'7'7/ RESOLUTION RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION #2168 - JOHN AND BARBARA WAGNER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the request for Recorded Exemption #2168 was submitted by John and Barbara Wagner, 14510 Weld County Road 6, Fort Lupton, Colorado 80621, for property which is located in Lot 2 of RE #1314, being part of the S 1/2 NW 1/4 of Section 28, Township 1 North, Range 66 West of the 6th P.M., Weld County, Colorado, and WHEREAS, this request is to divide the property into two parcels estimated to be approximately 50 acres and 7.4 acres, and WHEREAS, after reviewing the Planning staff's concerns and hearing the testimony presented, the Board determined that said request shall be denied for the following reasons: 1. It is the opinion of the Board of County Commissioners that this proposal evades the purpose of the Weld County Subdivision Ordinance as defined in Section 1.3. 2. The Board feels this division would be inconsistent with efficient and orderly development. 3. The Board feels this proposal is not consistent with the Weld County Comprehensive Plan. 4. It is the opinion of the Board that any further division of these lots will create additional accesses onto Weld County Road 6. The parcel HAS already been divided as follows: • 6/21/82- RE-549 was approved by the Board of County Commissioners, dividing the 80 acre parcel described as S1/2 NW1/4 into 12 acre Lot A & 66.219 acre Lot B. • 3/20/91 - RE-1314 was approved by the Board of County Commissioners, dividing Lot B of previous RE-549 into 8.778 acre Lot 1 (Lot A) and 57.402 acre Lot 2 (Lot B) • Present- RE-2168 is requesting that Lot 2 (Lot B) of previous RE-1314 be further divided into Lot A (7.4 acres) and Lot B (50 acres) The granting of another recorded exemption would result in yet another residential lot in the agricultural zone district. Section 10.5.10 of the Weld County Subdivision Ordinance states, "A flag lot configuration shall be avoided when possible.""island lots"which depend upon access across adjacent property CREATE PROBLEMS WHICH The applicant has already experienced due to conflicts with the other property owner. Because of these conflicts, the applicant is working with another property to utilize different access. THE APPLICANT PROPOSES TO INSTALL A NEW ACCESS ADJACENT TO THE CURRENT ACCESS. The creation of another lot utilizing a similar access easement agreement increases traffic and potential for new conflicts. The applicant has failed to comply with the A (Agricultural) zone district intent. The A (Agricultural) zone district was established to "maintain and promote agriculture as an essential feature of Weld County," and not to be continually decreased for residential development. The parcel is classified as Prime - Farmlands of National Importance by the USDA. • A.Goal 7 of the Weld County Comprehensive Plan strives to "Protect agricultural land from encroachment by those urban uses which hinder the operational efficiency and productivity of the agricultural uses." The creation of additional residential lots without utilizing the appropriate subdivision process adds potential for conflicts between agricultural activities and the newly created residential lots. Based upon submitted information, referral agencies, and the governing mechanism of the County, the Department of Planning Services' staff has determined that the applicant has not provided sufficient justification for the recorded exemption and recommends this request be denied. The applicant is requesting to divide a parcel which has already been involved in two recorded exemption applications (RE-549 and RE-1314). This application, if approved, would contribute additional residential lots to the Agricultural zone district without utilizing an appropriate subdivision process. The Department of Planning Services' staff considers the continued division of land utilizing the recorded exemption process to be an evasion of the Weld County Subdivision Ordinance. Staff has the following concerns: 1. The applicant has not demonstrated that this application is consistent with efficient and orderly development in accordance with Section 1.3 of the Subdivision Ordinance. This is the 3rd request for a recorded exemption in the 80 acre S1/2 NW1/4 of Section 28. Staff does not consider the creation of another flag lot to be efficient or orderly development. I asked Mr. Mackety(realtor)to adjust the acreages to a more favorable split. He insisted that two siblings of the seller would be purchasing to farm each parcel. Subsequently, two unrelated persons called me to inform me that each has a contract on the 46-34 acre parcels. Mr. Mackety then changed his application to a 75-5 acre split,which staff conditionally approved. Mr. Mackety now wants a letter of denial from staff which will satisfy his contingency in the contracts for the 46/34 acre parcels. I explained that staff had not officially denied and that we would have recommended denial had it gone to BOCC. Do I need to send anything that we do not normally send, or does Mr. Mackety simply need to have his attorney study his contracts? 2)An RE that I am currently processing is located near(2 miles south) the Town of Berthouds future wastewater digester site. The Towns referral requests that we place a note on the plat noting this use and potential odor. I would support the note for future property owners- but is this fair to the current owners? 3)Another RE that I have is a lot of a previous RE. Lot B of the previous RE utilizes a recorded access"agreement for road maintenance"across Lot A. The agreement states"said road is approx 30'wide and serves as access for ingress and egress for the following properties and owners"and goes on to describe Lots A& B and owners. The proposed RE is located on Lot B and proposes to utilize this access. The owners don't get along and Lot A does not want to allow additional users. I feel this agreement specifies two owners and additional users would require a new agreement prior to processing the RE. Agree? (I am faxing a copy of this agreement.) finally... 4)An individual has questions about a legal in St Louis Colony(adjacent to Evans). The property address is 2675 W 49th St. A court order created a legal which describes parts of Lots 1, 5 and 6. Two years later, a deed conveyed the property, leaving out the portion of Lot 5, otherwise the legal was exactly the same as that created by the court. The legal has been unchanged since. Staff is unsure as to the legality of lot since it did not convey the parcel as described by the court. I am faxing you a copy of the court document and subsequent deed. There is an area of Vona loamy sand that is not considered prime farmland located to the southwest of the proposed home site . If it does not adversely impact the existing farming operation, we recommend that a building envelope be formed to restrict construction to only non-prime farmland.
