The Commission found that the proposal, as presented, complies with the Greeley Comprehensive Plan but does not comply with the City of Greeley, Weld County, and Town of Windsor Cache la Poudre River Trail Master Plan. Therefore, the Commission recommended approval, conditional upon the following: 1. The applicant should work with the Poudre River Trail Corridor Board to designate a trail alignment. The agreed-upon Poudre Trail alignment should be depicted on the Site Extraction Plan and the Reclamation Plan. For your reference, I have included a copy of the staff report for this item. Sincerely, Came McCool EXHIBIT Planner I 961657 PLANNING COMMISSION SUMMARY ITEM: Weld County Referral for an Amendment to an Existing Use by Special Review PROJECT: Western Mobile Wet Sand and Gravel Mining Operation LOCATION: West of and Adjacent to 35th Avenue; Approximately '4 Mile North of F Street APPLICANT: Western Mobile Northern PLANNING COMMISSION HEARING DATE: July 23, 1996 PLANNING COMMISSION FUNCTION: Review the proposal and make a recommendation to the Weld County Planning Commission on conformance with the City of Greeley's Comprehensive Plan and the City of Greeley, Weld County, and Town of Windsor Cache la Poudre River Trail Master Plan. PROJECT OVERVIEW AND BACKGROUND: Western Mobile Northern was granted approval for wet sand and gravel extraction, processing, and associated uses in 1974 for this site. An amendment to the existing operation was approved in 1987 to allow for modification to the gravel extraction schedule and to add hot mix asphalt production as an approved use. The intention of this amendment request is to change the proposed location of facilities to the southeastern section of the site and modify the extraction schedule. The proposal is to mine the 359-acre site in 11 phases; each phase is estimated to take one year to complete. Additionally, the applicant is also adding a rail car off-loading facility with rail siding at the southern portion of the property. Although the noise and visual impacts of the sand and gravel mining operation should be no greater than what already exists, the staff is concerned that the proposed rail facilities could conflict with the designated Poudre Trail alignment currently proposed to run along the southern boundary of the property. The Western Mobile Northern wet sand and gravel mining operation is located within the three-mile area of influence of the City of Greeley. The site is located outside the Mid-Range Expected Service Area (MRESA) but within the Long-Range Expected Growth Area (LREGA). Since the property is located within the City's urban growth 961657 area referral boundary, the proposal is within the purview of the Greeley Comprehensive Plan. It is the practice of the City of Greeley Planning Commission to review Weld County requests principally for conformance with the City's Comprehensive Plan policies. Specific design issues are addressed also to the degree necessary to ensure consistency with the City's Comprehensive Plan and Zoning Code in the event the proposal is within the City's Long-Range Expected Growth Area. Summary 2 961657 KEY ISSUES: 1. Does the proposal comply with the City of Greeley Comprehensive Plan? 2. Does the proposal comply with the City of Greeley, Weld County, and Town of Windsor Cache la Poudre River Trail Master Plan? ANALYSIS: 1. The City's Comprehensive Plan of 1986 addresses sand and gravel mining operations in both general and specific sections. Since gravel mining is most similar to an industrial use, the proposed gravel mining operation will be considered industrial in nature. Within the City limits, a gravel mine would need to be located in the CD (Conservation District) zone. The applicable Greeley Comprehensive Plan policies are as follows: Comprehensive Plan Policies 3.2 and 3.3 Industrial development is encouraged to be located so that negative external influences generated by the industrial use do not affect either the existing or potential nonindustrial land uses located within the Long-Range Expected Growth Area. Comprehensive Plan Policy 3.3 Industrial development is encouraged to be geographically separated from existing or anticipated commercial and residential land uses if it is of high-impact agricultural or industrial nature that generates significant negative external impact. The following staff comment addresses both Policies 3.2 and 3.3: Staff Comment: The applicant notes that there are numerous sand and gravel operations in the surrounding area. The site is bordered to the north, south, and east by mining operations. Staff concurs that the existing mining and processing uses are compatible with surrounding land uses. A large portion of the employees at this site are truck drivers and asphalt personnel. The majority of product- Planning Comm. Summary 3 961657 hauling truck trips would be south on 35th Avenue into the City. The truck hauling patterns will not be altered with this amendment, thereby having no greater impact on the City's road service network than what currently exists. Comprehensive Plan Policy 4.3 All development is encouraged to be designed to promote compatibility among neighboring land uses of differing intensity and character. These efforts, where practical and appropriate, should include complementary landscaping, building massing, material selection, and site design. Staff Comment: The land uses in the surrounding area consist of a mixture