and considered , in particular , questions of allowance for functional loss and economis depreciation of the buildings of said taxpayer , and WHEREAS , it appearing to said Board and the Board Doth Find that said taxpayer has a bona fide and just claim.
