Dear Mr. Hall:
We have received clarification from the US Department of Labor regarding the Wagner-Peyser merit
system staffing issue and the steps which must be taken to ensure compliance with this requirement
and retention of the State's Wagner-Peyser funding. The crux of the matter rests upon whether
employees are hired and retained on the basis of merit, and merit-based due process is followed in
all personnel actions. Although these principles are incorporated in your current One-Stop contract,
USDOL has instructed the Department to make the due process requirement more explicit, and to
obtain the assurance that each region will comply with the requirement as a condition of continued
Wagner-Peyser funding.
Effective July 1, 2000,all One-Stop contracts will contain the following clause in addition to already
existing language regarding merit system staffing:
The contractor assures that any personnel action taken in the case of any county employee
funded in whole or part with Wagner-Peyser funds, including discipline or dismissal, shall
be based solely on performance or misconduct pursuant to the merit staffing requirements
outlined in the agreement between the Department of Labor and Employment and the
contractor. All such employees shall be provided with a meaningful review process
including an opportunity for a hearing before an appropriate county agency' in which to
contest the action and a subsequent opportunity to appeal an adverse decision.
To ensure compliance for the remainder of the current fiscal year contracts, we have the choice of
either amending the existing contracts or obtaining written assurance from each region that due
process will be followed in all personnel matters involving county staff funded in whole, or in part,
by Wagner-Peyser funds.
Please respond, in writing, by October 15, 1999, as to whether you want your current contract
amended to include the above provision, or whether you will provide a separate written assurance
that you will comply with USDOL's merit system principles.

If your region elects to provide a separate written assurance, please include the provision in its
entirety as part of the assurance, and submit it to the Department by November 1, 1999. The
assurance should be signed by your chief elected official.
