Planning Commission for the City of Fort Lupton reviewed the above mentioned referral at our
regular meeting of November 22, 1994.
The Commission had several concerns regarding this referral. They felt the packet did not contain
enough information on which to base a decision. The information in the packet indicates the
water source will be shared but it does not indicate how the water will be distributed. The
Commission feels that adequate water may become a problem in this subdivision. The packet also
indicates there will be a sewer system but does not indicate how it will be set up in order to
make a recommendation on this referral the Commission will need more information. If you
would like to provide us with more information prior to our next meeting we will review the
referral again_ Our next meeting will be held on December 13, 1994.

Reference is made to the Martin Brothers Partnership Project (your Case Number
SCH-13) located in the Northwest Quarter of Section 12, Township 1 North, Range 66 West,
Weld County, Colorado.
If any work associated with this project requires the excavation in or placement of
dredged or fill material, either temporary or permanent, into wetlands at this location, this
office should be contacted for proper Department of the Army permits pursuant to Section
404 of the Clean Water Act.

Mr. Martin has asked the Fort. Lupton Fire Protection District
response request for this sub-
division
Board for a variance ir��responseto .o have an approved water supply under the requirements
of the 1991 Uniform Fire Code.
Mr . Martin has submitted to the District Board a proposal of
the new home owners to install residential sprinklers in each
home pur chased in this subdivision.
The Fort Lupton Fire Protection District Board has accepted this
proposal with the following stipulations.
1. All homeowners sign an agreement in the form of a covenant
provided by Mr. Martin or a homeowners association to cover
the installation, ?< maintance of the residential sprinkler _system.
2. All residential sprinkler systems to be installed by a
state certified sprinkler- company.
-.. The residential sprinkler system shall be installed under.
NFPA 13;0 standards.
4 . The proposed installation of the seven -- 10,000 gallon water tanks
have fill valves installed capable of filling any of our tanker
trucks 24 hours a day, 7 days a week, 365 days a year.

In reviewing the application for Martin Brothers Partnership
I see that theare r-equi r�-ed to put a "F'ubl i c Water System"
in the subdivision. Under the 1991 Uniform Fire Code, Article
10 Division IV, this system shall have approved water supply
capable of supplying the required fire_ flow to all remises
upon which facilities, buildings or portions of buildings are
hera+ter" constructed or moved into or within the jurisdiction.
When any portion of the facility or building protected is in
excess of 150 feet from a water supply on a public:: street, as
measured by an approved route around the exterior of the facility
or building, on site fire hydrants and mains capable of supplying
the required fire_ flow shall be provided when required by the
chief.

Martin Brothers have provided information regarding what they
propose, in general terms, as a "public water system." They have
indicated that they propose to lower the costs of the project by
serving groups of lots by wells rather than one central supply
system supplying all of the lots. They also indicated that they
propose the creation of a homeowners association with its powers to
include provision of water and that the homeowners association will
likely be incorporated.
The Weld County Zoning Ordinance, which does require "public water"
for the planned unit development, describes public water and public
sewer facilities as those which are "constructed, operated, or
maintained by any group, organization, special district, or
municipality for the purpose of providing the members of the group,
organization, special district, or municipality with common water
. . . facilities." It is my opinion that an organization, such as
a homeowners association, would be such an organization or group
available as a public water purveyor.
I would suggest you consider requiring the developer to create a
homeowners association in accordance with the Colorado Common
Interest Ownership Act and that the association have powers to
transmit, store, treat, collect, and distribute water; that the
association be incorporated in some form; that the association have
adequate powers to build, maintain, and provide financing for the
water system; and that the association be subject to the drinking
water standards as community water supply.

Dear Mr. Morrison:
In order to comply with the Weld County Zoning Ordinance's definition of Public Water,
we commissioned WRC Engineering. Inc. to develop a proposal that would be economical,
oversetable, and practical for the property.
WRC Engineering recommended a central system or a series of smaller systems to serve
the property- They concluded that the series of smaller systems would be the most workable.
The ownership, control and maintenance of these systems would be through the
Homeowners Association of the Martin Brothers Estates.
The Colorado State Water Commission has indicated that the development of smaller
systems serving groups of lots would be acceptable to the State.

Dear Mr. Childs:
Per our recent discussions, you have asked what are the possible means to provide a public water
system or system(s) for the proposed Martin Brothers PUD Project located in Weld County, Colorado, given
the Weld County denial to use individual lot wells for this project.
Large lot developments can be provided water either through a single system or a combination of
smaller systems. Although a single system is more typical for smaller lot subdivision, they can be costly to
both construct and maintain for large lot subdivisions. This is due mainly to the additional line length and
size needed to serve water to lots in the subdivision furthest away from the water supply source. In this case,
the water supply source must be consolidated for storage, chlorination, and distribution storage.
An alternative for large lot subdivisions is to use a combination of systems, each serving a smaller
portion of the subdivision. In this manner, line sizes and lengths can be reduced, resulting in lower intial
costs and line maintenance costs. The number of lots to be served by these smaller systems is usually a
function of the potential well capacities to serve each individual system. We have previously designed systems
for small subdivisions including a system currectly under construction to serve a 12 lot subdivision. These
systems can also assist in project phasing and avoid problems of having a system designed for a large
subdivision initially serving only a small number of homes.
As with any type or size of rural system, agreements are necessary among the homeowners in order
to establish methods for funding of operation and maintenance activities.
Once you have selected an agreeable subdivision layout, we would be pleased to provide you estimates
of costs to construct both a single system and a series of smaller systems as well as advise you as to the
benefits and liabilities of each type of system.

of the parcel of land for which this application has been submitted is approximately 3/4 miles south of Weld County
Road 12 and approximately 3/4 miles west of Weld County Road 37.
