AR2472414 RESOLUTION RE: DENY REQUEST TO RECONSIDER CONDITION OF APPROVAL #4 FOR RECORDED EXEMPTION #1815 - CONWAY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated December 18, 1995, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), CRS, as amended, did conditionally approve Recorded Exemption#1815 submitted by John and Alice Conway, 2043 Road 37, Brighton, Colorado 80601, for property which is located in part of the SE' of Section 24, Township 1 North, Range 66 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, John Conway, applicant, and John Conway, Ill, were present at said meeting on December 18, 1995, and consented to said Condition of Approval #4 which reads as follows: 4. Prior to recording the plat, the applicant shall show on the plat a common access easement across Lot B for the use and benefit of both Lot A and Lot B. Said common access easement shall be dedicated on the plat for the use as shown utilizing the language set forth in Section 11.7.1.12.5 of the Weld County Subdivision Ordinance. WHEREAS, on January 10, 1996, the Board considered a request from Jasper Freese of Freese Engineering, applicants° representative, to reconsider Condition of Approval #4 for said RE#1815, and WHEREAS, said applicants were not present or represented at said meeting on January 10, 1996, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicants and the recommendations of the Weld County Planning and Public Works staff and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be denied. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request to reconsider Condition of Approval #4 for RE #1815 granted to John and Alice Conway by Resolution dated December 18, 1995, be, and hereby is, denied.
