HomeMy WebLinkAbout950145.tiffRESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND MINOR SUBDIVISION FINAL PLAT IN THE E (ESTATE ) ZONE DISTRICT - JERKE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 7th day of December, 1994, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of William H. and Charles W. Jerke, 23003 Weld County Road 39, LaSalle, Colorado 80645, for a Site Specific Development Plan and Minor Subdivision Final Plat in the E (Estate) Zone District on the following described real estate, to -wit: Part of the SE 1/4 NE 1/4 of Section 32, Township 5 North, Range 65, West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing on December 7, 1994, the Board deemed it advisable to continue said matter to December 28, 1994, at 10:00 a.m., to allow time for the ten-day notification requirements concerning a variance from the Weld County Subdivision Ordinance to be met, and to allow the applicant time to provide an agreement with the LaSalle Fire Protection District and revise the plat in accordance with said variance, and WHEREAS, at said hearing on December 28, 1994, the Board deemed it advisable to continue said matter to February 6, 1995, to allow completion of the Central Weld Water District water availability study and to determine how to provide fire protection service, and WHEREAS, at said hearing on February 6, 1995, at 1:30 p.m., William Jerke and Charles Jerke, applicants, were present, and WHEREAS, Section 4.5.16 of the Weld County Subdivision Ordinance provides standards for review of said Minor Subdivision Final Plat, and Section 14.1 of the Weld County Subdivision Ordinance provides standards for review of said Variance, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 950145 QLC? : P7 i 4Li JerKe PL0956 MINOR SUBDIVISION FINAL PLAT - JERKE PAGE 2 1. The submitted materials are in compliance with the application requirements of Section 4.4 of the Weld County Subdivision Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 4.5.16 of the Weld County Subdivision Ordinance including specifically: a. The proposed Minor Subdivision Final Plat is consistent with the Weld County Comprehensive Plan. b. The proposed Minor Subdivision will be located in an Urban Growth Boundary Area. The proposal is located within the Urban Growth Boundary Area of the City of Greeley, Town of Evans, and the Town of LaSalle. c. Definite provisions have been made for a public water supply for domestic uses that is sufficient in terms of quality, quantity, and dependability to the Minor Subdivision. An adequate water supply for fire protection is available from an irrigation well. Central Weld County Water District conditionally agrees to provide service to the proposed development. d. Provision has been made for Individual Septic Disposal Systems which will comply with the State and local laws and regulations in effect. Weld County Health Department has no conflicts with the request. e. No soil or topographical conditions have been identified that present hazards or require special precautions. f. Streets within the Minor Subdivision as proposed are adequate in functional classification, width, and structural capacity to meet the traffic requirements of the Minor Subdivision. g. Off -site streets providing access to the proposed Minor Subdivision are adequate in functional classification, width, and structural capacity to meet the traffic requirements of the minor subdivision. h. Construction, maintenance, snow removal, and other matters pertaining to or affecting the road and rights -of -way for the minor subdivision are the sole responsibility of the land owners within the minor subdivision. 950145 PL0956 MINOR SUBDIVISION FINAL PLAT - JERKE PAGE 3 The Minor Subdivision is not part of a Minor Subdivision previously approved by Weld County. j. That ingress and egress to all lots within the Minor Subdivision will be to the internal road circulation system. k. The facilities providing drainage and storm water management are adequate. Each lot proposed within the minor subdivision will be at least two and one-half (2 1/2) acres in size. m. The maximum number of lots proposed with the Minor Subdivision will not exceed six (6) lots. n. The Minor Subdivision will not cause an unreasonable burden on the ability of local governments or districts to provide police and fire protection, or other services. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of William H. and Charles W. Jerke for a Site Specific Development Plan and Minor Subdivision Final Plat in the E (Estate) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The following notes shall be placed on the Minor Subdivision plat prior to recording of the plat: a. The permitted uses within the Minor Subdivision consist of the E (Estate) uses as identified in the Weld County Zoning Ordinance and described in the application materials. b. All lots shall be maintained in compliance with the requirements of the LaSalle Fire Protection District. c. Typical road cross section shall be a minimum of two ten -foot drive lanes with a minimum of three-foot shoulders on each side with no less than four inches of gravel surface, adequate barrow ditches on both sides, and 20 -foot radii at the intersections. 950145 PL0956 MINOR SUBDIVISION FINAL PLAT - JERKE PAGE 4 d. Prior to the issuance of building permits within the Minor Subdivision for residential structures: A minimum of one speed limit sign shall be posted on Scotch Pine Drive. The sign shall be posted for traffic entering the subdivision, no more than 200 feet from the intersection with the county road. The sign shall limit the speed to no more than 25 miles per hour. ii. Stop sign shall be placed at the access point to control traffic prior to entering upon Weld County Road 50.5. iii. A soils and foundation investigation report prepared by a qualified soils and foundation engineer shall be submitted with each building permit application. e. Central Weld County Water District shall provide water to the proposed subdivision. f. Sewer service shall be provided by individual septic disposal systems approved by the Weld County Health Department. 9. The Subdivision shall be served by a water -delivery system for fire protection installed within the subdivision. Manual or remote turn -on capabilities shall be installed at the stand pipe or at the well site. h. Lots 1, 5, and 6 shall not access directly onto Weld County Road 50.5 and Weld County Road 41. All lots shall use only Scotch Pine Court for access. No other access shall be allowed. 2. Prior to recording the final plat, the location of the water -delivery system for fire protection, according to the Agreement between the LaSalle Fire Protection District and the applicants, shall be shown on the plat. 3. Prior to recording the final plat, an improvements agreement shall be approved by the Board of County Commissioners for all on -site improvements. The on -site improvements shall include, but are not limited to, road improvements, water line improvements, installation of a water -delivery system for fire protection, irrigation ditches, street name signs, traffic control signs, gas lines, electric service, and "T" post and wire fence. 950145 PL0956 MINOR SUBDIVISION FINAL PLAT - JERKE PAGE 5 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 6th day of February, A.D., 1995.