of smaller residential and commercial uses and large extractive and production operations. Directly to the south of the site is an existing gravel mining operation. The proposed landscaping and site design of the subject site promotes compatibility among neighboring land uses and significantly reduces potential negative impacts along 35th Avenue by changing the location of the proposed plant facilities towards the southeastern portion of the site. Comprehensive Plan Policy 4.11 All development is encouraged to develop in a manner that will not preclude future extraction of economically recoverable gravel when occurring in designated gravel resource areas. When sand and gravel operations are permitted, the site should be reclaimed in a manner that enhances both the natural environment and anticipated future land uses. Staff Comment: The proposed mineral extraction will fulfill the policy for removal of economically recoverable gravel. The applicant has noted that the land will be reclaimed for wildlife and nature area. Staff notes that the site has potential for recreational uses as well. The site is adjacent to the Cache la Poudre River. The Cache la Poudre River Trail Master Plan proposes a segment of the Poudre Trail to travel exclusively down the southern boundary of the site along the Colorado and Southern Railroad. Staff notes that the future rail unloading facility depicted on the Plan encroaches into the proposed Poudre Trail alignment. Planning Comm. Summary 4 961657 The staff notes that there are other trail alignment possibilities that are desirable and encourages the applicant to work with the Poudre River Trail Corridor Board to designate a trail alignment which would enhance the site while corresponding to the extraction schedule of the applicant. The agreed-upon Poudre Trail alignment should be depicted on the Site Extraction Plan and on the Reclamation Plan. The staff concurs that with responsible enforcement of existing environmental statutes for emission, noise, and site reclamation, extractive uses are compatible with the adjacent land uses. Additionally, the end use of this site has been represented for wildlife and nature area uses, and this is an appropriate neighbor for the proposed land uses in the City nearby. The staff also notes that with sensitive reclamation practices there is an excellent opportunity for creating additional riparian and vegetation areas that will result in increased wildlife habitat and also enhance the educational and recreational potential of the Poudre Trail corridor. ADMINISTRATIVE REVIEW TEAM COMMENTS: The Administrative Review Team (ART) reviewed this proposal at its July 3, 1996, meeting. The ART summary and record of comments are included as Attachment D. PLANNING STAFF RECOMMENDATION: The Planning staff is recommending that the Planning Commission find that the amendment request to the existing Use by Special Review for the wet sand and gravel mining operation is in conformance with the City of Greeley's Comprehensive Plan. The staff also notes that the proposed Site Extraction Plan and Reclamation Plan do not depict/designate an alignment for the Cache la Poudre River Trail Master Plan. The Planning staff further recommends that the Planning Commission find that the proposal complies with the Greeley Comprehensive Plan and recommend approval, conditional upon the development of a designed Poudre Trail alignment to be depicted on the Site Extraction Plan as well as the Reclamation Plan. The applicant shall submit any necessary air permit modifications or Air Pollution Emissions Notices to the Air Pollution Control Division, Colorado Department of Public Health and Environment. Also there has to be associated tank batteries and other production equipment in the mined area. The Fire Department requires that a 20 foot access road be constructed as all weather surfaces and maintained during all phases of the project and during all seasons to all wells and well facilities. Additionally,the siting of mining and associated equipment shall be kept at least 150 feet from the oil wells and related production equipment and tanks. We do not want potential sources of ignition in the vicinity of this equipment. The diking around the tanks shall be evaluated by the owner of the well and a report forwarded to the Fire Department regarding the size of the dike, its containment capability,and the ongoing maintenance program of said diking. The main concern is to be sure that we do not have an incident that would result in the contamination of the water in the proposed mining areas. The applicant shall provide the Fire Department with a site plan of the access roads to the well heads in the mining area and also the roadways to the production facilities and tanks. Additionally, the applicant shall show on his extraction plan map the locations of all roads, well heads, production facilities. An additional concern is that the location of all transmission and collection lines for the oil and gas operation are not included in the packet. These lines shall be indicated on the extraction plan map for the development. We do not want these lines damaged or cut during mining operations. Any relocation of lines shall be inspected and tested by the Fire Department to ensure that they have been properly tested and installed. Sufficient area around facilities are necessary for any oil servicing equipment, as well as for emergency access requirements.
