Dear Todd:
The Use by Special Review and Site Specific Development Plan for
Robert and Donna Connell has been reviewed. The following comments
are provided:
RIGHT-OF-WAY Right-of-way (ROW) has not been addressed by the
submittal. Projected traffic along this portion of SH 14
indicates the need for a 150 foot total ROW, 75 feet each side of
the highway centerline. Additional width to meet this projected
need should be protected by reservation, or preferably dedication,
as permitted by County regulations. (The remarks duplicate our
request of October 10, 1994, regarding the Recorded Exemption.)
ACCESS As stated in our comments made October 10, 1994, concerning
the Connell's Recorded Exemption, at such time as the property
experiences a change of use as defined by Section 2.10.3 of the
State Highway Access Code, the Department would have a warrant to
re-evaluate access. The proposed use of the property for storage
and sale of farm implements would likely constitute a change of
use.
Our October 10, 1994, letter also stated that should a change of
use occur, we would request that access to the properties be
obtained by way of Weld County Road 37. Removal of the direct
accesses to SH 14 appears to be necessary, and requires the
issuance of a State Highway Access Permit from this office.
It appears that the surrounding property is under the same
ownership (050). The applicant should contact us about his access
needs.
DRAINAGE The submittal states that drainage is south to the SH 14
borrow ditch, that no increase of run-off is expected, and that no
construction activities are required. Be reminded that if
surfacing materials are required the surface run-off conditions
could be increased. No additional run-off will be accepted to the
ROW; therefore, on -site accommodations will be required.

UTILITIES Should this proposal require new utility lines or
connections within the state highway ROW, a utility permit will be
required. Prior to such utility work, Mr. Henry Rangel of the
Department should be contacted at (303) 350-2111.
Our comments are based upon the Recorded Exemption submittal received
September 28, 1994 and the Special Use submittal received March 6,
1995.

Environmental Protection Services has reviewed this proposal; the following
conditions are recommended to be part of any approval:

All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
No permanent disposal of wastes shall be permitted at this site.
ID. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, blowing debris, and other potential nuisance
conditions.
4. Fugitive dust shall be controlled on this site.
4. The maximum permissible noise level shall not exceed the residential limit
of 55 db(A) as measured according to 25-12-102, Colorado Revised Statutes.
Any existing septic system(s) which is not currently permitted through the
Weld County Health Department will require an I.S.D.S. Evaluation prior to
the issuance of the required septic permit(s). In the event the system(s)
is found to be inadequate, the system(s) must be brought into compliance
with current I.S.D.S. regulations.
7. Adequate toilet facilities shall be provided for patrons of the facility.
Any septic system serving patrons of this commercial facility must be
evaluated by a Colorado Registered Professional Engineer. The purpose of
the evaluation is to determine if the existing septic system has been
adequately sized to handle the proposed load.

The application from Robert and Donna Connell for a Use by Special Review and Site
Specific Development Plan for a farm implement business located in the A(Agricultural) zone
district west of Ault, Colorado has been reviewed by the Ault Planning Commission. The
Planning Commission's recommendation is as follows:
The request has been reviewed and the Planning Commission recommends that the
following contingencies be applied to this request:
1. This facility shall not become a junk or salvage yard.
2. This facility shall not become a storage yard.
3. Any unsightliness will be screened.
4. This operation shall not become an unsightly or unattractive area.
5. The eastern approach to Ault shall be kept in a manner that compliments the
Town.

concerns.

Dear Todd:
A site visit was made to the Connell property on March 27, 1995. As a
result of that site visit the Department recommends the following:
1. The existing access to SH 14 for the east

The application from Robert and Donna Connell for a Use by Special Review and Site
Specific Development Plan for a farm implement business located in the A(Agricultural) zone
district east of Ault, Colorado, has been again reviewed by the Ault Planning Commission.
The Planning Commission's amended recommendations are as follows:
The request has been reviewed and the Planning Commission recommends that due
to a desire by the Town of Ault that the eastern approach to Ault be kept in a
manner that compliments the Town and neighboring properties, the following
amended contingencies be applied to the original contingencies:
1. This facility shall not become a junk or salvage yard.
2. This facility shall not become a storage yard.
3. This operation shall not become an unsightly or unattractive area.
4. All equipment shall be set back a minimum of seventy-five(75) feet from the
center line of State Highway 14.
5. The Use by Special Review and Site Specific Development Plan for a farm
implement business shall not be transferable nor leased to a second party.
--6. Given that this property is within the comprehensive growth zone of Ault, we
propose that these contingencies be enforced jointly by the Town of Ault and
Weld County.
