(1) How is this proposal consistent with the Weld County Comprehensive Plan?
We believe this proposal will benefit Weld County Comprehensive Plan by (1)
caring for some of the abused, neglected and abandoned children of the county, (2) ease
some of the burden of the welfare system of the county, and (3) add to the beauty of the
countryside by constructing a substantial and compatible-to-the-environment set of
buildings.
The construction of these buildings will in no way interfere with the present usage
of surrounding land.
This land was donated by a Weld County citizen to be used to benefit Weld
County.
(2) How does this proposal meet the intent of the zone district it is located in?
No conflict.
(3) How is this use compatible with future development as stated in the Weld
County Comprehensive Plan? If yes, how?
This plan is for use in a very low density area.
(4) What type of uses surround this site? Is this request compatible with the
surrounding area?
The surrounding area is farm land or government land. This use would be very
compatible with the surrounding land as the children's home will be built as a ranch. Part
of the land will be used for gardens and there will be some livestock.
(5) Is this property located within a Flood Hazard zone, Geologic Hazard zone or
Airport Overlay zone--and does it meet these special requirements?
There is no Geologic Hazard zone or Airport Overlay zone however there is a
Flood Hazard zone. We have received the flood zone map from Shani and find that none
of our building will take place in the flood zone. There is a beautiful hill and sloping area
where the homes will be built and the flood zone area will nicely hold gardens and
pastures.
(6) What efforts have been made to conserve productive agricultural land?
The 80 acres we will use for construction is marginal dry farm land. The area used
for garden, animals, and pasture is now pasture.

(7) How will public health, safety and welfare be protected?
Sanitary disposal of any and all waste will be carried out according to county code.
Since our goal is to care for children all measures will be taken for all safety standards.
(8) What will the site be used for?
The site will be used for the construction of eight homes for children. The plan is
to take no children under the age of two and none over the age of eight. We do not want
this to be a short term home for kids, but a permanent home where they will grow up in a
home atmosphere and be part of a community. There will be some out building
constructed such as chicken coops, small barn, and a corral. There will be gardens and
possibly a green house.
(9) How close is this site to other residential structures?
5/8 of a mile is the closes house.
(10) How many people will be employed at this site and how many hours will they
work?
We anticipate at completion to employ 29 and the hours will vary. We also
anticipate many volunteer workers.
(11) How many people will use this site?
125 at completion, 96 children and 29 full time staff.
(12) What type and how many animals will there be on this site?
There will be a small number of horses, cows, some chickens, possibly sheep and
without a doubt at least one dog and cat.
(13) What type and how much, if any, operating and processing equipment will
be utilized on site?
Normal household and small farm equipment.
(14) What type and how many structures will be erected on this site?
Eight homes, one multi-purpose building and associated out-buildings.
(15) What kind (type, size,weight) vehicles will access this site andhow often?
Cars, vans, small farm and garden vehicles.

(16) Will this site use a septic system or public sewer facilities?
Septic system. There is no public system available
(17) Are you proposing storage or stockpile of wastes on this site? If so, what is
the size and type proposed?
None
(18) How often will debris, junk, or waste be disposed of? By what means?
Regular pick-up by the local waste disposal company, Gray Bros.
(19) How long will it take to construct this site and when will construction begin?
Phase I: start as soon as process allows one or two houses.
Phase II: three to five buildings and the central building
Phase III: remainder of homes and out-buildings
(20) Explain the proposed landscaping plans and erosion control measures
associated with this site.
As soon as possible we will begin a tree planting program working with the Forest
Service. We anticipate putting in lawns and flowers, gardens and pasture. When we
signed our 99 year lease with Preston Ranch Ministries one of the stipulations was that we
would not allow any areas that could blow so as to protect their surrounding farm land.
(21) Explain any proposed reclamation procedures when termination of the
Special Review use begins.
(22) Explain the need for the proposed use (activity) in Weld County.
The need for permanent homes for children has increased at an alarming rate not
only in our county but in the surrounding counties. The availability of foster home care is
declining and the need for shelter, short term and long term is increasing. I can give you
an example of the pressing need in Weld county. When we went to see the head of Social
Services we were told we could set an appointment and come back on that day. When the
receptionist asked our reason for an appointment and we explained our plan, we were
given a hearing within minutes. We were met with a very positive reaction by Social
Services.
(23) Who will provide fire protection for this site?
Roggen Fire Protection District which is approximately five miles away.

