HomeMy WebLinkAbout961985.tiff_ .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. .. 3yy RESOLUTION RE: ASSESSMENT OF COSTS OF IMPROVEMENTS FOR WELD COUNTY DELWOOD AVENUE LOCAL IMPROVEMENT DISTRICT NO. 1995-2 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, in accordance with Section 30-20-607, Colorado Revised Statutes, as amended, a Statement of Expenses and Apportionment has been filed with the Weld County Clerk to the Board by the Weld County Engineer, which is attached hereto as Exhibit A, and WHEREAS, pursuant to Section 30-20-608, there has been proper notice of this hearing and of the costs of the improvements, and the share to be assessed to each lot, and WHEREAS, the Board of County Commissioners finds that the properties described herein, including those 17 lots adjoining Delwood Avenue between East 18th Street and U.S. Highway 34, as shown in the Plat of Lindale Subdivision, and the Replat of a part of Lindale Subdivision, as recorded under Reception Numbers 1201268 and 1722678, respectively, of the records of the Weld County Clerk and Recorder, and the rights-of-way for Delwood Avenue between East 18th Street and U.S. Highway 34, all in relation to the 6th P.M., in an unincorporated portion of Weld County, Colorado, in an area generally known as Lindale Subdivision, have been specifically benefitted by the construction of the improvements authorized under the Resolution of June 5, 1996, for the following reasons: 1) The market value of the property will increase. 2) The proposed improvements will adapt the property to a more profitable use. 3) The proposed improvements will facilitate access to the properties and thereby increase the convenience of use of said properties. 4) There will be an alleviation of fugitive dust, eliminating the health hazards to the benefitted properties and to users of the public roads to be improved. 5) The alleviation of fugitive dust will reduce maintenance costs to the subject properties and paving will lessen the maintenance required for a public road. 2521394 B-1578 P-390 11/20/96 02:08P PG 1 OF 7 RFC DOC Weld County CO JA Suki Teukamoto Clerk & Recorder 0.00 961985 SD0051 ASSESS COSTS - DELWOOD AVENUE LOCAL IMPROVEMENT DISTRICT NO. 1995-2 PAGE 2 WHEREAS, copies of the resolution creating this local improvement district have been provided to the Division of Local Government and the Weld County Treasurer and Assessor, and WHEREAS, at the time and place set forth in the notice, the Board of County Commissioners met in open session for the purpose of hearing and considering any objections and protests that might be made against the proposed assessments, and there being no protests, complaints, or objections, and WHEREAS, this resolution shall be prima facie evidence of the fact that the property assessed is benefitted, the amount of the assessment, and that the assessment has been lawfully levied. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado: A. That a local improvement district for the construction and installation of street improvements, to include shaping, grading, drainage, preparation of the base, compaction, and paving, together with any necessary incidentals on certain County roads as hereinafter described, is hereby created and established in accordance with the laws of the State of Colorado, and shall be known and designated as''Weld County Delwood Avenue Local Improvement District No. 1995-2." All proceedings heretofore taken by the Board of County Commissioners and the County staff and then ratified in connection with the district are hereby ratified, approved and confirmed. This proposal to create said district was initiated by the Board of County Commissioners by Resolution of March 13, 1996, upon a petition, proper in form, subscribed by a majority of the owners of property who will bear the cost of more than one-half of the total proposed assessment in the district and notice duly given as heretofore stated. B. That the property to be assessed for said improvements shall be the properties specifically benefitted by said improvements and more particularly described as follows: The area to be included within the district includes those 17 lots adjoining Delwood Avenue between East 18th Street and U.S. Highway 34, as shown in the Plat of Lindale Subdivision, and the Replat of a part of Lindale Subdivision, as recorded under Reception Numbers 1201268 and 1722678, respectively, of the records of the Weld County Clerk and Recorder, and the rights-of-way for Delwood Avenue between East 18th Street and U.S. Highway 34, all in relation to the 6th P.M., in an unincorporated portion of Weld County, Colorado, in an area generally known as Lindale Subdivision. 2521394 B-1578 P-390 11/20/96 02:08P PG 2 OF 7 961985 SD0051 ASSESS COSTS - DELWOOD AVENUE LOCAL IMPROVEMENT DISTRICT NO. 1995-2 PAGE 3 C. That the Statement of Expenses and Apportionment, attached hereto and incorporated herein by this reference as Exhibit A, has been submitted based upon the fact that there has been completion of the entire local improvement as previously authorized. D. That the assessment, as set forth in the attached Exhibit B, per lot or parcel being levied for the improvements shall be due and payable within thirty (30) days after the effective date of this assessing resolution. However, all such assessments may be paid at the election of the owner, in ten equal, annual installments of principal with installments of interest on unpaid installments at an interest rate of six and one- quarter percent (6.25%) simple interest per annum. The first of said installments of assessment shall be due and payable at the same time as ad valorem property taxes for the year 1996, due and payable in 1997, and similarly in each successive year thereafter until all are paid in full. E. That cost of the improvements assessed to property within the district is $19,149.48. F. That the Clerk to the Board shall prepare a local assessment roll, in cooperation with the Weld County Treasurer and Accounting Department, in a form showing in suitable columns, each parcel of land assessed, the total amount of assessment, the amount of each installment of principal and interest if, in pursuance of Part 6 of Article 20 of Title 30, Colorado Revised Statutes, the same is payable in installments, and the date when each installment will become due, with suitable columns for use in case of payment of the whole amount or of any installment or penalty, and shall deliver the same, duly certified, under the County seal, to the County Treasurer for collection. G. That failure to pay the whole assessment prior to December 15, 1996, shall be a conclusive determination and held to be an election on the part of all persons interested, whether under disability or otherwise, to pay in such installments. All persons so electing to pay in installments shall be conclusively held and considered as consenting to said improvements. Said election shall be conclusively held and considered as a waiver of any right to question the power or jurisdiction of the County to construct the improvements, the quality of the work, the regularity or sufficiency of the proceedings, the validity or correctness of the assessments, or the validity of the lien thereof. H. That failure to pay any installment, whether principal or interest, when due shall cause the whole of the unpaid principal to become due and collectible immediately, and the whole amount of the unpaid principal and accrued interest shall thereafter draw penalty interest at the rate of one percent per month from the first day of May until the day of payment, or until the day of sale. Official: The proposed Local Improvement District ("LID") will provide a means of financing the paving of roads in the subdivision for the benefit of the property owners using and adjoining those roads. The LID, if approved through the administrative process before the Board of County Commissioners. would allow the option to the property owners of financing their share of the costs over a ten year period. These improvements are not likely to he paid for by the County out of the Road and Bridge fund since the road serves local traffic within the subdivision. The paving of the roads would reduce the inconvenience of property owners in the subdivision using gravel roads and will facilitate travel over those roads and reduce vehicle maintenance costs. fhe properties would further he benefited by the alleviation of the fugitive dust from the roads which would kiwer maintenance for residents. The paving of roads to access the properties may increase their market value.
