RE: APPROVAL OF RECORDED EXEMPTION #1712 - ALM
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1712, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1712 was submitted by Raymond and
Victoria Alm, 22459 Weld County Road 70, Eaton, Colorado 80615, for property which is described
as Lot B of RE #1004, located in of Section 11, Township 6 North, Range 65 West of the 6th P.M.,
Weld County, Colorado, being more particularly described in the plat which shall be provided by
the applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to be approximately
151 acres and 3 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1712 submitted by
Raymond and Victoria Alm be, and hereby is, approved conditional upon the following:
1. A Weld County septic permit is required for any proposed home, and its septic
system shall be installed according to the Weld County Individual Sewage Disposal
System (ISDS) regulations.
2. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.
3. Only one access to Lot A from Weld County Road 45 shall be allowed. No new
accesses to Lot B shall be allowed.

Subject: RE -1712 Lot B of RE -1004 of Section 11, T6N, R65W of the 6th P.M., Weld County, CO.
Dear Commissioners:
This request for a recorded exemption is submitted by Raymond A. and Victoria M. Alm. The
parcel of land on which this request is being made is described as Lot B of RE -1004 of Section 11,
T6N, R65W of the 6th P.M., Weld County, Colorado. The property is located north of and adjacent
to Weld County Road 70 and east of and adjacent to Weld County Road 45.
This request is to divide a 154 acre parcel into two parcels of 151 acres and 3 acres, more or less.
North Weld County Water District is proposed to provide water service to both parcels with septic
being proposed for sewage disposal. Access is existing from Weld County Road 45 and Weld
County Road 70. The Weld County Health Department and Weld County Public Works
Department have reviewed this request and both have no conflict of interest.
Recorded Exemption 1004, approved by the Department of Planning Services' staff in 1987,
divided a 159 acres parcel into two parcels of 154 acres and 5 acres, more or less. This request
is to further divide the 154 acre parcel into 151 acres and 3 acres, more or less. A center pivot
irrigation system is existing on the 154 acre parcel. No residences currently exist on the property
at this time. The applicant has stated that the 3 acre parcel would be used for a residential building
site. The applicant currently has the right to build a home on the property as it exists. The division
of this parcel would create two buildable lots thus contributing to a sprawl row type development.
The Department of Planning Services' staff has concerns that the proposed division will be
inconsistent with the agricultural goals and policies as stated in the Weld County Comprehensive
Plan. Continued divisions of this type evade the intent and purpose of the Weld County Subdivision
Ordinance

The staff is concerned with the level of development that has occurred in this area and the potential
for continued divisions. Four recorded exemptions have been approved in this section since 1974.
The Board should consider whether it wants to allow this type of piecemeal development to
continue. The Department of Planning Services' staff requests that the Board of County
Commissioners consider this proposal and determine if the standards of Sections 11.5.1 through
11.5.7 of the Weld County Subdivision Ordinance have been met.
