IN THE MATTER OF THE REPEAL AND RE-ENACTMENT OF CERTAIN PORTIONS OF
ORDINANCE NO. 147, WELD COUNTY COMPREHENSIVE PLAN ORDINANCE
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF
WELD, STATE OF COLORADO:
WHEREAS, the Board of County Commissioners of the County of Weld, State of
Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with
the authority of administering the affairs of Weld County, Colorado, and
WHERES, the Board of and authority, under
the Weld County
Home Rule Charter and d Article 28 of Title 30 y Commissioners has the power
CRS, to adopt planning goals
and policies for the unincorporated areas of the County of Weld, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, has
previously adopted Ordinance No. 147, Weld County Comprehensive Plan, establishing a
comprehensive revision of the planning goals and policies for the unincorporated areas of the
County of Weld and has adopted amendments in Ordinance No. 147-A through No. 147-J, and
WHEREAS, the Weld County Planning Commission has recommended revisions to the
Comprehensive Plan, and
WHEREAS, extensive reference materials, specifically publications from the Colorado
Division of Wildlife, Colorado's Little Fish, published June, 1985, and House Bill 1041 Significant
Wildlife Habitats Maps, July 1996, were submitted to be part of the record in this matter, and
WHEREAS, the Board of County Commissioners of Weld County hereby finds and
determines that there is a need for revision to certain portions of the Comprehensive Plan for
the County of Weld, and that this Ordinance is for the benefit of the health, safety, and welfare
of the people of Weld County.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the
County of Weld, State of Colorado, that the Weld County Comprehensive Plan be, and hereby
is, amended as follows:
1. The "Potential for Impact to Wildlife Habitat Map" found on Page 1 of the
Colorado Division of Wildlife's, House Bill 1041, Significant Wildlife Habitat Maps,
Weld County, Colorado, July 1996, replaces Important Wildlife Habitat Areas,
Map 5" of the Weld County Comprehensive Plan for the following reasons:
A. The existing wildlife habitat map is in need of revision as proposed. The
proposed map was produced in 1996 by the Colorado Division of Wildlife.
The new map, when used in conjunction with the reference materials
submitted for the record, will provide the user with improved graphics and
more detailed information regarding sensitive wildlife areas in Weld
County.

B. The proposed amendment will be consistent with existing and future
goals, policies, and needs of the County.
BE IT FURTHER ORDAINED by the Board, if any section, subsection, paragraph,
sentence, clause, or phrase of this Ordinance is for any reason held or decided to be
unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The
Board of County Commissioners hereby declares that it would have enacted this Ordinance in
each and every section, subsection, paragraph, sentence, clause, and phrase thereof
irrespective of the fact that any one or more sections, subsections, paragraphs, sentences,
clauses, or phrases might be declared to be unconstitutional or invalid.
The above and foregoing Ordinance Number 147-K was, on motion duly made and
seconded, adopted by the following vote on the 14th day of April, A.D., 1997.
