Box758 GREELEY,COLORADO 80632 COLORADO August 20, 1996 Secretary of State 1560 Broadway Denver, CO 80202 Board of County Commissioners 915 Tenth Street Greeley, CO 80631 Weld County Council 915 Tenth Street Greeley, CO 80631 Dear Secretary of State, Board, and Council: Pursuant to § 24-18-109(3)(b) and § 24-18-110, C.R.S., this letter constitutes disclosure of a relationship which may have the appearance of a conflict of interest in my official duty as a member of the Board of County Commissioners of Weld County, Colorado. I am currently the appointee of the Weld County Board of County Commissioners on the Board of Directors for the Weld County Community Center Foundation, D/B/A Centennial Developmental Services, Inc. ("CDSI"). CDSI is the "Community Centered Board" in Weld County, as that term is defined in Section 27-10.5-102 (3), C.R.S. The corporation is authorized to provide case management services to persons with developmental disabilities in Weld County. It is funded from various public and private sources. A total of$41,105 was appropriated by the Board of County Commissioners to the CDSI 1996 budget. The CDSI Bylaws call for the membership of the CDSI Board of Directors to include "individuals with substantial management or policy making responsibilities" in government. The Board of County Commissioners' practice has been to appoint one of its members to the CDSI Board at the beginning of each calendar year. One of the current CDSI Directors has raised the question of whether my positions on both the Board of County Commissioners and the CDSI Board of Directors present a conflict of interest. fki4:111-111 OP/C 961421 Conflict of Interest Letter August 20, 1996 Page 2. Specifically, the allegation seems to be that my decision-making role as a Commissioner with respect to Weld County's budget (and the amount of the budget contributed to CDSI on an annual basis) is in conflict with my role as a CDSI Director. The Director who has raised the issue believes that I must excuse myself from participating in CDSI Board decisions as a result of this perceived conflict, in an effort to somehow comply with the requirements of Sections 14- 18-105 and 24-18-109(3)(a), C.R.S. I have discussed this allegation with Bruce T. Barker, Weld County Attorney. He and I concur that the perceived conflict of interest does not exist. I therefore intend to participate in all decisions before the CDSI Board, unless I have a personal or private interest in a decision which would prohibit such participation.