(24) What or who will provide water to this site?
We will drill wells. We proposed drilling two to three wells, but a man from a
neighboring water district advised drilling one 50 gallon per minute well. We will do
whatever works best.
(25) How will storm drainage be handled on the site?
There is natural drainage into Long Draw. Culverts and ditching will be put in as
required.

LANDOWNERSHIP STATEMENT INSTRUCTIONS
The landownership statement must be submitted with the well permit application in all
cases where the well permit applicant believes or claims that water to be withdrawn is
nontributary ground water or any ground water from the Dawson, Denver,Arapahoe, Laraime-Fox
Hills or Dakota aquifers. The statement must be signed by the landowner(s).
The legal description and the number of acres of overlying land must be indicated. In
areas of the state that are not surveyed, the State Engineer will accept an alternate description
of the location of the overlying land sufficient to identify and locate the land. For legal
descriptions of irregularly shaped parcels (where the boundaries do not follow or parallel section
lines) or where there are exclusions of land within the total parcel, the applicant must submit a
map having a scale of 1:24,000 or larger (e.g., 1:10,000) which accurately depicts the overlying - -
land.
If the legal description is too lengthy for the space provided on the statement, please
indicate "See attached legal description" in the space provided on the statement and attach the
complete legal description. The legal descriptions and maps provided must be complete and
legible.
The aquifer from which ground water is to be withdrawn must be indicated on the space
provided. Where applications for more than one aquifer are submitted at one time, the applicant

SUBJECT: Payment of Costs for Children in Residential Child Care Facilities and
Other Education Funding Issues
This memorandum responds to three questions you raised. You asked about the
school district responsible for paying public education costs for children in residential
child care facilities, and for information relating to the revenue streams for school
district funding and the process for raising local property taxes. These issues are
addressed in the following paragraphs.
Payment of Costs for Children in Residential Child Care Facilities

I. Per pupil operating revenue (PPOR) is a statutorily defined term. It is an amount equal to a
district's school finance funding per pupil less S202.

Sources of Revenue for School District Funding
In FY 1993-94, the most recent year for which data is available, 35.9 percent
of school district revenue statewide came from property taxes, 39.0 percent from state
aid, and 5.0 percent from the federal government. The remaining 20.1 percent came
from a variety of other local sources, including specific ownership taxes, tuition,
textbook, and transportation fees, interest earnings on investments, and charges for
meals and pupil activities. Individual district sources of revenue may differ
significantly from the statewide average. example,/districts with a relatively low
assessed value per pupil may Deceive* hi percentage of state aid and vice versa.
In addition, the property tax percentage includes property taxes raised to make principal
and interest payments for bonded indebtedness, and the amount of bonded indebtedness
varies by district. The percentage breakdown of revenue can also be provided for any
individual districts in which you are interested.
Process for Raising Local Property Taxes
A mill levy increase to generate additional property taxes for a school district
must be approved by the district electorate. Such an election may be initiated by the
school board or by a petition signed by at least five percent of the eligible electors in
the district at the time the petition is filed. The state constitution requires such
elections to be held during a state general election, a biennial school district election,
or on the first Tuesday in November of odd-numbered years. (Regular biennial school
district elections are held the first Tuesday in November of odd-numbered years.)
The amount of additional property taxes that may be raised locally is limited to
20 percent of a district's school finance funding. Sources of revenue that must be offset
against this 20 percent include any property tax increases approved by the district
electorate since 1988, any specific ownership taxes attributable to voter-approved
property tax increases, and any specific ownership tax revenue attributable to a bond
redemption levy which is not being used to satisfy bonded indebtedness.
In addition to prescribing the date for school district property tax elections,
Article X, Section 20 of the constitution also includes other requirements for tax
increase elections. For example, districts must mail a notice of the election detailing
the election date, hours, ballot title, text, and local election office address and telephone
number. The notice must also include historical spending data, an estimate of the E
maximum increase in taxes, the district's spending without the tax increase, and
summaries for and-against the proposal.

CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material Injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
2) The construction of this well shall be-in compliance with the Water Well Construction Rules 2 CCR 402-2, unless
approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump
Installation Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-90-105.
4) Water from this well may be used for domestic purposes Inside one (1) single family dwelling.
5) The maximum pumping rate shall not exceed 15 GPM.
6) The annual appropriation shall not exceed 1 acre-foot.
7) The Irrigated area shall not exceed 1 acre of lawn and garden.
8) Production is limited to the alluvium of Lost Creek or its tributaries. The depth of this well shall not exceed 80 feet
or the depth at which sandstone or shale is first encountered, whichever comes first.
