RESOLUTION
RE: APPROVE MINOR RESUBDIVISION, S #382 - COOK, LOFGREN, GARZA, AND
EWEGEN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 24th day of
July, 1995, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing the
application of Julia Cook, 32470 Weld County Road 63, Gill, Colorado 80624; Laura and Loretta
Lofgren, 29376 Weld County Road 64, Gill, Colorado 80624; Porfirio and Guadalupe Garza, 33501
Weld County Road 392, Gill, Colorado 80624; and Judith Ewegen, 37615 Weld County Road 39,
Eaton, Colorado 80615, for a Minor Resubdivision, S #382, to vacate the portion of Russell
Avenue on the north side of Lots 1 through 8, Block 36, and Lots 25 through 31, Block 48, Town
of Barnesville, Colorado, and a portion of Sanford Street between Lot 1, Block 36, and Lots 24 and
25, Block 48, Town of Barnesville, Colorado, and
WHEREAS, Loretta Lofgren, applicant, was present, and
WHEREAS, Section 8.2.5 of the Weld County Subdivision Ordinance provides standards
for review of said Minor Resubdivision, and
WHEREAS, the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented in this matter and, having
been fully informed, finds that this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 8.2.5 of the Weld County Subdivision Ordinance.
2. The right-of-way has not been used for its intended purpose since the recording of
the approved plat.
3. Seventy (70) percent of the landowners adjacent to the proposed right-of-way
vacation have waived any objection to the vacation by signing a petition.
4. The vacation would be compatible with the surrounding area and uses, be
consistent with efficient and orderly development, is consistent with the Weld
County Comprehensive Plan, and would not deprive any parcel of adequate access
to a public road or street right-of-way.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of Julia Cook, Laura and Loretta Lofgren, Porfirio and
Guadalupe Garza, and Judith Ewegen for a Minor Resubdivision on the hereinabove described
parcel of land be, and hereby is, granted subject to the following conditions:
1. Prior to recording the Minor Resubdivision map, the powerline easement located in
the Sanford Street right-of-way shall be clearly delineated on the map.
2. The applicant shall submit the amended Minor Resubdivision map to the
Department of Planning Services to be recorded in the Office of the Weld County
Clerk and Recorder. The map shall be prepared in accordance with the
requirements of Section 8.2.5.6 of the Weld County Subdivision Ordinance. The
applicant shall be responsible for paying the recording fees.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 24th day of July, A.D., 1995.

The attached application and submitted materials are concerning a request made by Julia
Cook/Laura & Loretta Lofgren/Porfirio & Guadalupe Garza and Judith Ewegen. The request is
to vacate the portion of Russel Avenue on the north side of Lots 1-8, Block 36 and Lots 25-31,
Block 48 Town of Barnsville and a portion of Sanford Street between Lot 1, Block 36 and Lots
24 and 25, Block 48 Town of Barnsville. The property is located north and adjacent to Madell
Avenue and south and adjacent to Weld County Road 293 right-of-way.
Based upon the submitted application materials and other relevant information regarding this
request, the Department of Planning Service's staff recommends conditional approval of this
request.
This determination was based on the following:
- The submitted materials are in compliance with Section 8.2.5 of the Weld County
Subdivision Ordinance.
- The right-of-way has not been used for its intended purpose since the recording of the
approved plat.

Conditions of Approval:

Stanford Street Right -of -Way shall be clearly delineated on the map.
2. The applicant shall submit the amended Minor Resubdivision map to the Department of
Planning Services to be recorded in the Office of the Weld County Clerk and Recorder.
The map shall be prepared in accordance with the requirements of Section 8.2.5.6 of the
Weld County Subdivision Ordinance. The applicant shall be responsible for paying the
recording fees.

I visited the site and talked with some of the applicants to verify the location of the vacation. All
of the areas in question on Russel Avenue and Sanford Street have previously been fenced and
incorportated into the existing lots. All of these lots border the right-of-way fence on 392. All
the lots in the petition have direct access to the County road directly south of 392.
The Weld County Public Works Department has no conflict with vacating the proposed streets
within the resubdivision.
